Provision of L2 high-speed transmission lines service for Polska Sp-łka Gazownictwa sp. Z o. O. in the Specification of Essential Terms of Order (hereinafter: the Terms of Reference) in the scope of data and voice transmissionand video through the backbone network implemented in Ethernet technology in the Contractor`s network. A detailed list of locations covered by the contract with their parameters is included in point 2 of the Detailed description of the subject of the contract, constituting Annex 5 to the ToR.

The subject of the contract is the provision of high-speed L2 transmission lines for Polska Społki Gazownictwa sp.z o.o. Benefit toservices consists in making available at the Employer`s locations telecommunication transmission access links with specified parameters to the Contractor`s network in which the L2 network service will be provided, as well as setting up and maintaining with the appropriate SLA for the duration of the telecommunication connections contract in point topology point.

In Tarnow locations, the Employer requires the provision of services on a separate fiber optic cable. In other locations, the opera house`s infrastructure can be used to implement the L2 linktrack on which other services for PSG are provided, in which case all service work must be carried out at different times for each of the services.

Installation cost cannot be greater than 5% of the total value of the offer.

I. Contractors who can apply for the contract:

1. not subject to exclusion;

2. meet the following conditions for participating in the procedure:

2.1 have competencerights or authorizations to conduct specific professional activities, provided that it results from separate provisions, i.e. they show that they are entered in the register of telecommunications entrepreneurs kept by the President of the Office of Electronic Communications (in accordance with the Act of 16 July 2004 Telecommunications Law);

2.2. Are in an appropriate economic and financial situation, i.e. as defined in pointIII.1.2) notices;

2.3 have specific technical or professional capacity as specified in point III.1.3) of the advertisement.

II. Contractors are excluded from the proceedings in the cases referred to in art. 24 paragraph 1 point 12, 13 a c, 14 (subject to point 7.1.3 below) 23 of the Act, as well as in the cases referred to in art. 24 paragraph 5 point 1 8 of the Act.

III. Assessment of compliance with the abovementioned conditions have been madeThe formula "meets does not meet", based on the information contained in the JEDZ, statements and documents to be provided by the Contractors to confirm compliance with the conditions for participation in the procedure and the lack of grounds for exclusion from the procedure.

IV. List of statements and documents they have provide the Contractor to confirm compliance with the conditions for participation in the procedure and the lack of basic provisionsand foreclosure.

1. Documents and declarations made obligatorily with the offer by all Contractors:

- offer prepared on the offer form constituting Annex 1 to the ToR,

- current statement as at the date of submission of tenders to the extent specified in this ToR in the form of a single document; EAT is made according to the model standard form specified in the RegulationExecutive Committee of the European Commission issued on the basis of art. 59 clause 2 of Directive 2014/24 / EU and art. 80 deg. 3 of Directive 2014/25 / EU. The single document that should be submitted together with the offer is available on the Employer`s website at https://zamycji.psgaz.pl, justification of the trade secret, if the Contractor reserves the trade secret,

- full applicablepowers, if the offer is signed by a proxy,

- if the Contractor relies on the abilities or situation of other entities, the obligation of these entities to provide him with the necessary resources at the disposal of the contract,

- document confirming the payment of the bid security, if the bid security is lodged in non-monetary form (details regarding the tender bond are explained in item 10 SIWZ).

Other documents shall be submitted by the Contractor at the request of the Employer.

An offer prepared in accordance with the template constituting Annex No. 1 to the ToR and the Uniform Document should be prepared under pain of nullity in an electronic form with a qualified electronic signature issued by the qualified trust service provider who is the entity providing certification services in the field ofelectronic signature, meeting the security requirements set out in the Act of 5 September 2016 on trust and electronic identification services (Journal of Laws of 2019, item 162 jt) and submitted via the PSG purchasing platform.

To confirm the condition specified in point 2.1 above (6.1.2.1 of the ToR), the Contractor shall submit a document confirming that he has been entered in the Register of Entrepreneurstelecommunications operated by the President of the Office of Electronic Communications. uniform documents regarding these entities, prepared in electronic formj and provided with a qualified electronic signature by the entity to which the documents relate. Contractors who are in an appropriate economic and financial condition, i.e.: have financial resources or creditworthiness in the amount ofnot less than PLN 500, 000;

b) they are insured against civil liability in respect of the activities related to the subject of the contract for an amount not less than PLN 500, 000.

II. The Contractor, at the request of the Employer, to confirm the condition specified in point I above (6.1.2.2. ToR) shall submit:

a) information from the bank or cooperative Savings and Credit Unionthe amount of financial resources or creditworthiness of the Contractor, not earlier than 1 month before the deadline for submission of bids;

b) a document confirming that the Contractor is insured against civil liability in the scope of conducted activities related to the subject of the contract;

III. For preliminary confirmation of compliance with the conditions for participation in the proceedings, (in point 6.1.2.2 of the Terms of Reference), it will be sufficient for the Contractor to submit a proper statement to JEDZ in Part IV: Qualification criteria, section α.

IV. The contractor may rely on technical or professional capacity or financial standing to confirm compliance with the conditions for participation in the procedure, where appropriate and in relation to a specific contract or part thereof.or economic activity of other entities, irrespective of the legal nature of the legal relations with it. Detailed rules are specified in the ToR.

I. The Awarding Entity, before awarding the order, will call the Contractor whose bid has been best assessed to be submitted within a designated period, not shorter than 10 days, valid on the day of submitting the statements or documents confirming the circumstances for whichthose referred to in art. 25 paragraph 1 of the Public Procurement Law, i.e.: i.e., documents referred to in point III 1.2. and point III.1.3. of this announcement;

2) information from the NQF in the scope specified in art. 24 paragraph 1 point 13, 14 and 21 of the Public Procurement Law and regarding conviction for an offense against imprisonment, to the extent specified by the Employer pursuant to art. 24 paragraph 5 points 5 and 6 of the Public Procurement Law, issued not earlier than 6 months beforethe deadline for submission of bids (subject to Article 133 (4) of the Public Procurement Law);

3) a certificate from the competent Head of Tax Office confirming that the Contractor is not in arrears with tax payments, issued not earlier than 3 months before the deadline for submitting bids or another document confirming that the Contractor has concluded an agreement with the relevant tax authority regarding the repayment of these receivables, together with anyactual interest or fines;

4) a certificate from the appropriate local organizational unit of ZUS or KRUS or other document confirming that the Contractor is not in arrears with payment of social security or health insurance contributions, issued not earlier than 3 months before the deadline for submitting bids or another confirmation document that the Contractor has concluded an agreement with the competentauthority on the repayment of these receivables together with any interest or fines;

5) an excerpt from the relevant register or CEiDG, if separate provisions require an entry in the register or a record in order to confirm the absence of grounds for exclusion pursuant to art. 24 paragraph 5 point 1 of the Public Procurement Law;

6) the Contractor`s statement that he has not issued a final court judgment or final administrative decisionjo in arrears with the payment of taxes, fees or social security or health insurance contributions or in the event of such a judgment or decision of documents confirming the payment of such receivables together with any interest or fines or the conclusion of a binding agreement on the repayment of these receivables;

7) the Contractor`s statement on no judgment against him in the titlea preventive prohibition to apply for public procurement;

8) the Contractor`s statement of the failure to issue a final judgment of the convicting court for the penalty of restriction of liberty or a fine to the extent specified by the Employer pursuant to art. 24 paragraph 5 points 5 and 6 of the Public Procurement Law;

9) the Contractor`s statement of the lack of issuing to him the final administrative decision on violation of obligationsarising from labor law, environmental protection law or social security provisions to the extent specified by the Employer pursuant to art. 24 paragraph 5 point 7 of the Public Procurement Law;

10) the Contractor`s declaration of non-payment of local taxes and fees, referred to in the Act of 12 January 1991 on local taxes and fees (Journal of Laws of 2018, item 1445);

11) completedof Annex 6 Price specification (to confirm the requirement of section 3.4 of the Terms of Reference that the cost of installation cannot be greater than 5% of the total value of the offer).

II.
