The contracting authority will respond clearly and fully to all clarification requests / additional information in 16th day before the deadline set for submitting bids in accordance with GEO 107 / 2017.

1) The bidders, the supporting third parties and the subcontractors must not find themselves in the situations provided by art. 164, 165, 167 of Law no. 98 / 2016.

The manner by which the fulfillment of the requirement can be demonstrated: the DUAE will be filled in by the economic operators participating in the award procedure (including any third partiesand the subcontractors with the information related to their situation

The supporting documents proving the fulfillment of the assumed by completing the DUAE are to be presented, at the request of the contracting authority, only by the tenderer placed on the first place in the intermediate rankings drawn up at the completion of the tender evaluation. will be:

1) certificates of non-existence(2) the criminal record of the economic operator and of the members of the administrative, management or administrative body of the company; oversight of the respective economic operator or those having the power to represent, decide or controleol as it results from the certifying certificate issued by the ONRC / constitutive act, 3) as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of the Public Procurement Law 98/2016; 4) other editorial documents, as the case may be.

Non-resident economic operators (foreigni) have the right to present any editorial documents issued by the authorities of the country in which they are residents proving the fulfillment of the outstanding obligations to pay the taxes to the state budget and the local budget in accordance with the legislation of the country of residence. Documents will be accompanied by their authorized translation into Romanian;

2) Bidderthird parties, the subcontractors should not find themselves in the situations stipulated in art. 60, of Law no. 98 / 2016.

The manner by which the fulfillment of the requirement can be demonstrated: the DUAE will be filled in by the economic operators participating in the award procedure with the information related to their situation.

The supporting documents proving the fulfillment of the assumed obligationsthe DUAE declaration, respectively the statement on the non-breach of the situations stipulated in art. 60 of Law 98/2016 will be presented by all participants together with the submission of the DUAE.

The failure of DUAE once-with the offer (including the partner / third party supporter) entails its rejection as unacceptable.

Failure to submit with the offer of the firm's firm commitment of the third party sustaining the actual manner in which the support of the subcontracting agreement and / or association agreement is the basis for requesting clarification of possible inadequaciesin the form of the information contained in the DUAE sections of both the tenderer / candidate and the subcontractor / third party, this being necessary to ensure the proper conduct of the award procedure.

The documentation will be downloaded from the website www.e-licitatie.ro. All answers to requests for clarifications requested by economic operators or formulated by the contracting authority / CNSC decisions / complaints / notices / remedial measures will be posted on the website www.e-licitatie.ro to ru"Documentation / clarifications / decisions", as well as by publishing eras.

DUAE, will be required to be filled in at https://ec.europa.eu/growth/tools-databases/espd/filter ( instructions for completing DUAE are available at www.e-licitatie.ro), and filing and completing it at the same time with the offer is mandatory, under the sanction rejectionand the latter as unacceptable according to art. 137 par. (2) lit. b) from H.G. no. 395 / 2016.

If it is found that the admissible tenders ranked in the first place have equal prices, the contracting authority will request clarification through the SEE for the electronic loading by the economic operators of documents containing new prices. Bidder assumes liability egclusive for the legality and authenticity of all documents presented in the original and / or copy for participation in the procedure. The review of the documents submitted by the bidders by the valuation committee does not impose any liability or liability on its acceptance as authentic or legal and does not remove the exclusive liability of the bidder under this aspectct.
