Acord-service framework for "Enterprise Licensing Agreement renewal." The service quantities were estimated based on the number of licenses corresponding to the EA licensing program and are presented in the specification as follows:

The framework agreement will be signed in fullestimated maximum area. 1: Bidders, associates, third parties and subcontractors should not find themselves in the situations referred to in art. 177, 178, 180 of Law no. 99/2016 on sector acquisitions. Mode of accomplishment: The economic operators participating in the award procedure will be represented by the economic operators under Art. 202 par. (1) of the Law no. 99/2016, ofertanti / associates / third-party supporters / subcontractors, each completing a separate DUAE for their situation. The supporting documents shall be submitted, at the request of the contracting entity, only by the tenderer ranked first, after applying the award criterion, according to art. 205 par. (2) of the Law no. 99/2016. The supporting documents can be:

1) Certificates prdue to lack of overdue debts, taxes or contributions to the general consolidated budget (local budget, state budget, etc.). They will only be shown for registered offices for which there are payment obligations. These documents must show that the tenderer has no overdue debts at the time of their presentation; 2) The judicial record of the economic operator and eacha member of the administrative, management or supervisory body of that economic operator or of those having the power of representation, decision or control within it, as evidenced by the certifying certificate issued by the ONRC / Act of Incorporation, valid at the moment their presentation; 3) as the case may be, documents demonstrating that the economic operator canit benefits from the derogations provided in art. 179 par. (2), art. 180 par. (2), art. 184 of Law no. 99/2016 on sector acquisitions. The foreign natural / legal persons wishing to participate in the procedure will present any editorial documents issued by the competent authorities of the country in which they are resident to prove the fulfillment of the requirement. 2: Ofcontractors, associates, third parties and subcontractors should not find themselves in the situations provided for in art. 72, 73 of the Law no. 99/2016. In the sense of the provisions of art. 76 par. (1) of the Law no. 99/2016, the decision-makers within the contracting entity involved in the awarding procedure are:

Way of accomplishment:economic participants participating in the award procedure, according to art. 202 par. (1) of the Law no. 99/2016, bidders / associates / third-party supporters / subcontractors, each filling a separate DUAE for their situation, as well as a declaration on non-compliance with the situations provided by art. 72, 73 of the Law no. 99/2016 (Form F7), which will be filed with the DUAE. 3: Eco operatorsnominees have to prove a registration form under the law of the country of residence, from which it appears that the economic operator is legally constituted, that he is not in any of the situations of cancellation of the establishment, and that he has the professional capacity to achieve the activities covered by the framework agreement. Mode of accomplishment: The OUA will be presented by Opeeconomic operators participating in the award procedure (bidders / associates / thirds / subcontractors), according to art. 202 par. (1) of the Law no. 99/2016, completing the sections related to the requirements above. Any request for clarification to the awarding documentation will be submitted online in SICAP. The answers to any requests for clarification to the tender documentation will be attached to the part announcement• The contracting entity has the right to exclude from the award procedure any bidder who has failed or failed to fulfill its contractual obligations with ENEL, for reasons attributable to the bidder, which has produced or is likely to cause serious harm to its beneficiaries (Law no. 99/2016 art. 180 lit. g)].
