Provision of service support. for Cisco network devices, which is described in detail in Part II of the ToR - Description Itemu Orders

Provision of service and technical support for Cisco network devices, as described in Part II of these Terms of Reference - Description of the Subject of the Order.

1. The Employer does not set the condition for participation in proceedings regarding competences or entitlements to conduct a specific professional activity.

2. A Contractor who can not apply for this public contract may applye is subject to exclusion.

3. Exclusion from the proceedings for the award of the contract is subject to the Contractor, to which there is at least one of the exclusion conditions set out in Article. 24 sec. 1 of the Act on Public Procurement Law (consolidated text: Journal of Laws of 2018, item 1986, as amended) / hereinafter: "Pzp Act" / and Article 24 paragraph 5 items 1, 5, 6 and 8 of the Act Pzp.

4. The offer must be attached as of the dayfor submission of offers a declaration in the form of a single European order document in accordance with the Commission Implementing Regulation (EU) 2016/7 of 5.1.2016 establishing a standard form for the Single European Order Document (EU L3 / 16) (hereinafter referred to as "EAT"), constituting preliminary confirmation that the Contractor is not subject to exclusion.

5. Contractor who relies on other resourcesh entities, in order to demonstrate to the entity that there are no grounds for exclusion, also submit EJ for these entities

6. Contractors jointly applying for the award of a contract, in order to prove to them that there are no grounds for exclusion, submit an EIT for each of the Contractors.

7. The ordering party, prior to the order being awarded, will call the Contractor whose offer has been the highest rated, to submit in the confessionno shorter than 10 days, valid as at the date of submitting declarations or documents confirming the circumstances referred to in art. 25 para. 1 of the Public Procurement Law, ie confirming the lack of grounds for exclusion (specified by the Employer in item 3 above), i.e .:

7.1. information from the National Criminal Register, to the extent specified in art. 24 sec. 1 items 13, 14 and 21 of the PPL Act and, refconviction for offenses on custody in the scope specified by the Ordering Party on the basis of art. 24 sec. 5 points 5 and 6 of the Public Procurement Law, issued no earlier than 6 months before the deadline for submission of tenders;

7.2. certificate of the competent head of the tax office confirming that the Contractor is not in default of paying taxes, issued not earlier than 3 months before the expiry of tfor submission of bids, or other document confirming that the Contractor has entered into an agreement with the competent tax authority regarding the repayment of such receivables with possible interest or fines, in particular obtained legally permissible, postponement or payment of overdue installments or suspension in full of the decision of the competent authority;

7.3. certificate of ownershipthe off-site organizational unit of the Social Insurance Institution or the Agricultural Social Insurance Fund or other document confirming that the Contractor is not in arrears with paying social security or health insurance contributions, issued not earlier than 3 months before the deadline for submission of tenders, or other document confirming that the Contractor has agreement withthe competent authority regarding the repayment of such receivables, together with any interest or fines, in particular obtaining the legally required exemption, deferral or payment in installments of overdue payments or suspension in full of the implementation of the decision of the competent authority;

7.4. excerpt from the relevant register or central records and business information, if separate regulations are requiredthey are entering an entry in the register or records in order to confirm the absence of grounds for exclusion under Art. 24 sec. 5 point 1 of the Public Procurement Law.

7.5. the Contractor's statement that he has not been the subject of a final court judgment or final administrative decision on late payment of taxes, fees or social security or health insurance premiums or in the event of such a verdict or decision confirming payment of such receivables, including any interest or fines or forthe value of binding agreement on the repayment of these receivables - drawn up according to the template constituting an attachment to the offer, - 7.6 statement on belonging to or lack of belonging to the same capital group (prepared according to the template attached to the offer);

7.7. the Contractor's statement about the lack of a decision against him as a preventive measure of the prohibition to apply for the publi's ordercomplete - drawn up according to the template attached to the offer;

7.8. performance of the Contractor's non-delivery of a final conviction of a conviction court for violation of liberty or a fine, to the extent specified by the Awarding Entity pursuant to art. 24 sec. 5 points 5 and 6 of the Public Procurement Law - prepared according to the template attached to the offer,

7.9. statements of the Contractor about not being chargedtaxation and local fees, referred to in the Act of 12.1.1991 on local taxes and charges (Journal of Laws of 2018 item 1445) - prepared according to the template constituting an appendix to the offer. Specific rules for the submission of documents, in particular by Contractors acting jointly, of an Economic Operator having its registered office or place of residence outside the territory of the Republic of Poland ("RP") and the Contractor having its registered office in the territory of the Republic of Poland, with regard to a person residing outside the territory of the Republic of Poland and the dates of their issuance were specified in the ToR, whereby: - 8.1 in the case of an Economic Operator having its registered office or place of residence outside the territory of the Republic of Poland has - 7 of the Regulation of the Minister of Development of 26.7.2016 on the types of documents that may be usede ordering the contracting party from the contractor in the procurement procedure (hereinafter: "the ordinance") in the scope of demonstrating the lack of grounds for exclusion,

8.2 in the case of the Contractor having its registered office in the Republic of Poland, in respect of a person residing outside the territory of the Republic of Poland 8 of the abovementioned regulation with regard to demonstrating the lack of grounds for exclusion.

9. The Contracting Entity provides pconducting the procedure referred to in art. 24aa Public Procurement Law

10. The ordering party is the administrator of personal data within the meaning of Regulation of the European Parliament and of the Council (EU) 2016/679 of 27.4.2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repeal of Directive 95/46 / EC (hereinafter: "RODO").

11. Contractorand the bidder in the proceedings is required to submit a declaration required from the contractor to fulfill the information obligations provided for in Article 13 or art. 14 RODO, whose model is an attachment to the ToR.
