- Preparing the application for financing for the Regional Infrastructure Development Project to step-Waste water from Covasna County that will be implemented during the financing period of the Large Infrastructure Operational Program (POIM), including the documents attached to the financing application (feasibility study, cost benefit analysis, institutional analysis, environmental impact assessment, topographic surveys, geo surveys, technical expertise, etc.),

- Ensuring the necessary support on parthe evaluation of the feasibility of the proposed project (technical, economic, financial, environment, etc.); - Making the awarding documents for the works, supply and services contracts resulting from the procurement plan that must be part of the feasibility study, in the bidding-contracting process,

- Elaboration of technical projects for contracts dis the type of execution of the works stipulated in the project, including assuring the assistance of the designer during the execution of the works, in accordance with the provisions of Law 10 / 1995.

1) Value of the guarantee of participation: 130 000 RON; 2) The period of validity of the guarantee Participation: 150 calendar days from the deadline for receipt of tenders; 3) The guarantee will be set in ccompliance with the provisions of art. 42 of H.G. 394/2016 in one of the following ways: - by bank transfer or bank guarantee letter, according to Form 1, - - by a guarantee instrument issued in accordance with the law by an insurance company, according to Form 1.

Notes: the guarantee must be irrevocable and must stipulate that the payment of the guarantee will be executed unconditionallyat the first request of the beneficiary, on the basis of his / her statement regarding the guilt of the guarantor.

In the case of submitting joint offers, the guarantee must be constituted on behalf of the association and be mentioned as jointly covering all members of the group of economic operators .

The guarantee issued in a language other than Romanian will be accompanied by an authorized translation into the Romanian languageThe proof of the guarantee will be submitted in electronic format (scanned in jpg or pdf format) in SEAP, the "Qualification Documents" section or will be submitted to the contracting entity's registry until the closing date and time for submission of tenders. the tender opening session, at the request of the evaluation commission, will be the original guarantee.the igrator will make available to the contracting authority a performance guarantee of the contract in the amount of 10% of the value of the contract accepted without VAT. The performance guarantee shall be submitted to the contracting authority within 5 working days of signing the contract and shall be constituted by bank transfer through a guarantee instrument issued under the terms of the law by a bank /insurance contracts which become an annex to the contract or, if the parties so agree, may be constituted by successive deductions from the amounts due for partial invoices (the initial amount deposited in the account open to the contracting entity may not be less than 0.5% the price of the contract). In the latter case, the contracting entity is to feed the available balance account by retention-successive of the amounts due and due to the contractor up to the amount set as a guarantee of good execution in the contract

The term of validity of the performance guarantee will be 67 months

The warranty letter of good execution is submitted in original, according to Form 2.

Notes:

In the case of submitting bids in association, the guarantee must be made on behalf of the association and be-mention that it collectively covers all members of the group of economic operators.

The guarantee is returned under the conditions specified in art. 48 of H.G. 394 / 2016.

The total annual turnover of the bidder for at least one of the last 3 years (2015, 2016, 2017) must be at least RON 13 000 000.

If the contracting authority sends an answer in the sense that it followsto take remedial measures, it has a 7-day period for their effective implementation.

The person who considers himself or herself to be prejudiced by the answer to the prior notice or who has not received any response within the 3-day period mentioned above, such as and any person who considers himself / herself injured by the remedial measures taken by the contracting authority mayrequest the council to cancel the act of the contracting authority, to oblige it to issue an act or to take remedial measures, as well as to recognize the claimed right or legitimate interest, within 10 days

Special conditions regarding the execution of the contract:

1) The award procedure is launched under the suspensive clause, meaning that the start of the contract (the issuance of the start order for the service contract activities) is conditioned by the conclusion of the financing contract with the Managing Authority for the service contract "Support for the preparation of the financing application and the awarding documents for the Regional Project for the development of the water and wastewater infrastructure in Covasna County "; 2) For activityII.4 - Support during the process of awarding service, supply and works contracts, activity II.5 - "Updating the general and objective estimates of the feasibility study after the completion of the public procurement procedure for all project contracts" and activity IV - technical assistance as designer in the execution phase of the works din the Tender Book the award procedure is launched under the suspension clause in the sense that the start of the contract for the activities II.4, II.5 and IV is conditioned by the conclusion of the financing contract with the Managing Authority for the investment project. Activity IV of the specification (Technical Assistance as Designer in the Conformity Workwith the provisions of Law no. 10 of 1995) will be budgeted and reimbursed by the Managing Authority as part of the regional project for the development of the water and wastewater infrastructure in Covasna County during 20142020.
