Support and development of the TETA System for 4 years

The subject of the orders is the provision of services: handling of tickets, support, maintenance and updating of the TETA personnel and payroll system, within 48 months from the commencement of the provision of the said services.The TETA system is crucial for the handling of business processes in the area of Human Resources and Payroll, including time registration and settlements with PPL employees.

The subject of the order is the provision of maintenance services including: handling of bug reports, support, maintenance, updating and development of the SystemTETA payroll (TETA HR, TETA WEB) within 48 months from the day of signing the Agreement, including:

1. Accepting applications and undertaking service activities via remote links or in an exceptional situation at the Employer's office.

2. Having an internet application to accept and handle requests.

3. Registration of system errors reported by the Ordering Party via the internet applicationin 24/7/365 mode or in exceptional situations, by e-mail or by phone during the Contractor's Website hours (ie on working days from 8.00 to 16.00).

4. Providing information on all new versions, patches, patches and software updates.

5. Update of the manual in the case when the software upgrade affects the system's operation by usersagent.

6. Implementation of Software Change Requests as part of system development. The cost of implementation of the change will be calculated according to the rates listed in the Agreement. The Contracting Authority provides under the Agreement a pool of 800 Osobodni to be used during the Agreement. The Employer will pay only for the days actually used.

7. Conducting additional training if provided for in the scope of changes anddevelopment and submission of operating instructions as part of the changes introduced to the system.

8. Providing new versions of the software taking into account:

• Changes occurring in the generally applicable legal provisions, with the proviso that the above-mentioned changes will become available no later than on the effective date.

• Changes related to the improvement of quality and functionalitygambling or removing errors detected by the Contractor in the operation of the software.

9. Repair of reported errors in the System.

10. Support and maintenance of system modifications created by the Employer to the extent permitted by the license granted by the Software Owner

11. Performing reviews, audits and tuning of the System at the request of the Ordering Party under the pool available in the Agreementdays.

12. Maintenance / versioning of source codes for modifications created on the Ordering Party's order.

13. Keeping, updating and versioning the System documentation.

14. Execution in emergency situations of administrative work in the production environment of the System, which would be ordered and paid by the Employer in the course of the man-days pool

15. Transfer of copyrights to alltheir modifications made by the Contractor at the request of the Employer within the individual-day pool of

16. The method of servicing must meet the requirements of the RODO.

17. Guaranteeing the Ordering Party's ability to perform audits (audit of the other party), in order to confirm compliance with the terms of the contract and the correctness of personal data processing (RODO).

Terms of handling applications

1. The service service will be realizedin accordance with the SLA conditions specified below, during the Contractor's Website work hours.

2. The ordering party must be able to order additional support (after working hours of the Website and on weekends) in the form of on-call remote consultant and / or programmer. The ordered Extra Duty will be billed from the man-days pool

3. Required response times to the notification and deadlines for removing the Error (or Workaround) li• Failure / critical error - the error removal time is max. 8 hours from the moment of notification. Response time to take up to 4 hours from the time of notification.

• Serious error - error removal time is max. 7 days. Response time - up to 4 hours.

• Normal error - Error removal time is max. 14 days. Response time - up to 4 hours.

2. The contracting authority provides for the award of an orderthe previous contractor for services in accordance with Article 134 sec. 6 point 3 of the Public Procurement Law. The scope of these services will include services referred to in - 1 para. 2 points 7), 8), 11), 14) and 15) Essential Provisions of the Agreement.

The Offer and the Form EAT may only be submitted in electronic form signed with a qualified electronic signature through the Platform Portal SmartPzp. Contractors should offer their offerlive until 22.3.2019 hours 10: 00

2. The ordering party (pursuant to Article 26 paragraph 1 of the Act) will call the Contractor, whose offer was the highest rated to submit the following documents within the prescribed period, confirming the lack of grounds for exclusion in the scope of art. 24 sec. 1 of the Act indicated in the Ordinance of the Minister of Development of 26.7.2016 in "on the types of documents (...)": - - par. 5 point 1) -in the scope of 24 sec. 1 items 13, 14, 21 of the Act,

- par. 5 point 4) - within the scope of art. 24 sec. 5 point 1 of the Act,

- par. 5 points 2), 3) and 9) - within the scope of art. 25 para. 5 point 8 of the Act,

- par. 5 point 5) - within the scope of art. 24 sec. 1 point 15 of the Act,

- par. 5 point 6) - within the scope of art. 24 paragraph 1 point 22 of the Act

3. If the Contractor has a registered office or place of residence outside the territory of the Republic of Poland, as well as inWhen the person whose document relates is residing outside the territory of the Republic of Poland, the principles set out in par. 7 and 8 above Regulation.

4. Employer, in order to confirm the fulfillment of the conditions for participation in the proceedings, acting on the basis of art. 1 of the Act will call the Contractor, whose offer was the highest rated for submission within the prescribed period

List of services rendered with evidence confirming proper performance.

5. The Contractor applying for the award of this order must submit the following documents with the offer: - - Form 'Offer' (Annex 1 to the Terms of Reference), - Commitment, where the Contractor relies on the capacities of other entities according to the terms of the ToR) Single European Order Document

-proof of payment of a bid bond,

- power of attorney, which results from the right to sign the offer (in accordance with the ToR)

- power of attorney to represent all Contractors (in accordance with the ToR)

6. According to art. 24 sec. 11 of the Contractor's Act within 3 days from the date of posting on the website information referred to in art. 86 par. 5 of the Act will provide the Employer with a declaration of belonging or absencebelonging to the same capital group as referred to in art. 24 sec. 1 point 23 of the Act. With the submission of a statement, the Contractor may provide evidence that links with another Contractor do not lead to distortion of competition in the procurement procedure. The Contracting Authority informs that for a period of two months, referred to in Section IV point 2.6 of this announcement is to be understood60 days counted from the day of opening the offers. The Contracting Authority provides for the contracting of services to the previous Contractor in accordance with art. 134 sec. 6 point 3 of the Public Procurement Law. The scope of these services will include services referred to in - 1 para. 2 points 7), 8), 11), 14) and 15) Significant Provisions of the Agreement and the value of these services will not exceed 50% of the value of the basic service in this respect.
