The subject of the order includes the delivery of antivirus software license for a period of 24 months from the date of license delivery for 8, 700 Users (including a maximum of 3, 215 servers).

According to the scope indicated in theII.1.4) Short description.

1. The Employer does not set the condition for participation in proceedings regarding competences or entitlements to conduct a specific professional activity.

2. The Contractor who is not subject to exclusion may apply for granting this public order.

3. Exclusion from the proceedings for the award of the contract is subject to the Contractor, which is affected by at least one of the prexclusion exemptions specified in art. 24 sec. 1 of the PZP Act and art. 24 sec. 5 points 1, 5, 6 and 8 of the Act on Public Procurement Law (consolidated text: Journal of Laws of 2018, item 1986, as amended) / hereinafter: "Ustawa Pzp" /.

4. valid as of the day of submitting bids a declaration in the form of a single European order document according to the Commission Implementing Regulation (EU) 2016/7 fromon 5.1.2016 laying the standard form of the Single European Order Document (Official Journal UEL3 / 16) / hereinafter: "EAT"), constituting preliminary confirmation that the Contractor is not subject to exclusion.

5. Contractor who refers to resources other entities, in order to demonstrate to the entity that there are no grounds for exclusion, also submit EJ for these entities.

6. Contractors jointlyrequesting the order, in order to demonstrate to them that there are no grounds for exclusion, submit an EIT for each of the Contractors.

7. Contractor, within 3 days from the date of placing by the Contracting Party information referred to in Article 86 para. 5 of the Public Procurement Law, submits to the Ordering Party a declaration of belonging or non-affiliation to the same capital group referred to in art. 24 sec.1 item 23 of Public Procurement Law - 8. The contracting party, prior to the order being awarded, will call the Contractor whose offer has been rated the most, to submit in a designated period, not shorter than 10 days, valid as of the date of submitting statements or documents confirming the circumstances referred to in art. 25 para. 1 of the Public Procurement Law, ie confirming the lack of grounds for exclusion (specified by the Employerin item 3 above), i.e .:

8.1. information from the National Criminal Register, to the extent specified in art. 24 sec. 1 items 13, 14 and 21 of the Public Procurement Law and, regarding convictions for a prison sentence, to the extent specified by the Awarding Entity pursuant to art. 24 sec. 5 points 5 and 6 of the Public Procurement Law, issued not earlier than 6 months before the deadline for submission of tenders;

8.2. certificate of the competent chieftax office confirming that the Contractor is not in arrears with paying taxes, issued not earlier than 3 months before the deadline for submission of bids, or other document confirming that the Contractor has concluded an agreement with the competent tax authority regarding repayment of such receivables with possible interest or fines, in particular, he obtained the law provided for by lawno, postponing or spreading overdue payments into installments or suspending the execution of a competent authority decision in its entirety;

8.3. a certificate of the relevant local organizational unit of the Social Insurance Institution or the Agricultural Social Insurance Fund or other document confirming that the Contractor is not in arrears with paying social security or health insurance premiums, issuedego no earlier than 3 months before the deadline for submission of bids, or other document confirming that the Contractor has concluded an agreement with the competent authority regarding repayment of these receivables with possible interest or fines, in particular obtained the legally required exemption, postponement or distribution of overdue payments into installments or suspension in full of the implementation of the decision responsibleigan body;

Due to the lack of space in this section, further content will be included in section VI Supplementary information, VI.3 Additional information - The Contracting Entity does not require participation in proceedings regarding the economic and financial situation.

Continued Section III.1.1 ) Ability to conduct a professional activity, including requirements related to an entry in the professional or trade register:

8.4. an excerpt from the relevant register or central records and information on economic activity, if separate regulations require an entry in the register or records, in order to confirm the absence of grounds for exclusion under Article. 24 sec. 5 point 1 of the Public Procurement Law - 8.5. the Contractor's statement that he has not been the subject of a final court judgment or final administrative decision about remaining in silencetaxes, fees or social security or health insurance premiums, or in the event of issuing such a verdict or decision documents confirming the payment of such receivables together with any interest or fines or conclusion of a binding agreement regarding the repayment of such receivables - prepared according to the template attached to the offer; 8.6. Contractor's statements about bthe cancellation of a decision against him as a preventive measure for the prohibition of applying for a public order - drawn up according to the template attached to the offer;

8.7. performance of the Contractor's non-delivery of a final conviction of a conviction court for violation of liberty or a fine, to the extent specified by the Awarding Entity pursuant to art. 24 sec. 5 points 5 and 6 of the Public Procurement Lawaccording to the template attached to the offer;

8.8. Contractor's statement on not paying taxes and local fees, referred to in the Act of 12.1.1991 on local taxes and charges (Journal of Laws of 2018 item 1445) - prepared in accordance with the template attached to the offer.

9. Specific rules for the submission of documents, in particular by Economic Operators appearing jointly, Wa contractor having a registered office or place of residence outside the territory of the Republic of Poland (hereinafter referred to as the Republic of Poland) and the Contractor having its registered office in the territory of the Republic of Poland, with respect to a person residing outside the territory of the Republic of Poland and the dates of their issuing have been specified in the ToR, with: 9.1. in the case of an Economic Operator having its registered office or place of residence outside the territory of the Republic of Poland, it shall apply- 7 of the Regulation of the Minister of Development of 26.7.2016 on the types of documents that the contracting authority may request from the contractor in the procurement procedure (hereinafter: "ordinance") in the scope of demonstrating the lack of grounds for exclusion; 9.2 for the Contractor having registered office in the territory of the Republic of Poland, - 8 applies to a person residing outside the territory of the Republic of Polandabove. regulation regarding the demonstration of no grounds for exclusion.

10. The contracting authority provides for the procedure referred to in art. 24aa of the Public Procurement Law

11. The Ordering Party is the administrator of personal data within the meaning of the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27.4.2016 on the protection of individuals with regard to the processing of personal data and onthe free flow of such data and the repeal of Directive 95/46 / EC (hereinafter: "RODO").

12 The contractor submitting the offer in the procedure is required to submit a declaration required from the Contractor to fulfill the information obligations provided for in Article 13 or Article 14 of the RODO, whose model is an attachment to the offer.

13 The Contractor submits the offer via the Form for submission, changesy, withdrawal of the offer or application available on ePUAP and also made available on the miniPortal. The public key necessary to encode the offer by the Contractor is available to contractors on the miniPortal
