1. The subject of the order is the delivery of standard package subscription packages for hosted services and technical support (collectively referred to as the Products) under the agreement in forcefor 36 months.

2. The offered products are to be standard products commonly available on the market (Commercial off-the-shelf type - COTS).

3. The ordering party requires the delivery of Produktow on terms provided by the software producer (Producer) for units performing public tasks, in accordance with the contractual rules

4. The offered products are to be standard products commonly available on the market.

5. Software subscriptions must guarantee the availability of the latest version of the software available during the term of the contract.

6. Services and mus softwareand allow the transfer, use or licensing of purchased software licenses to affiliates and third parties with whom the Employer cooperates, including the State Treasury.

7. The Employer allows the offering of Products with a wider than described functionality.

8. Due to the wide functional and territorial scope of the implementation planned on the basis of the ordered softwareframing and the need to minimize costs related to the implementation, training and operation of systems, the Ordering Party requires an offer including Products, enabling the use of common and uniform procedures for mass installation, updating, management, monitoring and technical support.

9. The Contractor shall provide access to a personalized page allowing authorized persons fromthe Ordering Party's website at:

a. activation of purchased packages,

b. access to the platform service resources,

c. resource management of the platform service.

10. The Contracting Authority requires the granting of authorizations on the producer's website and access to the platform service within 10 business days of signing the contract.

11. After ninety (90) days from the end of the contract period, the Contractor will provide the opportunitydisabling the account on the personalized website of the Ordering Party and deleting his data.

12. The Contractor shall provide the Employer's defense for claims by a third party for infringement of the copyrighted product offered in the event of immediate notification of the claim by the Contractor about the compensation claim. If the new version of the Product will contain more restrictive usage rights than inersja, which was current at the date of submitting the offer, these more restrictive rights of use will not apply to the use of this Product by the Ordering Party.

14. A detailed description of the subject of the order together with a description of the minimum parameters and technical and functional requirements is contained in Annex A to the ToR.

Contractors who are not subject to the order may apply for the orderexclusion from the proceedings under Art. 24 sec. 1 of the Public Procurement Law and meet the conditions for participation in the proceedings, specified by the Employer in the notice of procurement and SIWZ.

1. In order to initially confirm the absence of grounds for exclusion and fulfillment of the conditions for participation in the proceedings, the Contractor shall attach a statement in the form of a Uniform Europeano Order Document, hereinafter referred to as: "EAT", constituting Annex No. 8 to the Terms of Reference - espd-request [DZ / 13/18] xml "- readable Annex No. 8a to SIWZ - espd-request [DZ / 13/18] PDF, in accordance with the Instruction of completing the EED, constituting Annex No. 7 to the Terms of Reference and in accordance with the specimen specified in the executive regulation of the European Commission issued on the basis of art. 59 par. 2 of Directive 2014/24 / EU and art.80 ust. 3 of Directive 2014/25 / EU.

2. In the case of joint application for the Contractors, "EAT" is submitted by each of the Contractors jointly applying for the order.These documents confirm initially the lack of grounds for exclusion from the proceedings and fulfillment of the conditions for participation in the proceedings, in which each of the contractors demonstrates compliance with the conditions of participation in the proceedings.

3when the Contractor refers to the resources of other entities referred to in art. 22a of the Public Procurement Law, the Contractor submits an EGF regarding these entities and an undertaking - Annex No. 6 to the Terms of Reference. These documents initially confirm the lack of grounds for exclusion from the proceedings and fulfillment of the conditions for participation in the proceedings to the extent that the Contractor relies on the resources of these entities. Ordering partyformulates that in Part IV, the criteria for qualifying the form EAT provides for the possibility of submission by the Contractor of a general declaration of compliance with the conditions for participation in the procedure (eligibility criteria), which allows the contractor not to fulfill further conditions relating to particulars of participation in the procedure specified by the Employer. The Contractor is limited to filling in. General 0provision for all eligibility criteria, constituting preliminary confirmation of meeting the conditions for participation in the proceedings.

List of statements or documents confirming no grounds for exclusion at the request of the Employer

1. The ordering party will call the Contractor whose offer has been assessed as the most advantageous to submit in the shortened, not shorter than 10 days, currentand the day of submitting the following statements or documents:

1) information from the National Criminal Register in the scope specified in art. 24 sec. 1 point 13, 14 and 21 of the Public Procurement Law, issued not earlier than 6 months before the deadline for submitting bids;

2) statements of the contractor about the lack of a final court decision or final administrative decision on payment of tax, o, fees or social security or health insurance premiums or - in the event of issuing such a verdict or decision - documents confirming payment of these receivables together with any interest or fines or conclusion of a binding agreement regarding repayment of such receivables - Annex 9 to the ToR;

3 ) the contractor's statement about the lack of a ruling against him as a preventive measureban on applying for public orders - Annex No. 10 to the ToR.

2. If the contractor has its registered office or place of residence outside the territory of the Republic of Poland, instead of the document referred to in para. 1 point 1 shall submit information from the relevant register or, in the absence of such register, another equivalent document issued by the competent judicial or administrative body of the country, in-whose contractor has the seat or place of residence or place of residence has a person who concerns information or a document, to the extent specified in art. 24 sec. 1 points 13, 14 and 21 of the Public Procurement Law - issued not earlier than 6 months before the submission of offers - c.d in section III.1.2)

3. If in the country in which the contractor has its registered office or place of residence or place-residence has the person the document refers to, the documents referred to in paragraph 2, it is replaced by a document containing the statement of the contractor, indicating the person or persons authorized to represent it, or a statement of the person to whom the document was to be submitted, before a notary or before a judicial, administrative or self-government bodyhim or the economic operator competent for the place of residence or place of residence of the contractor or place of residence of that person - issued not later than 6 months before the offer submission has expired.

4. Contractor established in the territory of the Republic of Poland, in relation to a person residing outside the territory of the Republic of Poland, which is referred to in the document referred to in paragraph 1-point 1, submit the document referred to in paragraph 2, to the extent specified in art. 24 sec. 1 points 14 and 21 of the Act. If there is no such document in the country in which the person concerned is to reside, it is replaced by a document containing a statement of that person made before a notary or before a judicial, administrative or self-government bodyb economic proper for the place of residence of this person.

5. The Employer demands from the Contractor, which relies on the abilities or situation of other entities on the terms specified in art. 22a of the PZP Act, to present documents referred to in para. 1 points 1, 2 and 3.

1. Contractor, at the latest on the day of submitting bids and before the deadline for submission of offers, guiltn pay a deposit in the amount of PLN 30, 000.00 (in words: PLN thirty thousand).

2. Based on Article. 67 sec. 1 point 7 of the Public Procurement Law, in the period of three years from the delivery of the subject contract to the previous Contractor supplies, the Contracting Authority provides for the order for additional deliveries up to 50% of the value of the basic order.

3. The order referred to in paragraph 1 will be pit was on delivery of similar deliveries to the order of the basic order specified in the subject description.

4. The method of delivery will be carried out in accordance with the rules provided for the implementation of the order specified in the description of the subject of the order and in the contract.

5. It is anticipated that the value of similar contracts will be determined based on past experience, as agreednot with the methodology adopted while estimating the value of the basic order, taking into account changes in market prices.

6. Employer based on art. 93 para. 1a of the Public Procurement Law, may invalidate the procedure for awarding a contract, if the funds that the Employer intended to allocate to finance all or part of the order were not granted to him. According to the provisions of art. 24aa of the PZzp Act, The Employer will first evaluate the offers and only in relation to the Contractor whose offer has been assessed as the most advantageous, will examine the lack of grounds for exclusion and fulfill the conditions for participation in the proceedings.
