Non-compliance with Art. 164, art. 165 and art. 167 of Law no. 98/2016 will be filled in by the economic operators participating in the award procedure with the information relating to their situation.

Note: In the case of submitting a joint tender, the requirement must be fulfilled by all members of the association as well as third party supporters and / or subcontractors, if any.

At the request of the Contracting Authority, the candidatethe bidder placed on the first place in the intermediate rankings completed at the evaluation of the tenders will present the following up-to-date supporting documents proving the fulfillment of the assumed by completing the DUAE: - Tax certificate issued by the fiscal administration body of the territorial administrative units within the range of which the economic operator has its registered office, whichto certify that the tenderer has no overdue debts at the moment of presenting this document to the consolidated general budget, - a tax attestation certificate regarding the local taxes and taxes, proving that the tenderer has no overdue debts at the moment of presenting the document, to the local budget,

- the criminal record of the economic operator and the members of the management body, management or oversight of the respective economic operator, or those having the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive document, - documents proving the fact that the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 din Public Procurement Law 98/2016, - other editorial documents, as appropriate.

Documents must be valid on the date of their submission. 2

Self-declaration on the non-existence of conflict of interest, mentioning the persons holding decision-making positions within the contracting authority, as well as those involved in the development of the documentationibuire and proceeding, completed in accordance with FORMULA 1. The risks of submitting the offer, including force majeure, fall intoarcina of the economic operator. The offer is binding in content terms for the entire period of validity set by the contracting authority and assumed by the bidder. Documents written in a language other than the Roman language will be accompanied by an authorized translation into the Romanian language.

Notes:

1) Concerning clarifications: requests for clarifications on the documentwill be exclusively addressed to SEAP in the "Questions" section of the award procedure conducted by electronic means, and the responses to them will be published in the SEAP, in the "Documentation and Clarification" section of the tender notice, the authority the contracting entity will not respond to the requests addressed by another means of communication. Datelimit for transmitting the answer to the clarifications: according to the provisions of art. 160 and 161 of Law no. 98/2016; 2) Concerning the contestations, the provisions of Law no. 3) The Evaluation Committee will submit the requests for clarifications regarding the submitted offers in the SEAP in the "Questions" section. The economic operators will submit the answers to the clarifications and the possible soil documentsduring the evaluation of the offers through SEAP (Section "Questions"), fully in the section corresponding to the respective request, in the form of one or more separate documents signed with the extended electronic signature; 4) If the first ranked offers have the prices equal, the contracting authority will request re-transmission through the SEAP in the "Intrebars ", for the electronic loading by the economic operators of documents containing new prices, in order to divide the offers.The new financial proposal will be submitted only after the request of the contracting authority 5) For the qualification and selection documents, the economic operators will submit to the SEAP, by the closing date for submission of tenders, the DUAE formcompliance with art. 137 par. (2) lit. b) from H.G. no. 395/2016, the evaluation committee has the obligation to reject the bid as unacceptable if the bidder has not completed the DUAE in accordance with the criteria set by the contracting authority; DUAE can be downloaded to fill in and submit from SEAP (instructions for completing DUAE are available at https: //sicap-prod.e-licitatie.ro)

The contracting authority may require tenderers to submit all or part of the supporting documents as proof of the information contained in the DUAE during the course of the proceedings, form art. 196 par. (1) of the Law no. 98/2016; 6) According to the provisions of art. 123 par. (1) of H.G. 395/2016 the tenderer shall prepare the tender in accordance with the provisions of the awarding documentation and shall state, when justified and, if appropriate, in its contents which the information in the technical proposal and / or the financial proposal is confidential, classified or protected by a-intellectual property right, based on the applicable law. If these conditions are not incidental, the technical and financial proposals will be considered public documents within the meaning of Law 544/2001 on free access to information of public interest.
