Provision of technical support services for the Red Hat JBoss Enterprise Application Platform software owned by the Employer

1. The subject of the order is the provision of technical support services for the Red Hat JBoss Enterprise Application Platform software owned by the Ordering Party for 36 months, fromfrom the day of signing without reservations of the Receipt Confirmation Protocol, but not earlier than from 1.6.2020

1. Provision of technical support service for the Red Hat software owned by the Employer:

- Red Hat JBoss Enterprise Application Platform 16-Core Standard 1 pcs,

- Red Hat JBoss Enterprise Application Platform, 64-Core Standard 2 pcs

2. Detailed conditions, scopeand the rules for implementing the subject of the contract are set out in the relevant provisions of the contract contained in volume II of the ToR.

1. Contractors who are not subject to exclusion and who meet the conditions of participation in the procedure specified by the Employer may apply for awarding the order.

2. The Contractor in relation to which any of the Fr.Circumstances referred to in art. 24 paragraph 1 point 12 23 and para. 5 item 1 8 of the PPL Act

3. The Contractor is obliged to submit a current statement as at the date of submitting the offers constituting a preliminary confirmation that the Contractor is not subject to exclusion and meets the conditions for participation in the procedure.

4. The declaration referred to in item 3. The Contractor is obliged to submit a single document drawn upit in accordance with the template of the standard form set out in the European Commission implementing regulation issued on the basis of art. 59 clause 2 of Directive 2014/24 / EU, hereinafter referred to as the "single document".

5. At the request of the Employer, the Contractor is obliged to submit the following statements or documents:

5.5.1. In order to confirm the lack of grounds for excluding the Contractor from participation in the proceedings:

1) information from the National Criminal Register in the scope specified in art. 24 paragraph 1 point 13, 14 and 21 of the Public Procurement Law and, regarding conviction for an offense against imprisonment, to the extent specified by the Employer pursuant to art. 24 paragraph 5 points 5 and 6 of the Public Procurement Law, issued not earlier than 6 months before the deadline for submitting bids;

2) a certificate from the competent head of the tax officerusting that the Contractor is not in arrears with payment of taxes, issued not earlier than 3 months before the deadline for submitting bids or other document confirming that the Contractor has entered into an agreement with the competent authority on the repayment of these receivables together with any interest or fines, in particular obtained release, deferral or installment of overdue pease or withholding in full of the decision of the competent authority;

3) certificate of the competent organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the Contractor is not in arrears with payment of social security or health insurance contributions issued not earlier than 3 months before the expiry of the deposit periodgiving offers or other document confirming that the Contractor has entered into an agreement with the competent authority on the repayment of these receivables together with any interest or fines, in particular, he obtained the exemption provided for by law, deferment or installment of overdue payments or withholding in full the decision of the competent authority;

4) an excerpt from the relevant register or from the central ewidata and information on business activities, if separate provisions require an entry in the register or a register in order to demonstrate the lack of grounds for exclusion pursuant to art. 24 paragraph 5 point 1 of the Public Procurement Law;

5) the Contractor`s statement that he has not issued a final court judgment or a final administrative decision regarding arrears with the payment of taxes, fees or insurance premiumspecuniary or health or in the event of the issuance of such a judgment or decision documents confirming the payment of these debts together with any interest or fines or the conclusion of a binding agreement on the repayment of these debts;

6) the Contractor`s statement that there was no decision against him as a preventive measure prohibiting him from applying for public procurement,

7) statementsnot to the Contractor about the failure to issue a final judgment of the convicting court for an offense of restriction of liberty or a fine to the extent specified by the Employer pursuant to art. 24 paragraph 5 points 5 and 6 of the Public Procurement Law

8) the Contractor`s statement that he has not issued the final administrative decision regarding the breach of the obligations arising from legal provisionsand work, environmental protection law or social security regulations to the extent specified by the Employer pursuant to art. 24 paragraph 5 point 7 of the Public Procurement Law;

9) the Contractor`s statement of non-payment of local taxes and fees, referred to in the Act of 12.1.1991 on local taxes and fees (Journal of Laws of 2016, item 716 of later changes).

5.5.2. If the Contractor has its registered office, lor place of residence outside the territory of the Republic of Poland, instead of the documents referred to in item 5.5.1. notices (section III.1.1):

1) point 1 submits information from the relevant register or, in the absence of such register, another equivalent document issued by the competent judicial or administrative authority of the country in which the Contractor has its registered office or place of residence or place of residencethe person who is affected by the information or document has the bullying in the scope specified in art. 24 paragraph 1 point 13, 14 and 21 and par. 5 points 5 and 6 of the Public Procurement Law;

2) point 2 4 submits a document or documents issued in the country in which the Contractor has its registered office or place of residence, confirming respectively that:

a) he is not in arrears with payment of taxes, fees, insurance premiums social or health or thatentered into an agreement with the competent authority regarding the repayment of these receivables, together with any interest or fines, in particular, it obtained a legal exemption, deferment or distribution in installments of overdue payments or withholding in full the decision of the competent authority,

b) its liquidation has not been opened or announced bankruptcy.

5.5.3. Documents referred to in items 5.5.2.1 andpoint 5.5.2.2 lit. b, should be issued not earlier than 6 months before the deadline for submission of tenders. The document referred to in item 5.5.2.2 lit. a, should be issued not earlier than 3 months before the expiry of this period.

5.5.4. If in the country where the Contractor has its registered office or place of residence or place of residence there is a person to whom the document relates, no document is issuedreferred to in point 5.5.3., they are replaced by a document containing, respectively, a statement of the Contractor, with an indication of the person or persons authorized to represent him, or a statement of the person to whom the document was to relate, made before a notary public or before a judicial or administrative authority, or a professional or economic self-government body competent for the seat or place behindContractor`s apartment or place of residence of that person. Point 5.5.3. shall apply.

5.5.5. In the event of doubt as to the content of the document submitted by the Contractor, the Employer may contact the competent authorities of the country in which the Contractor has its registered office or place of residence or place of residence, respectively, of the person to whom the document relates, to provide the necessary information regarding thisthe document. 5.5.6

. The Contractor having its registered office in the territory of the Republic of Poland, in relation to a person residing outside the territory of the Republic of Poland, to whom the document referred to in point 5.5.1.1 applies, shall submit the document referred to in point 5.5.2.1, to the extent specified in art. 24 paragraph 1 points 14 and 21 and par. 5 point 6 of the PPL Act. If in the country where the place of residenceand the person to whom the document was to relate does not seem such documents, it is replaced by a document containing the person`s statement submitted before a notary public or before a judicial, administrative or professional or economic self-government body competent for the place of residence of that person. The document should be issued not earlier than 6 months before the expiry of the terminu submission of tenders.

The rest of section III.1.3 of the announcement

The Contractor entering the tender is required to submit a deposit of PLN 10, 000.00 (say: ten thousand zlotys).

2. The bid security is lodged before the bid submission deadline.

3. The bid bond may be lodged in one or several of the following forms:

1) in cash;

2) bank guarantees or cooperative suretiesmandatory and credit, except that the guarantee must be a cash guarantee;

3) bank guarantees;

4) insurance guarantees;

5) guarantees granted by entities referred to in art. 6b paragraph 5 point 2 of the Act of November 9, 2000 on the establishment of the Polish Agency for Enterprise Development (Journal of Laws of 2014, item 1804 and of 2015, items 978 and 1240).

4. The bid security must be carried outthe offer validity period and may not contain any restrictions contrary to the Act, in particular those limiting the possibility of exercising the rights specified in art. 46 section 4a and 5 of the Act.

5. 60 days should be understood under the 2 months offer validity period.

6. The contractor, before signing the contract, is required to provide a performance bond of 5% of the offer price.
