Supplying the training platform according to the specifications

Bidder / third party / subcontractor must not be in the foreseeable situationit's at art. 164, art. 165 and art. 167 of Law no. 98/2016. The way in which the fulfillment of the requirement can be demonstrated: the economic operators will complete the European Unique Acquisition Document (DUAE), according to the quality they are participating in, taking into account the provisions of Law no. 98/2016 (it is recommended to consult AMAA Notification No 240/2016 on the DUAE User Guide for-to the economic operators):

The individual bidder presents the DUAE completed as follows:

1) on his own situation, with the information provided by art. 193 par. (1) lit. a) of Law no. 98/2016; 2) regarding the declared subcontractors, according to art. 193 par. (3) of the Law no. 98/2016, with the information provided by art. 193 par. (1) lit. a) of Law no. 98/2016, including those stipulated in art. 150 par.(2) of H.G. no. 395/2016: the name and contact details of the subcontractors, the part (s) of the contract to be fulfilled by them, the value to which the party (s) are raised;

3) regarding the third parties, according to art. 193 par. (2) of the Law no. 98/2016, with the information provided by art. 193 par. (1) lit. a) of Law no. 98 / 2016.

At the same time, the bidder presentsa:

(a) DUAE completed by subcontractors (art. 170 par. (1) of the Law no. 98/2016]; (b) subcontractors' agreement on the information referred to in point 2 (art. 150 par. (2) of H.G. no. 395/2016],

(c) DUAE supplemented by third-party supporters [art. 183 par. (1) of the Law no. 98/2016], (d) the commitments of third parties (Forms 6 and 7 of Section B - Forms), accompaniedof the documents submitted by them, which show the actual manner in which their support will materialize (art. 182 par. (3) and (4) of H.G. no. For the bidder-associate, the association leader shall: (i) in its own DUAE: information on the declared subcontractors and / or third party advocates of the association, as specified in points 2 and 3 above, ii) DUEA completed by each of the associated members, with the information provided by art. 193 par. (1) lit. a) of Law no. (Iii) the Association Agreement and the documents specified in (a) (d) above.

The supporting documents mentioned in points 1 4, which prove the fulfillment of the assumed by completing the DUAE, will be submitted only by the bidderin the first place in the ranking after the application of the award criterion, at the completion of the evaluation of the tenders and only at the request of the contracting authority.

It will be required to present the average of the global turnover in the last 3 years, respectiv for the years 2015, 2016 and 2017 that is at least equal to RON 4, 400, 000.00. For the RON / currency equivalent, the average annual RON / currency exchange rate communicated by the NBR will be taken into account. The economic operator can demonstrate his economic and financial capacity by invoking the support provided by another person. The bidder will prepare the offer in accordance with the provisions of the documentedaward and will indicate in its contents which information in the technical proposal and / or the financial proposal is confidential, classified, or protected by an intellectual property right. The offer has a firm and binding character from the point of view of its content throughout its validity period, it must be signed, on its own responsibility, by the bidder or-to the person legally empowered by him / her. The evaluation commission has the obligation to establish the winning bid of the admissible tenders based on the criterion for the award of the public acquisition contract. Before awarding the public procurement contract, the contracting authority shall request the tenderer ranked first after applying the award criterionpresent without delay the updated supporting documents demonstrating that all the qualification criteria have been met, according to the information contained in the DUAE. If, following the establishment of the final ranking according to the award criterion, the evaluation commission finds that there are two or more bids with the same score, the tie will be made taking into account the score obtained by the rating factors in descending orderhas their weights. If the equality is maintained, the contracting authority will request through SEAP, for electronic loading by the respective economic operators, documents containing new prices and the winning tender will be designated with the lowest financial proposal. Any communication, solicitation, information, notification, and the like will be-uploaded in SEAP and signed with an extended electronic signature based on a qualified certificate issued by a certification service provider accredited under the law.
