The subject of the order is the delivery and service of brand-new special-purpose vehicles for cleaning and disinfecting waste containers for Miejskie Przedsiębiorstwo Oczyszczania w m.st. Warszawie Sp. z o.o. and training in the scope provided by the Employer, divided into 4 tasks, in accordance with the requirements specified by the Employer in the SIWZ.

Main Site: Place indicated by the Employer located in the capital city of Warsaw.

The subject of the order is the delivery and service of 2 brand new specialist vehicles for cleaning and disinfecting containers nand waste along with training in the scope provided by the Employer, with the technical parameters specified in the Terms of Reference and in accordance with the requirements of the Employer specified in the ToR, among others:

1. Vehicles must be brand new, produced no earlier than in 2018.

2. The vehicle (each separately) can not show energy consumption above 1800 MJ per 100 km for a vehicle with a washing and disinfection devicewaste containers, according to the Ordinance of the Prime Minister of 10.5.2011 on other than the price of mandatory criteria for the evaluation of offers for certain types of public procurement (Journal of Laws of 2011 No. 96, item 559). 3. 36 months warranty (for a complete vehicle separately) with no kilometer and motohour limit counted from the date of signing a faultless receipt protocolword - qualitative.

4. The vehicle (each separately) must meet the technical requirements set out in the Regulation of the Minister of Infrastructure of 31.12.2002 regarding technical conditions of vehicles and the scope of their necessary equipment (uniform text Journal of Laws of 2016 item 2022).

5 . Vehicles (chassis and chassis) must comply with applicable regulations, in particular in the areas of OHS, fire protection, and ergonomii and must have lighting in accordance with applicable regulations.

6. The Ordering Party reserves the right to place on the vehicles being the subject of the order (on each separately) the Employer's logos and signs associated with the introduction of municipal waste collection (self-adhesive foil), to which the Contractor agrees and declares that it will not result in loss or limitation of the rights of the guarantororders subject to the subject matter.

7. The Employer reserves the possibility of retrofitting the vehicles (each separately) with the vehicle monitoring system and / or the vehicle data logging system and / or RFID system. The Contractor declares that:

a) vehicles being the subject of the order (each separately) will be adapted to retrofit in each of the following systems:

- vehicle monitoring system,

- registration systemdue to the parameters of the vehicle's operation,

- RFID system.

The ordering party excludes additional costs related to the adaptation of vehicles to the retrofitting of the above-mentioned vehicles. systems;

b) agrees to retrofitting without loss or limitation of the warranty rights on the subject of the order.

Further part of the justification from Section IV.1.1.)

In the event that MPO eventually did not receive the order, i.e. they would not have signedthe agreements between MPO and the Capital City of Warsaw, which could not be unequivocally and confidently excluded, obtaining vehicles in accordance with the requirements of the Capital City of Warsaw would be a pointless activity and would expose MPO to incur unnecessary very significant costs.

The lack of rolling stock replenishment would have a negative impact on the implementation of the principal activity of the Employer with regard to the collection of waste from the Capital City of Warsaw.Warsaw, which must be carried out in an unbroken and unbroken way. The Employer can not allow a situation in which he will not have efficient vehicles, in the number and specification guaranteeing the provision of the service in a manner consistent with applicable regulations. The subject of the order are special cars not available on the market in direct sales, but only on individual ordersup. Due to the time limits associated with the conduct of the public procurement procedure, the designation of a 35-day deadline for submitting offers would make it impossible to objectively order the contract and its implementation within the time allowed to secure the fastest possible disposition of vehicles. The inability to early initiate proceedings results from the emergence of urgent necessity, spowdue to circumstances not attributable to the Ordering Party. The initiation of the proceedings had to be preceded by obtaining corporate consents, which the Purchaser obtained only on 16.4.2019, which due to the other deadlines referred to above, makes it impossible to set a 35-day deadline for submitting bids in an objective manner. Ordering party, after analyzing cof the factual and legal circumstances accompanying the contract in question, he came to the conclusion that the above-mentioned proceedings and conclusion of a public procurement contract with a 35-day deadline for submission of offers is not objectively possible. Simultaneously, taking into account the nature of the subject of the order, preparation of offers by the Contractors is not time-consuming.Municipal vehicles market is focused only on professional entities dealing with this matter, therefore, objectively speaking, each of these entities is able to prepare and submit an offer for the implementation of the task in conditions when the deadline for submission of tenders will be shortened to 15 days. The facts described above, in the Employer's opinion, exhaust the premises specified in art. 43paragraph. 2b point 2) of the Act, which allows the deadline for submitting bids to be shortened.

Note: due to the limited number of characters in Section II.2.14), the Ordering Party hereby informs about the possible forms of deposit:

1. The bid bond can be contributed in the following forms:

1.1. in money,

1.2. in bank guarantees or social-savings bank sureties, except that the surety is guaranteedis always a financial guarantee,

1.3. in bank guarantees,

1.4. in insurance guarantees,

1.5. in sureties granted by entities referred to in art. 6b par. 5 point 2 of the Act of 9.11.2000 on the establishment of the Polish Agency for Enterprise Development (Journal of Laws of 2018, item 110, as amended).

1. Whenever the term "Act" or the Public Procurement Law is used in this notice, without bThe lower definition of the act concerned is related to the Act of 29.1.2004. Public Procurement Law (consolidated text Journal of Laws of 2018, item 1986 as amended).

2. According to art. 24aa paragraph 1 of the Act, the Awarding Entity will first evaluate the offers and then examine whether the contractor whose tender has been rated as the most advantageous is not subject to exclusion. If the Contractor referred to above evadesfrom the conclusion of the contract, the Ordering Party may examine whether the Contractor who submitted the highest rated tender of the remaining offers is not excluded.

3. Declarations and documents required by the Employer to submit by each Contractor with the offer:

3.1.document containing data valid as of the day of submitting bids confirming that the offer was signed by a person authorized to representthe Contractor, if the offer has been signed by a person other than the one registered in the Contractor's registration document (eg power of attorney, civil partnership contract).

3.2. The Single European Order Document (EAT) with content in line with Annex 2 to the Commission Implementing Regulation (EU) 2016/7 of 5.1.2016 establishing a standard form, completed in accordance with the indicationsreferred to in point 9 SIWZ.

4. In addition, the offer should consist of:

4.1. a completed Electronic Form available and generated via the Platform;

4.2. completed form "A" according to the formula specified in Part III of the ToR,

4.3 of the original security in accordance with the provisions of point 11.4 of the ToR,

4.4 if the offer includes business secrets of evidence, referred to in item 12.8.3. SIWZ;

4.5. statements and documents listed in point 7.1. Terms of Reference.

5. Documents related to belonging to the same capital group.

Within 3 days from the date of submission (posting on the Platform) information from the opening of bids, the Contractor is obliged to provide the Employer (without request) a declaration of affiliation or lack of belonging to the same capital group, mowand in art. 24 sec. 1 point 23 of the Act - according to the formula specified in Annex No. 1 to the ToR. With the presentation of the statement, the Contractor may provide evidence that links with another Contractor do not lead to distortion of competition in the public procurement procedure. A list of statements or documents requested by the Employer to deliver to the Contractor in order to confirm the fulfillmentia of conditions of participation in the procedure, fulfillment of the requirements specified by the Ordering Party and the lack of grounds for exclusion from the proceedings:

6.1. List of statements or documents confirming compliance with the conditions of participation in the proceedings.

6.2.1. a statement confirming the requirements regarding the subject of the order according to the formula specified in Annex No. 2 to the ToR.

6.3. List of statements or documents confirming no grounds for exclusion from the proceedings:

6.3.1 information from the National Criminal Record in the scope specified in art. 24 sec. 1 points 13, 14 and 21 of the Act, issued not earlier than 6 months before the expiry of the term compositionania of offers;

6.3.2. documents and declarations specified in - 5 pts. 2 6 and 9 and respectively in - 7 para. 1 3 and - 8 section 1 of the Regulation of the Minister of Development of 26.7.2016 on the types of documents that the Employer may request from the contractor in the proceedings for the award of the contract (Journal of Laws of 2016, item 1126 with amendments) .

7. The Employer will exclude Contractors from the proceedings in relation to whichthe exclusion conditions indicated in art. 24 sec. 1 and par. 5 points 1 and 8 of the PPL Act, subject to art. 24 sec. 8 and 9 Public Procurement Law.
