Renewal of technical support for Oracle products

The subject of the contract is the guarantee by the contractor for the manufacturer to provide the customer with technical support for Oracle software and support for Oracle equipment at the "Premier Support" level, on the principles and into the extent specified in the contract, Annex 5 to the ToR and in Annex 7 and 8 to the contract.

1. A contractor who is not subject to exclusion pursuant to art. May apply for awarding the contract. 24 paragraph 1 and paragraph 5 point 1 Public Procurement Law

2. In order to demonstrate the lack of grounds for exclusion, the contractor will be required to submit the following statements and documents:

a) information from the National Criminal Record inthe scope specified in art. 24 paragraph 1 point 13 lit. a c, art. 24 paragraph 1 point 14 in connection from paragraph 1 point 13 lit. a c and art. 24 paragraph 1 point 21 of the Public Procurement Law, issued not earlier than 6 months before the deadline for submission of bids;

b) an excerpt from the relevant register or from the Central Register and Information on Economic Activity, if separate provisions require an entry in the register or the register, in order to confirmno grounds for exclusion under Article 24 paragraph 5 item 1 of the Public Procurement Law;

c) a certificate from the competent head of the tax office confirming that the contractor is not in arrears with tax payments, issued not earlier than 3 months before the deadline for submitting bids, or another document confirming that the contractor has entered into an agreement with the competent tax authority regarding these repayments are duetogether with any interest or fines, in particular, he obtained the exemption, deferral or installment of overdue payments as provided for by law, or withholding in full the execution of the decision of the competent authority;

d) a certificate of the competent organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document reaffirmingego that the contractor is not in arrears with the payment of social security or health insurance contributions issued no earlier than 3 months before the deadline for submitting bids, or other document confirming that the contractor has entered into an agreement with the competent authority regarding the repayment of these claims together with any interest or fines in particular, he obtained the exemption provided for by law, fromannual or installment of overdue payments or withholding in full the execution of the decision of the competent authority;

e) the contractor's statement that he has not issued a final court judgment or the final administrative decision on arrears in payment of taxes, fees or social or health insurance contributions or in the case of issuing such a judgment or document decision pconfirming the payment of these debts together with any interest or fines or concluding a binding agreement on the repayment of those debts;

f) the contractor's declaration of non-payment of taxes and local fees, as referred to in the Act of 12.1.1991 on taxes and local fees;

g) declarations by the contractor that no decision has been issued against him as a measure forpost-pending prohibition to apply for public contracts;

h) the contractor's declaration of belonging or non-belonging to the same capital group. In the case of belonging to the same capital group, the contractor may submit, together with the declaration, documents or information confirming that links with another contractor do not lead to distortion of competition in the proceedings;

i) currento as at the day of submitting the offers, a declaration constituting a preliminary confirmation that the contractor is not subject to exclusion and meets the conditions for participation in the procedure. The contractor submits this statement on the form of the single European order document (EAT), to the extent specified by the contracting authority in the ToR.

3. Other information regarding participation in the proceedings is contained in the Material SpecificationThese Order Terms.

1. The contractor who can prove that he has the financial means or creditworthiness in the amount not less than PLN 1, 000, 000.00 gross is eligible to award the contract.

2. In order to confirm that the condition of participation is met, the contractor is required to submit information from the bank or cooperative savings and credit union confirming the amount of fundsfinancial or creditworthiness of the contractor, within a period not earlier than 1 month before the deadline for submission of bids.

If, for a justified reason, the contractor cannot submit the document referred to in the previous sentence, he may submit another document which sufficiently confirms the fulfillment of the condition of participation in the proceedings referred to in item 1.

Note: In the case of collaboratorsnon-applicants at least one of them must demonstrate that the condition has been met in full,

1. Document referred to in point III.1.1 point 2 lit. and this announcement, is submitted with the offer.

2. Document referred to in point III.1.1 point 2 lit. h of this notice, shall be submitted within 3 days from the date of posting the information referred to in art. 86 section 5 Pzp.

3. Behindthe ordering party will call the contractor whose bid has been highest rated to submit within a specified period, not shorter than 10 days, the date valid as at the date of submitting the declarations or documents referred to in point III.1.1 item 2 lit. a g and in point III.1.2 point 2 and in point III.1.3 point 2 of this notice.
