Open procedure for entrusting the supply of shortbread biscuits in 250/350 grams packs as food aid to the indigent in Italy

The contract concerns the supply of shortbread biscuits in packs of 250 / 350 grams for the destitute in Italy and distributed through the partner organizations accredited presso l'Agea, divided into 3 geographical lots.

Main Site: Regions of Piedmont, Valle d'Aosta, Liguria, Lombardy, Veneto, Trentino-Alto Adige, Friuli-Venezia Giulia, Emilia-Romagna and Tuscany.

The contract has for object supply of shortbread biscuits in packs of 250/350 grams in food aid to the indigent in the Piedmont Regions, Valle d'Aosta, Liguria, Lombardy, Veneto, Trentino-Alto Adige, -Friuli-Venezia Giulia, Emilia-Romagna and Tuscany, distributed through partner organizations accredited by Agea. All economic operators, including those established in other Member States, referred to in art. 45 of Legislative Decree 50/2016, in compliance with the requirements set by articles 45, 47 and 48 and of the further conditions foreseen in the-law of competition, provided they meet the requirements set out in paragraphs 6 and 7 of the Competition Regulations.

Competitors belonging to European Union countries, other than Italy, will be admitted to participate according to the provisions of art. 49 of Legislative Decree 50 of 2016.

Registration with the Chamber of Commerce, Industry, Crafts and Agriculture (CCIAA) - Register of companies (or professional register)equivalent for foreign companies) for activities related to the subject matter of the procurement (processing and packaging and / or even just marketing of biscuits).

- total turnover over the last 3 years,

- turnover in the sector covered by the contract over the last three years,

- bank statement (alternatively the RCT-RCO insurance coverage policy).

The economic operator who, for justified reasonsi, is not able to present the required references, can prove its economic and financial capacity by any other document, considered suitable by the contracting authority, pursuant to art. 86, paragraph 4, and of Annex XVII, part I, of Legislative Decree 50 / 2016.

Determination of the Director of the Single-person Office no. 8675 of 12.10.2018.

Agea can ask competitorsdocument integration, pursuant to art. 83, paragraph 9, of Legislative Decree no. 50/2016, and reserves the right, at any time and for justified reasons, to suspend or revoke the procedure, not to proceed with the award or not to sign the contract and the competitors will have nothing to claim. Each lot will be awarded in the presence of at least 2valid offers. Offers will not be accepted for only part of the supply requested. The relative contract does not contain the arbitration clause (see Article 209, paragraph 2, first sentence, of Legislative Decree No. 50/2016). Agea reserves the right not to proceed with the award if none of the submitted offers is considered suitable and to proceed with the negotiated procedure in the case of-unsuccessful experiment of this tender procedure, pursuant to art. 63, paragraph 2, letter a), of Legislative Decree no. 50 / 2016.

Point II.2.5): the award criterion is better specified in the tender regulations.

Deposits and guarantees required:

A) to guarantee the seriousness of the offer, for each individual lot the bid of the competitors must be accompanied, by penalty of exclusion, by a partyprovisionally, in the form of a deposit or surety, as defined by art. 93 of Legislative Decree no. 50/2016, equal to 2% of the total amount of the individual lot, namely:

- lot 1: 26 840 EUR,

- lot 2: 34 389 EUR,

- lot 3: 29 680 EUR,

B) at the time the contract is signed, the successful tenderer must have submitted-the definitive deposit in the measure and in the ways foreseen by the art. 103 of Legislative Decree no. 50/2016, which will be released pursuant to and in accordance with the modalities provided for in the same article, as indicated in paragraph 10 of the Competition Regulations.
