The subject matter of the contract is the provision of specialized services related to Microsoft software to the extent:

See. Point II.1.4).

Justification of non-division of the subject of the contract into parts according to - 28 of Act no. 343 /2015 Coll. on Public Procurement and on the Amendment of Certain Conclusions as amended (hereinafter referred to as the "Conclusions"):

The subject matter of the contract consists of 2 inseparable parts, namely: a. ") in the context of the contracting authority, (b) the provision of paid services by software specialists within theSupport of Microsoft environment in the IS of the contracting authority. the consequence is a significant disruption of the contracting authority`s key internal processes as well as a threatthe fulfillment of an obligation which the contracting authority must ensure in the public interest and which arises from the applicable legislation. MS software technologies cover the areas of server virtualization, Active Directory, DNS services, PKI services, presentation services, e-mail, database services, payroll management and deployment services, backup services andintegration platform services, secure controlled access services of external clients to SP applications, and publishing services to Internet applications and secure controlled access services of internal clients from the Internet. Division of the subject of the contract is not possible, as the implementation of every 1 of the above mentioned area requires access and knowledge of the whole complex Microsoft environment incenter of the contracting authority. Managing the Microsoft environment can not be divided also because the search for resolution of each incident would require the involvement and coordination of all stakeholders, ie possible different suppliers, which is in practice unrealizable, especially in critical incidents that require immediate resolution . Since these areas are closely interconnected, in practiceit would not be possible to determine which of the parties is responsible for the incident. Separating part of the expanded support from the regular support services listed above would increase the level of risk in implementing changes to the configuration and architecture of the MS technology deployed resulting from the implementation of new projects or from the use of new, respectively. still unused trainsMicrosoft`s technological environment in the IS of the contracting authority. different types of providers, eventually the necessity of division into parts would arise from geographicFrom the survey of the market for the purpose of determining the estimated value of the contract, it follows that there are several entities on the market who can provide the complete subject of the contract and who have sufficient capacities to successfully realize the subject of the contract and achieve its objective, on the basis of which it can be stated that sufficient economies are ensured

Applicant must meet the conditions for participation concerning personal status stated in - 32 para. 1 zakona. Documents and documents through which the applicant proves the fulfillment of the conditions for participation in relation to personal status pursuant to - 32 of the Act:

1.1. 1 of the Act, in accordance with - 32 par. 2 law or afterAccording to - 152 of the Act.

1.2 In the case of a tenderer consisting of a group of contractors involved in public procurement, it is required to prove the fulfillment of the conditions for participation in personal status for each member of the group separately. Fulfillment of participation requirement according to - 32 par. 1 pism. (e) the law proves the group member only in respect of that part of the contract subject to the contract.the registered office, place of business or habitual residence outside the territory of the Slovak Republic and the statute of its registered office, place of business or habitual residence does not issue any of the documents referred to in - 32 para. (2) If the law of the candidate with seat is established, or does not issue equivalent documents, they may be replaced by an affidavit in accordance with the rules in force in the State of his residence, place of business or usual residence.the place of business or usual residence outside the territory of the Slovak Republic is not governed by the institute of honor, it may be replaced by a declaration made before a court, administrative body, notary, other professional institution or commercial institution according to the regulations applicable in the country of residence, place of business or usual residence of the applicant. the contracting entity shall recognize an equivalent record to the record don the list of economic entities pursuant to Section 152 of the Act or a certificate of registration issued to the competent authorities of another Member State, by which the tenderer or candidate demonstrates fulfillment of the conditions for participation in public procurement. The contracting authority shall also accept any other equivalent document submitted by the tenderer or candidate. The entry in the list of entrepreneurs made under Act no. 25/2006 Coll. on public procurementnor on the amendment of certain conclusions as amended by 17 April 2016 is an entry in the list of economic entities to the extent of the recorded facts. Of the Slovak Republic, the applicant submits documents according to - 32 par. 1 pism. (a) the law shall be amended as follows:according to - 32 par. 2 pism. a) of the Act, in accordance with - 1 par. 6 Act No. 177/2018 Coll. on certain measures to reduce administrative burdens through the use of public administration information systems and on amendments to certain outcomes (ending against bureaucracy). If the tenderer has a valid entry in the list of economic operators kept by the Public Procurement Office, fulfillment of the condition of participation according to - 32 par. 1 pism. 1.7 In the case of proving the fulfillment of the condition of participation in relation to personal status pursuant to - 32 para. 1 pism. e) by an excerpt from the Commercial Register of the Slovak Republic or an excerpt from the Trade Register of the Slovak Republic, the applicant is not obliged under - 32 par. 3 prohibits the submission of such documents to the publicthe contracting authority, because of the use of data from public administration information systems. This rule applies to economic operators (tenderers) listed exhaustively in - 2 para. 2 Act No. 272/2015 Coll. on the Register of Legal Persons, Entrepreneurs and Public Organs and on the amendment of certain conclusions. In all other cases, the tenderer shall continue to be required to produce a document proving that he has metie the conditions for participation in personal status pursuant to - 32 para. 1 pism. e) the law according to - 32 par. 2 pism. (e) the law. If the tenderer has a valid entry in the list of economic entities maintained by the Public Procurement Office, a document proving fulfillment of the condition of participation according to - 32 para. 1 pism. (e) the law is not requiredArticle 33 of the Act: by expressing a bank or a branch of a foreign bank or a foreign bank. Further information on the economic and financial position of the tenderer is given in Part A.2 of the Conditions of Participation of Applicants for Suitability Documentation, which is published in the profile of the contracting authority on the portal www.uvo.gov.sk and on the portal IS EVO. Within the scope of this tender, the provisions of - 66 para.In accordance with the second sentence of Article 7 (7) of the Act, the contracting authority shall carry out an evaluation of the fulfillment of the conditions of participation and an evaluation of the tenders with regard to the fulfillment of the requirements for the subject of the contract. This public procurement is carried out through IS EVO. IS EVO will be used for each termination in the procurement process, ie. the whole process of publicthe maintenance takes place only electronically via IS EVO.

4. The contracting authority requires candidates to register in IS EVO. This registration is associated with certain process terminations, so it must be done well in advance. Registration in IS EVO may be carried out by interested parties no later than the expiry of the deadline for submission of tenders pursuant to this notice. Offers, navrand other documents and documents in public procurement according to - 21 par. 6 of the Act shall be submitted in the statutory language, which is the Slovak language. If the document or document is drawn up in a foreign language, it shall be submitted together with its official translation into the statutory language; this does not apply to offers, proposals, documents and documents made in the Czech language. If there is a difference in their content, the decisive factor is decisivelad into the state language, which is Slovak language

6. Where necessary, clarification of the information needed to draw up the tender and to demonstrate compliance with the conditions for participation set out in this notice, in the tender documents or in other documents provided by the contracting authority may ask any interested party electronically via IS EVO to explain it.proceed in accordance with - 48 of the Act. Detailed information on the explanation can be found in the documentation. A security offer of 40, 000 EUR is required under the law. Detailed information on the composition of the security shall be given in the tender documents. All the costs and expenses connected with the preparation and submission of the tender shall be borne by the tenderer without financial claim to the contracting authority, in view of the outcome of the procurement. The tenderer may provisionally replace the documents proving the fulfillment of the conditions of participation determined by the contracting authority by a single European document within the meaning of - 39 of the Act. To complete and re-use the single European document, it is possible to use the free service available on the website of the Public Procurement Office https://www.uvo.gov.sk/jednotny-european-document-for-public-procurement-602.html and on the website of the European Commission https://ec.europa.eu/tools/espdlang=en.

10. The contracting authority declares that it limits the information required to the conditions of participation (concerning Part IV: Conditions for participation Sections A to D of the Single European Document) to one question with a yes or no answer (alpha: Global for all conditions of participation), i whether economic operators meet all the required conditions for participation without the need to complete other sections of Part IV: Conditions for participation in the Single European Document. The contracting authority may not enter into a contract with a tenderer or tenderers who have an obligation to register in the public sector partner register and are not entered in the public sector partner register or whofast subcontractors or subcontractors under Act No. 315/2016 Coll. on the Register of Public Sector Partners and on amendments to certain conclusions, as amended, which have an obligation to register in the Register of Public Sector Partners and not to be entered in it.
