Maintenance services for Oracle hardware

1) Reasons related to the criminal convictions.

The mode of fulfillment and applicability in the procedure: the DUAE form (part III "Reasons for exclusion") will be presented, completed with the data / information referring to the provisions of article 164 of Law No. 98 / 2016.

DUAE will be presented for each participating entity in the award procedure, respectively bidder, associate, Subcontractor or third party supporter

The supporting documents proving the fulfillment of those assumed by completing the DUAE will be presented, at the request of the contracting authority, only by the tenderer ranked first in the intermediate ranking drawn up at the end of the evaluation of the offers. Documents that may be required:

- criminal record for the bidder and for the persons asre are members of the administration, management or supervisory body of the respective tenderer or have the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive document.

For foreign bidders it is accepted any document considered edifying in the country of origin or in the country in which it is established, as ar be declarations on their own responsibility, certificates, court records or other equivalent documents issued by the competent authorities of the respective country, accompanied by an authorized translation into Romanian.

Requirement no. 2.

Reasons related to the payment of taxes and contributions to social insurance.

The method of fulfillment and applicability within the procedure: the DUAE form will be presented (paPart III "Reasons for exclusion") supplemented with the reference data / information in relation to the provisions of Article 165 of Law No. 98 / 2016.

DUAE will be presented for each participating entity in the award procedure, respectively bidder, associate, subcontractor or supporting third party.

The supporting documents proving the fulfillment of those assumed by completing the DUAE will be presented, at the request of the contracting authority, only by the bidder ranked first in the intermediate ranking drawn up at the end of the evaluation of the bids. The documents that could be requested:

- certificates of fiscal attestation regarding the payment of taxes, taxes or contributions to the general consolidated budget, etc., so as to show the lack of outstanding debts at the time of filing the documentr,

- documents proving that the economic operator can benefit from the derogations provided in art. 166 para. (2), art. 167 para. (2), art. 171 of Law no. 98/2016 (if applicable).

For foreign bidders, any document considered edifying in the country of origin or in the country in which it is established, such as statements on their own responsibility, certificates, case, is accepted.judicial documents or other equivalent documents issued by the competent authorities of the respective country, accompanied by an authorized translation into Romanian.

Requirement no. 3.

Reasons related to insolvency, conflicts of interest or professional misconduct.

Method of fulfillment and applicability within the procedure: the DUAE Form (Part III "Reasons for exclusion") will be presented, filled with the data / informationthe reference subjects in relation to the provisions of art. 167 of Law no. 98/2016. The DUAE will be presented for each entity participating in the award procedure, respectively tenderer, associate, subcontractor or third party supporter.

The supporting documents proving the fulfillment of those assumed by completing the DUAE will be presented, at the request of the contracting authority, only by the tendererthe ranked first place in the intermediate ranking drawn up at the end of the evaluation of the offers:

Specify average annual turnover. The average turnover of the tenderer over the last (3) three years (2017, 2018, 2019) must be worth at least RON 100 000. The economic operators participating in the award procedure will complete the DUAE with the information related to their situation. The supporting documents proving the fulfillment of those assumed by completing the DUAE shall be prexempted, at the request of the contracting authority, only by the tenderer ranked first after applying the award criterion. The supporting documents, which prove the fulfillment of those assumed by completing the DUAE are: the balance sheets for the last 3 years (2017, 2018, 2019), registered with the competent bodies, according to the legal provisions in force or other documents that havethe contracting authority considers them adequate (financial audit reports prepared by specialized entities or verification balances assumed by the economic operator, in case the situations related to the financial year ended have not yet been finalized, according to the provisions of the legislation in this field). If, for objective and justified reasons, the economic operator is notable to present one or more of the information and documents provided above, the economic operator is authorized to prove its economic and financial situation by any other document that the contracting authority considers appropriate (financial audit reports prepared by specialized entities or balance sheets of verification assumed by the economic operator, ifthe situations related to the financial year ended have not yet been finalized according to the provisions of the relevant legislation in the field).

If the existence of 2 or more offers, with equal scores, ranked in the first place, for the purpose of ranking, is established, the contracting authority will designate winning bid with the lowest price. If equality is maintained, the winning bid will be the one withthe highest score obtained for the evaluation factor "Qualification and professional experience of the personnel designated for the execution of the contract (key experts proposed) for carrying out activities within the contract". In case of absolute equality, will request through SEAP new offers of price, case in which the contract will be awarded to the bidder whose new financial proposalwhich has the lowest price

Requests for clarifications will be addressed in Romanian, through SEAP, in the "Questions" section of the award procedure carried out by electronic means, and the answers to these will be published in Romanian, in SEAP in the "Documentation, clarifications and decisions" section of the participation announcement. For sending requestsof clarifications economic operators must register in SEAP www.e-licitatie.ro

The evaluation commission will send the clarification requests regarding the offer, in Romanian language, by using the technical facilities available in SEAP ("Questions" section). economic will send the answers to clarifications and any documents requested during the evaluation ofethe networks, through SEAP (the "Questions" section), fully in the section corresponding to the respective request, in electronic form, in the form of one or more distinct documents / files, signed with the electronic signature, according to the provisions of the Law no. 455/2001 regarding the electronic signature .

All documents / records relating to the award procedure, submitted by the bidderYou (offer, qualification documents, clarification requests, answers to clarification requests) will be written in Romanian or will be accompanied by the authorized translation into Romanian.
