The bidders, the third party supporters and the subcontractors must not find themselves in the situations provided in art. 164, 165, 167 of Law no. 98 / 2016.

The manner in which the requirement can be demonstrated: the DUAE will be completed by the economic operators participating in the award procedure with the information related to their situation. The supporting documents that probeating the fulfillment of those assumed by completing the DUAE will be presented, at the request of the contracting authority, only by the tenderer ranked on the first place in the intermediate ranking prepared at the end of the evaluation of the offers. These documents can be:

- Certificates confirming the lack of outstanding debts regarding the payment of taxes, taxes or contributions to the gene budgetconsolidated rally (local budget, state budget, etc.) at the time of presentation,

- the criminal record of the economic operator and of the members of the administration, management or supervision body of the respective economic operator or of those who have the power to represent, to decide or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive act,

- afterin case, documents proving that the economic operator can benefit from the derogations provided in art. 166 para. (2), art. 167 para. (2), art. 171 of Law 98/2016 on public procurement; other edifying documents, as the case may be.

"The procedure for awarding the public procurement contract is initiated under the scope of this suspension clause, in the sense that the conclusion of the contractof the public procurement is conditioned by the allocation of the budget credits with this destination, the signing of the contract being made in compliance with the provisions regarding the commitment of the expenses from the budgets that fall under the legislation on public finances.

In view of the provisions of Law no. 98/2016 on public procurement and H.G. no. 395/2016, with the amendments and completelyIn the subsequent countries, the contracting authority specifies that it will conclude the contract with the tenderer declared the winner only insofar as the funds necessary for the acquisition will be secured by allocating budgetary credits to this destination. In case, for whatever reasons, the budget credits will not be allocated, the contracting authority, after receiving the notification regarding the non-granting of finesto annul, it reserves the right to cancel the award procedure, provided that there is no other source of financing, in accordance with the provisions of art. 212 paragraph (1) lit. c) thesis 2 of Law 98/2016, with the subsequent modifications and completions, being impossible to conclude the public procurement contract.

The bidders under this procedure understand that the contracting authority cannot bei shall be held liable for any damage in the event of the cancellation of the award procedure, regardless of its nature and whether the contracting authority has been notified of the existence of such damage. The bidders in this procedure accept the use of the special conditions above / the suspension clause, assuming their full responsibility in relation to the eventualitiesdamages that they may suffer in the described situation ".
