The specialized technical assistance service through site managers consists of verifying the correct execution of the construction works in complianceis with the requirements imposed in the specifications and in compliance with the legal regulations in force.

Main Site: Timisoara, Str. Burebista no.5, at the supplier`s premises and at the beneficiary`s premises (as the case may be).

Based on the contract, the specialized technical assistance service will be provided by site managers who consists in verifying the correct execution of the construction works execution.in accordance with the requirements imposed in the specifications and in compliance with the legal regulations in force.

The site manager will provide specialized technical assistance through site managers for the works related to the investment objective, both during the execution of the works (12 months), as well as during the guarantee period of the executed works, until the final reception of athem (60 months).

All services provided will comply with the specifications.

The City of Timisoara will exclude at any time of the procedure for awarding the service contract any economic operator that is in one of the situations provided in art. 60, 164, 165 and 167 of Law 98/2016 on public procurement.

The reasons for exclusion will be applied in the case ofcompanies / subcontractors / third-party supporters, as the case may be

Fulfillment mode: under the sanction of rejecting the offer as unacceptable, each economic operator participating in the award procedure, (bidder, associate bidder, subcontractor, third party supporter, as the case may be) will present with offer, DUAE distinct, completed in SEAP with the information related to their situation.

They will be presented:

(a) the declaration on its own responsibility regarding the non-classification in the situations potentially generating conflicts of interests, as defined in art. 60 of Law no. 98/2016 by all participants in the procedure and

(b) if applicable, the firm commitment of the supporting third party accompanied by documents from which results the effective way in which its support will materialize, the agreement ofsubcontracting and / or association.

The supporting documents proving the fulfillment of those assumed by completing the DUAE will be presented, only at the request of the contracting authority, to the tenderer who is in the first place after applying the award criterion on the admissible offers.

The supporting documents can be:

1 . certifying certificates regarding the lack of debts regarding the paymentyour taxes, taxes or contributions to the general consolidated budget (local budget, state budget, etc.) at the time of presentation;

2. the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the respective economic operator or of those who have power of representation, decision or control within it, asulta from the certifying certificate issued by the ONRC / the constitutive document;

3. if applicable, documents proving that the economic operator can benefit from the derogations provided in art. 166 para. (2), art. 167 para. (2), art. 171 of Law 98/2016 on public procurement;

4. other edifying documents, as the case may be

The requested documents will be presented in Romanian / the language in which they wereissued with the translation into Romanian, as the case may be.

The economic operators who submit the offer must prove a form of registration under the law of the country of residence, from which toit turns out that the economic operator (bidder and, if applicable, associated bidder), is legally constituted, that it is not in any of the situations of cancellation of the constitution, as well as the fact that it has the professional capacity to carry out the activities that are the object of the contract.

Modality of fulfillment: will be presented DUAE completed in accordance with prev. art. 193 of Law 98/2016 with the latest complexcountries and changes. The supporting documents proving the fulfillment of those assumed by completing the DUAE, respectively the ONRC certificate / equivalent documents issued in the country of residence, are to be presented only at the request of the contracting authority, by the first-place bidder, after applying the award criterion on the admissible offers. The information contained in the certificatesas / the equivalent document must be real, valid at the date of its presentation. In the case of a common offer submitted by several economic operators, the requested documents will be presented by each economic operator signing the association agreement, for the part of the contract they perform. The requested documents will be presented in Romanian / the language in which they were issued, instranslation hoops in Romanian, as the case may be.

1. Within the documents attached to the participation notice published in SEAP, DUAE is configured directly in SEAP and made available to interested economic operators. The participating economic operators will fill in the SEAP, directly, in this document.

The information / answers related to the classification / non-classification in the exclusion reasonsmeeting the qualification criteria requested by the contracting authority, taking into account the quality in which they participate in the award procedure, respectively bidder, associate bidder, subcontractor, third party supporter, as the case may be.

2. In order to view the attached documents, the economic operators must have a program necessary to view the electronically signed files.

3. operatedeconomic hours have the right to submit the offer (DUAE completed, the declaration regarding the non-compliance with the provisions of article 60 of Law no. 98/2016, the technical proposal, the financial proposal, the supporting document regarding the establishment of the participation guarantee and, if applicable, the commitment to support of the supporting third party, the association and / or subcontracting agreements), only in electronic format, semnates with the extended electronic signature and only up to the date and time limit set for submitting tenders in the participation announcement.

4. Requests for clarifications regarding this award documentation will be addressed exclusively in SEAP, within the award procedure carried out by electronic means, the contracting authority not to respond to the requests addressedby another means of communication than the established one. Any interested economic operator has the right to request further clarifications or information regarding the award documentation, in compliance with the deadline specified by the contracting authority in section II.1.4 of this document, respectively no later than 20 days before the deadline. the limit set for the depositshe offers. Clarifications submitted after this deadline will no longer be considered. According to art.160, 161 of Law 98/2016, the contracting authority will respond clearly and completely to all requests for clarification / additional information, on the 11th day before the deadline set for submission of tenders, to the extent that they are will be addressed within the time limit set in the yearparticipation rate. The consolidated response to the requested clarifications will be published in the SEAP, within the participation announcement. In case the contracting authority requests the presentation of certain clarifications / completions in order to verify the conformity of the offer with the imposed requirements, both the request and the tenderer`s reply are transmitted in SEAP, only in electronic format, signed withextended electronic signature. In the situation where the bidder`s response is posted in SEAP, without the extended electronic signature, his offer will be assimilated to the provisions of art. 137 para. (2) lit. j) from GD 395/2016, being rejected as unacceptable.

6. If, following the application of the award criterion "the lowest price", it is found that two or more offers ranked first, are pricedEqual countries will be required to re-offer through SEAP. If this is not achievable for reasons attributable to the SEAP operator, bidders will be asked for a new offline financial proposal. The contract will be awarded to the bidder whose new financial proposal has the lowest price.
