The subject of the order is:

Main Site: Warsaw, Poland

The subject of the contract is:

1) the provision of services in the field of maintenance and technical support of the Education System (SE) for a period of 24months from the date of signing the contract;

2) SE development of a maximum of 1, 500 working hours for a period of 24 months from the day of signing the contract;

3) updating the SE Documentation;

4) ensuring the transfer of property rights to the Employer for the effects of the Contractor`s work;

5 ) providing warranty and warranty services.

The detailed scope of the subject of the contract is specified in the "Description of the subject of the contract" stannexing Annex 1 to the ToR.

1. The awarding entity envisages using the procedure specified in art. 24aa section 1 of the Public Procurement Law.

2. Social clause point 3.4 of the Terms of Reference, Environmental clause point 3.3 of the Terms of Reference, Employment under an employment contract 3.5. Terms of Reference.

3. Information clause from art. 13 GDPR for the purpose related to the procedure for the award of a public contract (point 1.16 of the Terms of Reference). Rules forconfidentiality of data and information are specified in point 1.17 of the Terms of Reference.

4. The offer should be submitted under pain of nullity in an electronic form signed with a qualified electronic signature, via the platform available at: http://gus.ezamawiacy.pl.

5. The Awarding Entity, before awarding the contract, will call the Contractor whose highest bid was to submit the nextdeclarations or documents:

1) information from the National Criminal Record in the scope specified in art. 24 paragraph 1 item 13, 14 and 21 of the Act, issued not earlier than 6 months before the deadline for submitting bids or requests to participate in the procedure;

2) a certificate from the competent head of the tax office confirming that the Contractor is not in arrears with tax payments, issued not earlier than 3 months before the deadline for submission of bids or requests to participate in the procedure, or other document confirming that the Contractor has entered into an agreement with the competent tax authority regarding the repayment of these receivables along with any interest or fines, in particular obtained release, postponement or spreading overinstallments of late payments or withholding in full of the decision of the competent authority;

3) a certificate from the appropriate field organizational unit of the Social Insurance Institution or the Agricultural Social Insurance Fund (Kasa Rolniczego Ubezpieczenia Społecznego) or another document confirming that the Contractor is not in arrears with payment of social security or health insurance contributions, issued not earlier than 3 months pbefore the deadline for submitting bids or requests to participate in the procedure, or another document confirming that the Contractor has entered into an agreement with the competent authority regarding the repayment of these receivables together with any interest or fines, in particular, he obtained the exemption, deferment or installment provided for by law late payments or withholding in fullsubmitting the decision of the competent authority;

4) an excerpt from the relevant register or from the Central Register and Information on Economic Activity, if separate provisions require an entry in the register or register, in order to confirm the absence of grounds for exclusion pursuant to art. 24 paragraph 5 point 1 of the Act;

5) the Contractor`s statement of the lack of a decision against him as a precautionary measure forbidding him from applyingę on public procurement;

6) evidence confirming that the supplies indicated in the statement referred to in point 9.1 of the ToR were made or are being duly performed.

6. Documents of foreign and joint entities (paragraphs 9.9 and 9.10 of the ToR).

7. Deposit: PLN 7, 000.00.

8. ZNWU: 10% of the value of the contract with VAT.

9. In the present proceedings, communication between the Employer and the Contractors, in detailin point 10 of the Terms of Reference, will be held in Polish, using:

1) the Purchaser`s purchasing platform, hereinafter referred to as the "Platform", available at: http://gus.ezamawiacy.pl;

2) electronic mail.
