Project design and technical assistance from the designer regarding the investment: "Modernization of the Square of the Cross Square", Unique Identification Code: 14756536-2018-81, according to• Based on the contract, the documentation for the approval of the works of intervention, the project for the authorization of the execution of the construction works and the technical project with respect to the provisions of H.G. no. 907 / 29.12.2016. The designer will also provide technical assistance during the modernization works in the Square of the Cross. The proposed project will provide landscaping works absolutely necessary, taking into account the obligation to restore the natural environment. The required works to design are: vegetation; alleys and urban furniture; monument; irrigation system; lighting system; surveillance and monitoring system.

Timisoara will exclude at any time the award procedure of the cothe service provider any economic operator who is in one of the situations provided by art. 60, 164, 165 and 167 of Law 98/2016 on Public Procurement. Exclusion reasons will also be applied to associates / subcontractors / third-party supporters, as appropriate.

Means of performance: Subject to the rejection of the offer as unacceptable, each participating economic operator(tenderer, associated bidder, subcontractor, third party, as the case may be), will present with the offer and the DUAE completed according to the provisions of art. 193 of Law 98/2016, with the information related to their situation.

Will be presented:

(a) Statement of non-compliance in situations potentially generating conflict of interests, as defined in art. 60-of Law no. 98/2016 - by all participants in the procedure,

(b) and, where appropriate, firm commitment of the third party, accompanied by documents showing the effective manner in which its support will materialize, the subcontracting agreement and / or Association. The supporting documents demonstrating the fulfillment of the undertaken by completing the DUAE are to be presented, only at-requesting the contracting authority, the tenderer ranked first after the application of the award criterion for the admissible tenders.

The supporting documents may be:

1) certificates of absence of debts regarding the payment of taxes, duties or contributions to the general consolidated budget local, state budget, etc.) at the time of the presentation,

2) the criminal recordof the economic operator and of the members of the management, management or supervisory body of the respective economic operator or of those who have the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act ; 3) where appropriate, documents demonstrating that the economic operator can benefitby the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Public Procurement Law 98/2016

1) Within the documents attached to the participation announcement published in SEAP, DUAE is made available to economic operators interested in editable format, in order to complete it by the bidders. Participating economic operators will fill in this document with the information / responses related to the inclusion / non-inclusion in the grounds for exclusion, respectively the fulfillment of the criteriaallegations requested by the contracting authority, which correspond to the instructions of the bidders (where they are explicitly stated) and will not have the right to intervene on the DUAE format, respectively on the requirements imposed by the contracting authority, 2) For viewing the attached documents, the economic operators must have a program to view the files-(3) The economic operators have the right to submit the offer (the DUAE completed, the declaration regarding the non-compliance with the provisions of Article 60 of the Law 98/2016, the Technical Proposal, the Financial Proposal, the document proving the participation guarantee and, if is the case, Third Party Support Commitment, Association Agreements and / or Subcontracting)only in electronic format, signed with extended electronic signature; 4) Requests for clarification regarding this tender documentation will be addressed exclusively in SEAP, within the award procedure conducted by electronic means, the contracting authority will not comply with the requests addressed by means of communication other than that established. Any operator-economic interest has the right to request clarifications or additional information regarding the awarding documentation, in compliance with the deadline stipulated by the contracting authority in section II.1.4) of the tender notice, not later than 15 days before the deadline set for submission of bids. Clarifications submitted after this deadline will no longer beconsider it. According to art. 160 161 of Law 98/2016, the contracting authority will respond in a clear and complete way to all clarification requests / additional information 10 days before the deadline set for the submission of tenders, to the extent that they will be addressed within the time limit specified in the announcement participation. The answers to the required clarifications will be published• If the contracting authority requests the submission of certain clarifications / completions in order to check the conformity of the offer with the required requirements, both the request and the bidder's response shall be submitted in SEAP, only in electronic format, signed with extended electronic signature. If the bidder's response isposted in SEAP without the extended electronic signature, its offer will be assimilated to the provisions of art. 137 par. (2) lit. j) from H.G. 395/2016, being rejected as unacceptable; 6) If, following the application of the "lowest price" award criterion, two or more first-ranked offers contain equal prices, the SEAP will be required to be re-paid. This is notachievable for reasons attributable to the SEAP operator, a new off-line financial proposal will be requested from bidders.
