- Lot 1 - "Rehabilitation the main irrigation infrastructure in Calmatui Gropeni Chiscani, Brail Countya ",

- Lot 2 -" Rehabilitation of the main infrastructure in the Latina Vadeni irrigation installation, Braila county ",

- Lot 3 -" Rehabilitation of the main infrastructure in the irrigation plant B.H. Calmatui, Braila County. "Note: In order to comply with the provisions of Article I, point 20 21 of OUU 107/2017, the contracting authority will respond to the clarification requests before the datethe deadline for submitting bids by 10 days. Tenderers will be able to request clarification of the awarding documentation within 13 days before the deadline for submission of tenders.

The amount of the participation guarantee for Lot 1 = 4.050 RON, Lot 2 = 1.403 RON, Lot 3 = 5.126 RON. The tenderer has the obligation to constitute the guarantee of participation according to art. 36 paragraph (1) of GD 395/2016. Fora deposit guarantee lodged in the equivalent leu / foreign currency will be made at the NBR exchange rate from the date before the deadline for submitting bids by 5 days. The term of validity of the participation guarantee will be equal to the period of validity of the tender, ie 90 days (from the deadline for receipt of tenders). Proof of the guarantee of participation must be presentered into SEAP no later than the date and time set for the submission of tenders. The participation guarantee is constituted by a bank transfer or by a guarantee instrument issued under the law by a bank or insurance company on the account of RO67TREZ7045005XXX010641 - Treasury of sector 4, CIF 29275212. The return of the participation guarantee will be made in accordancewith art. 38 of HG 395/2016. The guarantee of participation will be retained in accordance with the provisions of art. 37 of HG 395/2016. The amount of the good execution guarantee instrument is 5% of the value of the contract, excluding VAT, valid for the entire period of validity of the contract. If during the execution of the public procurement contract the value is added-the contractor has the obligation to complete the performance guarantee in correlation with the new value of the public acquisition contact, according to art. 39, paragraph (5) of GD 395/2016. The guarantee of good execution is made within 5 working days from the date of signing the public procurement contract.

The guarantee of good execution is constituted according to the provisions of art. 40 of H.G. no. 395/2016.

The contracting authority has the right to issue claims on the performance guarantee, at any time during the performance of the public procurement contract, to the extent of the damage caused, if the contractor fails to fulfill his obligations under the contract. Before issuing a claim on the performance guarantee, the contracting authority shall obligenotification of the claim both to the contractor and to the issuer of the guarantee instrument, specifying the obligations which have not been respected, and the manner of calculating the damage. In the case of execution of the performance guarantee, in whole or in part, the contractor has the obligation to re-enter the guarantee in relation to the remainder to be executed, according to art. 41 from H.G. no. 395/2016.

The Authority will withhold / refund the performance guarantee under the conditions of Art. 41 and art. 42 para. (3) lit. a) and b) of H.G. no. 395 / 2016.

The state budget.

The sole bidder / the associated offeror / the subcontractor / the supporting party must prove that they do not comply with the provisions of art.164, 165, 167 of the Law no. 98 / 2016.

The manner by which the fulfillment of the requirement can be demonstrated:

Complystage DUAE by the economic operators participating in the award procedure with information related to their situation, including associate, subcontractors / third party supporters. The supporting documents proving the fulfillment of the assumed by the completion of the DUAE shall be submitted, at the request of the contracting authority, only by the bidder placed on the first place in the interim ranking intoI am going to complete the bid evaluation. The information in the documents must be actual / current on the date of submission. These documents may be: - - tax certification certificates regarding the lack of overdue debts related to the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget, etc.) at the moment of presentation, - the criminal record of the ec operatoronomic and of the members of the administrative, management or supervisory body of the respective economic operator, or those who have power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / - where appropriate, documents demonstrating that the economic operator may benefit from the derogations providedto art. 166 par. (2), art. 167 par. (2), art. 171 of Public Procurement Law 98/2016, - other editorial documents, as the case may be.

- The bidders, the supporting third parties and the subcontractors must not find themselves in the situations stipulated in art. 60 of Law no.98 / 2016.

- attestation regarding the elaboration of the documentation for substantiating the request for the water management opinion and of the water management permits according to art. 1 of the Regulation of the Ministry's Order 584/2017Water and Forests.

- registration certificate, according to art. 1 of the Order 1026/2009 of the Ministry of Environment regarding the approval of the conditions for the elaboration of studies for environmental protection. (minimum RIM level),

- ANRE type C1A certificate for design of electrical installations 0, 4-20 Kv according to art. 1 par. (1) of ANRE Order no. 45 / 2016.

The DUAE will be completed.
