1. Only Contractors who are not subject to exclusion from the proceedings under Art. 24 sec. 1 of the Act

2. The ordering party will exclude from the proceedings for the contractor's order to be ordered afterdst. Art. 24 sec. 5 points 1, 4, 8 of the Act. None of the Contractors appearing jointly may be subject to exclusion on the basis of Art. 24 sec. 1 and art. 24 sec. 5 points 1, 4, 8 of the Act

3. In order to initially confirm the absence of grounds for exclusion of the Contractor from participating in the public procurement procedure, the Contractor will send in an electronic form (with a qualified electronic signature)z), valid as at the day of submitting bids The statement referred to in art. 25a para. 2 of the Act, in the form: EAT Annex No. 2 to the SIWZ EAT should be prepared and sent in accordance with the provisions of Chapter 12 point 8 of the ToR.

4. The ordering party shall call the Contractor whose tender has been best assessed before submitting the order, to submit the declarations or the document valid as at the date of submission of the order within the prescribed periodow, confirming:

1) there are no grounds for exclusion, in accordance with Chapter 6 point 2.1 of SIWZ

2) that the offered supplies meet the requirements specified by the Employer, in accordance with Chapter 6 point 2.2 of the ToR.

5. If the Contractor is established or resides outside the territory of the Republic of Poland instead of the documents referred to in: - 1) point 2.1 subsection 1). 6 of the SIWZ consists of information from the relevant register or in pIn the absence of such a register, another equivalent document issued by the competent judicial or administrative body of the country in which the Contractor has its registered office or place of residence has the person concerned - Information or document in the scope specified in art. 24 sec. 1 item 13, 14 and 21.

2) point 2.1 subsections 2, 5, 6, and 6 of the SIWZ consists of a document or documents issued in the country in whichThe Contractor has his registered office or place of residence, confirming that: a) he is not in arrears with taxes, fees, social security or health insurance contributions or that he has entered into an agreement with the competent authority regarding the repayment of such receivables with any interest or fines, of particularity, he obtained the legally required exemption, postponement or payment of overdue installments-payment or suspension in full of the execution of the decision of the competent authority,

b) its liquidation has not been opened or bankruptcy has been announced

6. Documents referred to in point 3 subpoint 1 and point 3 subpoint 2 lit. b. 6 of the SIWZ should be issued not earlier than 6 months before the deadline for submission of tenders. Document referred to in point 3 point 2 lit. a distinction 6 of the Terms of Reference, it should be issued not before3 months before the deadline.

7. If in the country in which the Contractor has its registered office or place of residence or the place of residence has a person whose document concerns, the documents referred to in item 3 of the 6 SIWZ, it is replaced by a document containing the Contractor's declaration, indicating the person or persons authorized to represent it, or a statement of personsy whose document was to be submitted to a notary or before a judicial, administrative or professional self-government or economic authority competent for the seat or place of residence of the Contractor or the place of residence of that person. Recording of point 4, 6 of the ToR apply.

8. Contractor based in the Republic of Poland, in relation to a person residing outside ofthe Republic of Poland, which concerns the document indicated in point 2.1 point 1 Roz. 6 of the Terms of Reference, submit the document referred to in point 3 sub-point 1 of the SIWZ. 6 within the scope defined in art. 24 sec. 1 points 14 and 21. If in the country in which the person has a place of residence, the document does not appear, it is replaced by a document containing the statement of that person submitted before the notary orb before the judicial administrative body or the authority of the professional or economic self-government competent for the place of residence of that person. Recording of point 4, 6 sentence 1 applies
