1. The subject of the order jis the delivery of IT equipment, software and the implementation of new e-services processes along with the adaptation of the server room to SPZOZ in Radzyń Podlaski. A detailed description of the subject of the order is defined in Annexes 3.1-3.5, 11 and 12 to the ToR.

1. When submitting an offer, each Contractor is obliged to pay a deposit of PLN 40, 000.00 (in zlotys: forty) to the offered tasks.PLN thousand 00/100)

2. The bid bond must be submitted before the deadline for submitting bids.

3. The terms of payment of the tender deposit may be made in one or more of the following forms: - 1) money, - 2) bank guarantees or guarantees of the Social Credit Union, but the surety is always a cash guarantee,

3) bank guarantees,

4 ) insurance guarantees(5) sureties granted by entities referred to in art. 6b par. 5 point 2 of the Act of 9.11.2000 on the establishment of the Polish Agency for Enterprise Development (Journal of Laws 2018, item 110, 650).

Failure to secure the offer accepted as a security deposit will exclude the Contractor and the submitted offer will be rejected. . The bid security paid in the form of guarantees and sureties must meet the followingrequirements:

1) be issued to the Employer, i.e. Independent Public Health Care Center in Radzyń Podlaski [address: ul. Wisznicka 111, 21-300 Radzyń Podlaski];

2) contain in its content statement of the guarantor (guarantor), in which he undertakes to unconditionally and irrevocably pay the amount of the bid bond at the first request of the Employer, containing a statement that one of thepremises mentioned in art. 46 ust. 4a and 5 PZP;

5. The bid security paid in cash is paid by bank transfer to the Employer's bank account:

6. Effective payment of the bid bond in cash takes place at the moment the cash is credited to the Contracting Party's bank account, referred to in Chapter. VIII para. 5, before the deadline for submitting bids (ie before the end of the day and the hour designated as the deadline for submitting bids).

7. The Employer allows submission of documents to the offer from Ch. VIII para. 3 pkt 2-5 only in the form of originals. Proofs of payment of the bid security should be placed in the offer.

8. Conditions for returning the bid bond The Purchaser shall return the bid bond to all Contractors immediately after the selection of the most advantageous tender or cancellation of the proceedings, with the exception of the Contractor whose offer has been selected as the most advantageous subject to art. 46 ust. 4a PPL. Contractor whose offer has been selected aso the most advantageous, the Ordering Party returns the bid bond immediately after the conclusion of the public order contract.

9. The validity period of the bid bond must be in line with the offer binding date.

10. The ordering party shall retain the bid bond with interest, if the contractor whose offer has been selected:

1) refused to sign a public procurement contract on terms specified in the offer;

2) in response to-the call referred to in art. 26 par. 3 and 3a of the PPL act, for reasons attributable to him, he did not submit declarations or documents confirming the circumstances referred to in art. 25 ust. 1, statements referred to in art. 25a para. 1 of the PPL Act, proxies or did not agree to correct the error referred to in art. 87 par. 2 point 3 of the Public Procurement Law, which resulted in the lack of possibility to choosethe tender submitted by the contractor as the most advantageous.

3) the conclusion of the public procurement contract became impossible due to reasons attributable to the Contractor

11. The Contractor's offer, which will not bring the bid bond or bring it in an incorrect way, will be rejected.
