Framework agreement with a single economic operator, according to the provisions of art. 114 and art. 115, par. (1) and par. (2) lit. of) of Law no. 98/2016, art. 9 par. (3) lit. b) of GD no. 395/2016, given that the exact quantities are not known at the time of initiation of the procedure.

Integrated communications services (fixed telephony, mobile telephony and online video communication) for National Penitentiary Administration, defenset and the penitentiary units subordinated to it, as users of the legal person type, according to Annex no. 4, attached to the specification or as follows:

1) Mobile subscriptions - full subscription

Amounts frame agreement 24 months:

- Minimum quantity monthly subscriptions - 60,

- Maximum amount of frame agreement subscriptions - 4 800,

Subsequent contract quantities:

- Quantity-minimum subscriptions for 2 months - 2,

2) Mobile phone subscriptions - medium subscriptions

1 ) Requirement: The bidders, third parties and subcontractors must not find themselves in the situations provided for in art. 59 60, 164, 165, 167 of Law no. 98 / 2016.

Means of performance: DUAE will be completed by the operatoreconomic participants of the award procedure with the information related to their situation. The supporting documents proving the fulfillment of the undertaken by completing the DUAE are to be submitted, at the request of the contracting authority, only by the bidder ranked first in the intermediate rankings drawn up at the completion of the tender evaluation. Along with DUAE, form 1 will also be posted; 2) Requirement: Certificates of absence of overdue debts, taxes or contributions to the consolidated general budget (local budget, state budget, etc.) at the time of the request. Requested, mandatory requirement

Mode of accomplishment: will be presented to the DUAE, completing the sections related to the required requirements.

For Romanian legal / physical persons will be presented documsupporting documents, respectively the certificates confirming the payment of taxes and duties to the consolidated general budget and the local budget, and for foreign legal entities / physical persons shall present the editorial documents issued by the competent authorities of the country of residence, proving the fulfillment of the outstanding debts of the payment of the taxes to the state budget and local budget, ccompliance with the legislation of the country of residence at the time of filing these documents. The above-mentioned documents will only be presented by the tenderer ranked first, at the request of the contracting authority, upon completion of the evaluation of the tenders. Notes:

1) The failure of the DUAE with the offer (including the associate / third party) ;

2) They will-filed with the DUAE the following documents: the firm's firm commitment to the third party, resulting in the actual manner in which its sustainability, subcontracting agreement and / or association agreement will materialize, as the case may be. Failure to do so with the DUAE is a basis for requesting clarification of any inaccurate form of information contained in sectionsDUAE, both of the tenderer / candidate and of the subcontractor / third party, which is necessary to ensure the proper conduct of the award procedure. Requirement 1: For the qualification, the contracting authority requests general information that will necessarily contain the average annual turnover for the years 2015, 2016, 2017, in function on the date on which the tenderer was established or started to operate. For the calculation of equivalence the annual average RON will be used/ min reported by the NBR for each of the three years: 2015, 2016 and 2017 respectively.

Minimum turnover in the field of the public procurement / framework agreement object, related to the value of the higher subsequent contract, respectively 56 863, 36 RON (VAT excluded), according to art. 175 par. (2) lit. a) of Law no. 98/2016 and art. 107 par. (1) lit. f) of GD no. 395/2016. The requirement a-has been requested in view of the volume, complexity and nature of the framework agreement to be concluded. Thus, the contracting authority, in order to designate the winner of the award procedure, shall ensure that the tenderer has the capacity that the firm, body, legal entity to carry out the future contract.

The beneficiary penitentiary units reserve the right to resize the minimum and maximum amounts of the subsequent contracts, depending on the allocated resources and needs, up to the cantesthe maximum level of the framework agreement - Given that the award documentation contains a minimum set of specific information on estimates of the minimum and maximum quantities that may be required throughout the framework agreement as well as estimates of minimum and maximum quantities which could be the subject of a single subsequent contract, of those to be awarded on-the duration of the framework agreement, we underline that these minimum and maximum quantities that the contracting authority initially sets out in the awarding documentation and subsequently in the framework agreement represent estimates of quantities that might be required throughout the entire framework agreement and not the quantities the exact ones to be purchased, the latter being smaller, equal or larger, in relation to the estimated ones, according to the actual needs of the contracting authority. Consequently, corroborating the provisions of art. 20 par. (8) lit. f) with those of art. 108 par. (1) of H.G. no. 395/2016, the contracting authority has the right to conclude subsequent contracts for a quantity additional to the maximum amount provided in the framework agreement whenever it intends to purchasethe products / services / works subject to the respective framework agreement, provided that the cumulative value of all such contracts does not lead to circumvention of the application of those provisions of the law imposing obligations on the contracting authority in relation to certain value thresholds. in which two or more bids are ranked first, with equal points, tie-will be made taking into account the score obtained in the evaluation factors in descending order of their weight. If the equality is maintained, the contracting authority has the right to request new financial proposals and the winning bid will be the one with the lowest financial proposal.
