Software and equipment supply contract for upgrading the hardware and software infrastructure of the National System Unique for Emergency Calls

The purpose of the acquisition is to upgrade the hardware and software infrastructure of the National Emergency Response System at national level through:

Main Site: At the headquarters of the contracting authority, 112, dispatchers and substations located in all municipalities.

The contract is aimed at providing equipment and computer applications for modernizationhardware and software infrastructure of the National Emergency Response System, grouped on the following systems / subsystems / components:

(a) Centralized Emergency Call Acceptance and Dispatching System - 1 cpl., composed of:

1) Subsystem processing emergency calls and administering applications and specific data SNUAU - 1 cpl.;

2) Voice overvoltage backup subsystem -1) 3) GIS-1 subsystem c) 4) ARLS subsystem 1) 5) Subsystem locating calls from mobile public networks - 1 cpl; 6) Interconnection component operators for answering calls - 1 7) Network Component - 1 cpl; 8) Power Component 1 cpl; 9) Interface Component with TETRA-1 radio infrastructure, b) WAN / MAN Data Communications Reserve Component-- 1 cpl.,

(C) Upgrading component of the emergency call reception and dispatching points - 1 cpl.

The delivery of the equipment and computer applications will also include the provision of related services for installation, configuration, commissioning, integration and their operationalization. Detailed information can be found in the tender documents.

The economic operator participating in the processregardless of its quality (bidder with individual offer, affiliate bidder, subcontractor, third party supporter) should not be subject to provisions 164, 165 and 167 of Law no. 98/2016, as subsequently amended and supplemented, which determines the exclusion from the award procedure.

Method of performance: According to art. 193 of Law no. 98/2016, with modifications and comthe next pleading will be completed and presented to the AUC (Single European Procurement Document) for each economic operator participating in the procedure (nominated at the level of an offer). A separate DUAE will be required to be filled in and submitted, including for associates, subcontractors or third-party supporters, if they exist.

If the tenderer demonstrates that the refto the economic and financial situation or to the technical and professional capacity based on the capabilities of other entities, invoking, where appropriate, the support of a third party, the DUAE, together with the commitment to support, must be separately filled in by the supporting third / i) whose capacity is based on the bidder. DUAE submitted by third party / supporter (s) will includethe information referred to in Art. 193 par. (1) lit. a) of Law no. 98/2016, as subsequently amended and supplemented, as well as the information in par. (1) lit. b) and c) of the same article, which are relevant for the support granted in the award procedure concerned.

If the tenderer intends to subcontract a part / s of the contract, the DUAE shall include andand information on the part of the contract to be subcontracted and annexed to the subcontracting agreement. Subcontractors whose capabilities the tenderer is based on must separately complete the DUAE, including all the information referred to in Art. 193 par. (1) lit. a) of the Law no. 98/2016, with subsequent amendments and completions, as well as those of lto align (1) lit. (b) and (c) of that same Article, which is relevant in the light of the capacities of the subcontractors on which the tenderer is based in the award procedure. In the case of subcontractors on whose capacity the bidder is not based, the DUAE will only contain the information referred to in Art. 193 par. (1) lit. a) of Law no. 98/2016, with modifications and completions

Prior to the award of the contract, the CA will ask the tenderer ranked first after applying the award criterion to submit updated supporting documents demonstrating that the qualification criteria are met, according to the information contained in the DUAE. the following supporting documents, valid (current / real) at the time(2) the judicial record of the economic operator, the amount of the tax, respectively the criminal record for each of the members of the administrative, management or supreme bodyand the persons who have the power of representation, decision or control within the said economic operator, as it results from the certificate issued by the Ministry of Justice - the Trade Register Office / the constitutive act of the economic operator; 3) as the case may be, other documents by which the economic operator demonstrates that he / she is in situations of ewhich does not lead to exclusion from the procedure provided for in Art. 165 par. Average annual turnover of the bidder(2015, 2016 and 2017) must be at least equal to RON 20 000 000. 1) Ranking of bids with equal scores: If, following the application of the award criterion, two or more economic operators (OEs) ) are ranked first, with the same total score, the winning bid will be the one that scored the best for the "Offer price. "If among OEs ranked first, with the same total score, two or more OEs have the same score for the bidding factor, the winning bid will be the one of OE who scored the best score for the" Duration of the additional warranty period and technical support. If and after rthe SEAP, OE will not be able to be separated, the provisions of art. 212 paragraph (1) lit. c) of Law no. 98/2016, and the award procedure will be canceled; 2) Confidentiality: The EO will prepare the tender in accordance with the provisions of the awarding documentation and will indicate, in its content, which information in the technical proposal and / or the financial proposal isclassified or protected by an intellectual property right under the applicable law; 3) The AC has the right to request in the original any special document whose validity is conditioned by the presentation in this form; 196 par. (1) of the Law no. 98/2016, the CA may ask the EO to deposit all or some of the documentsas evidence of the information contained in the DUAE, at any time during the course of the proceedings, if necessary to ensure the proper conduct of the procedure, 5) EOs interested in participating in the procedure may access the DUAE at https: // ec. europa.eu/growth/tools-databases/espd/filter;

6) Documents to be transmitted by electronic means are applicable prevlegal editions related to electronic signature (Law 455/2001). Thus, tender documents, DUAE, qualification documents, any other supporting documents and, as the case may be, answers to requests for clarification, shall be transmitted according to the CA request, through SEAP, necessarily signed with an extended electronic signature, based on a qualified certificate, issuet by an accredited certification service provider, being considered as original documents. Documents issued by authorized institutions / bodies must be signed and initialed in accordance with the legal provisions, and the extended electronic signature based on a qualified certificate issued by an accredited certification service provider belonging to the EO shall be applied by him7) Personal data requested in the present procurement procedure are processed in accordance with the provisions of Regulation no. 679/2016.
