Technical assistance through project supervisors for the investment objective "Skateboard development in Central Parkin the city of Timisoara ", according to the requirements imposed by the awarding documentation, unique identification code: 14756536-2018-PAAPD 1001606.

Main Site: Central Park Timisoara and / or at the beneficiary's premises (as the case may be) technical through project supervisors for the investment objective "Skateboard Running in the Central Park in Timisoara", in accordance with the requirements imposed by the awarding documentation

The site engineer will act as representative of the beneficiary in relation to the designer, the constructor, the suppliers, the service providers in the execution of the works contract

The contract will provide the following services:

- Technical Assistance to the Beneficiary in the Works Contract, - The monitoring and supervision of the construction works, according to the provisions of the Romanian legislation in force (Law No. 10/1995, Government Decision no. 343 / 18.5.2017 regarding the approval of the Regulation for the reception of the construction works and related installations, Government Decision No. 766/1997 regarding the approval of certain regulationsquality in construction, Order no. 1496/2011, as amended and supplemented by Order no. 277/2012)

The duration of the contract is from the date of issue of the order for commencement of works up to the final acceptance of the execution works, respectively 3 months, plus the warranty period for the execution of the 5-year works (60 months ). The contract takes effect until the final reception.

Timisoara shall exclude at any time the procedure for the award of the service contract, any economic operator who is in one of the situations provided in art. 60, 164, 165 and 167 of Law no. 98/2016 on public procurement. Exclusion reasons will also be applied to associates / subcontractors / third-party supporters, as appropriate.

Means of performance: under the sanction of respirationthe bidder as unacceptable, each economic operator participating in the awarding procedure (tenderer, associated bidder, subcontractor, third party, as the case may be) will present with the offer and DUAE completed according to the provisions of art. 193 par. (1) of the Law no. 98/2016, with information related to their situation.

Will be presented:

(a) Statement of non-compliance with situationsgenerating conflicts of interest, as defined in art. 60 of Law no. 98/2016, by all participants in the procedure; (b) Where appropriate, the firm's firm commitment to documents supporting the manner in which its support, subcontracting and / or association agreement will materialize. The supporting documents that prove to be successfulThe supporting documents may be:

1) Finding certificates regarding the lack of debts due to the payment of taxes, taxes or of the contributions to the consolidated general budget (local budget, buget the state, etc.) at the moment of the presentation, 2) the judicial record of the economic operator and of the members of the administrative, management or supervisory body of the respective economic operator or of those who have the power to represent, decide or control in its framework, as it results from the certifying certificate issued by the ONRC / constitutive act, 3) as the case, documents by whichit demonstrates that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016 regarding public procurement, 4) Other editing documents, as the case may be

1) Within the documents attached to the participation announcement published in the SICAP, the DUAE is made available to economic operators interested in the format editable in order to complete it by the bidders. The participating economic operators will fill in the information / response in this document(ie where they are clearly explained) and will not have the right to intervene on the DUAE format, respectively on the requirements for the exclusion or the fulfillment of the qualification criteria requested by the contracting authority that have the correspondence at the level of the data acquisition imposed by the contracting authority; 2) For viewing the document(3) The economic operators have the right to submit the offer (complete DUAE, the declaration on non-compliance with the provisions of Article 60 of the Law No. 98/2016, the technical proposal, the technical proposal, the financial proposal, the document proving the participation guarantee and if necessary, angthe supportive support of the third party, the association agreements and / or the subcontracting agreements), only in electronic format, signed with the extended electronic signature and only until the deadline and deadline set for the submission of the tenders in the tender notice; this awarding documentation will be addressed exclusively to the SICAP in the procedurethe awarding authority carried out by electronic means, the contracting authority will not respond to requests addressed by means of communication other than the established one. Requests for clarification (if applicable) will be submitted within the deadline for addressing the requests specified in Section II. point 1.4.) of this document, and those outside this deadline will no longerbe taken into account. Response to requests will be published in the SICAP within the tender notice; 5) If the contracting authority requests the submission of certain clarifications / completions, in order to check the compliance of the offer with the required requirements, both the request and the bidder's response are sent to the SICAP only in electronic format, signed with elect signatureextended rhonics. If the bidder's response is posted to the SICAP without the extended electronic signature, its offer will be assimilated to the provisions of Art. 137 par. (2) lit. j) of GD no. 395/2016, being rejected as unacceptable; 6) If, following the application of the award criterion, the "lowest price" finds that two or more first-ranked offers contain equal prices, it will beowing to re-routing through SICAP. If this is not feasible, for reasons attributable to the SICAP operator, a new offline financial proposal will be requested from bidders.
