Monobloc electrically insulating taps and joints necessary for the execution of the project "Developments of S.N.T. in the cloud areaEastern Europe in order to improve the natural gas supply of the area and to ensure the transport capacities to the Republic of Moldova. "

Main Site: S.N.T.G.N. Transgaz S.A. - According to the detail of the attachment, where the lower value of the interval detailing the estimated value of RON 9, 449, 353 represents the estimated total value of the acquisition for quantitiesthe higher value of the interval detailing the estimated value of RON 11, 339, 224 represents the estimated value for a possible addition of the 20% contract to the quantity of the products through a review clause established in accordance with the provisions of Art. 236 of the Law no. 99 / 2016.

Revision of the contract price:

The quantity may varyie the actual needs of the contracting entity for the implementation of the "Developments of the S.N.T. in the northeastern part of Romania in order to improve the natural gas supply of the area as well as to ensure the transport capacities to the Republic of Moldova "with 20% of the estimated total quantity, thus the estimated value of the acquisition is between 9 449 353 RON and 11 339 224 RON.

If the review clause becomes operative, the unit prices for each product category will be kept unchanged at the level of the specification, followed by the mechanical application of the unit price to a possible addition of 20% to obtain the total value of the contract.

Both the economic operators participating in the procedure and the supporting third parties, the subcontractors, as the case may be, must not find themselves in the situations provided by art. 177, 178 and 180 of Law no. 99 / 2016.

Means of compliance by which the requirement can be demonstrated: will be completed by the DUAE, in accordance with the NAPA Notification no. 240/2016, both by the economic operators participating in the procedure and by third parties, the subcontractors, where appropriate, with-information about their situation (bidders, third parties, subcontractors, as the case may be). The supporting documents proving the fulfillment of the assumed by completing the DUAE shall be submitted, at the request of the contracting entity, only by the tenderer placed on the first place in the interim ranking made after the evaluation of the tenders has been completed. These documents can be:

- certifi- the criminal record of the economic operator and the members of the administrative, management or supervisory body of that economic operator or of the economic operator, those who have the power to represent, decide or contritateol as it results from the certifying certificate issued by the ONRC / constitutive document, - where appropriate, documents proving that the economic operator may benefit from the derogations provided for in art. 179 par. (2), art. 180 par. (2), art. 184 of Law 99/2016 on Sector Procurement, - other editorial documents, as the case may be.

Foreign natural / legal persons, whowishing to participate in the procedure, will present any editorial supporting documents issued by the competent authorities of the country in which they are resident, proving the fulfillment of the requirement.

Both the economic operators participating in the procedure and the third party supporters, the subcontractors, it must not be found in the situations provided in art. 73 of Law no. 99/2016 on sector acquisitions. Means of performance: Both economic operators participating in the procedure, and third party supporters, subcothe contractors, as the case may be, shall submit, together with the DUAE, the Declaration of non-compliance in the situations provided by art. 73 of Law no. 99/2016 regarding the avoidance of conflict of interest.

In the case of the joint offer: all the signatories of the Association Agreement will submit the above documents. 186 of Law no. 99/2016 on the sectoral acquisitions, the economic operators submitting the tenderyou have to prove your personal situation (the form of registration or professional membership in accordance with the legal requirements of the country where the economic operator is established). In this respect, the economic operators submitting the tender must prove a form of registration according to the law of the country of residence, to prove that the economic operator is a legal constitutionit is not in any of the situations of cancellation of the establishment and the fact that it has the professional capacity to carry out the activities that are the object of the contract

According to the provisions of art. 196 of the Law no. 99/2016, operatoeconomic operators have the right to use a third / third party to support the economic and financial situation.

Economic operators submitting a bid must show a minimum annual average turnover over the last 3 years (2015, 2016, 2017) of RON 9, 449, 353.

The term of supply of products is 12 months. If two or more bidare ranked first, with equal scores, the tie will be made taking into account the score obtained in the evaluation factors, in descending order of their weight. In the event that equality is maintained, the contracting entity has the right to request new financial proposals and the winning bid will be the one with the lowest financial proposal.

Requests for clarificationI would like to draw attention to the fact that the files attached to the clarification requests are visible to all participating economic operators We recommend that they do not contain identification data that can reveal the identity of the operators demanding economists, otherwise they will assume disclosureidentity. In the case of a joint offer, all signatories of the Association Agreement will fill in each separate DUAE with the information related to their situation. The supporting documents proving the fulfillment of the undertaken by completing the DUAE in sections III.1.1.a), III.1.1.b), III.1.2), III.1.3.a), III.1.3.b) shall be presented, at the request of the contracting entity, only by the tendererranked I in the intermediate rankings of the tender evaluation evaluation

In the case of the joint offer, the economic and financial situation, the technical and professional capacity is demonstrated by taking into account the cumulated resources of all the members of the group. The requirements regarding the quality assurance standards and environmental protection under Section III.1.3.b) will beindividually met by each member of the association for the part of the contract he / she makes. Bidders assume sole responsibility for the legality and authenticity of the SEAP loaded offer. All documents submitted to SEAP (offer, answers to clarification requests from the evaluation committee) will be signed signed with the extended electronic signature of the representativelegal / empowered entity of the economic operator. For the person empowered to sign the documents electronically, the empowerment granted in this respect shall be submitted within the offer.
