Winter maintenance of road lanes of district roads in the City and Commune of Aleksandr-w Łodzki, and the commune of Parzęczew.

Reference Number: ZP.272.52.2018

1. The subject of the order is the service of winter maintenance of road lanes of poviat roads, Zgierz poviat in the City and Commune of Aleksandr-w Łodzki and the commune of Parzęczew, consisting in removing snow and removing slipperywinter from the road and pavements. The scope of the subject of the order also includes cleaning poviat roads from the sand after the winter period.

Main Site: Zgierski Poviat, poviat roads within the City and Communes of Aleksandrow Łόka and Parzęczew Communes

Certain guidelines for the implementation of the subject of the order contained in:

1) Plan for winter maintenance of poviat roads in the season 2018/2019 forin the Zgierz poviat - Annex 5 to the Terms of Reference;

2) STWiOU cleaning roads and streets and pavements of the Zgierz Poviat after the winter - constituting Annex 6 to the ToR;

3) STWiOU clearing the road constituting Annex 7 to the ToR;

4) list of roads - constituting Annexe No. 8 to the ToR,

3. As part of emergency transport, the Ordering Party reserves the right to direct the contracton other sections of poviat roads in the Zgierz poviat, than those which were assigned to a given part of the order.

4. The Contracting Authority reserves the right to move equipment to other sections of poviat roads in the Zgierz Poviat.

5. The scope of services and detailed location of work will be determined each time by the duty coordinator from the Road Engineering Department.

6. CoordinatorAs a winter action on behalf of the District Road Administrator, it will be handed over to the Contractor each time a duty is set for a given day. The Contractor undertakes to proceed immediately, to combat slipperiness, after notification by the Employer, not later than during the reaction declared in the submitted offer. The call can be made each time on the phone depending on the situationon the roads and needs coordinating the winter action.

9. The orderer reserves the right to take samples of the mixture to examine the salt content in the mixture. If a smaller quantity is found by more than 5% from the one required, a fine of PLN 1, 000.00 (in words: one thousand zlotys) will be imposed each time.

10. Work performed without the disposition disposition will not be paid for prorder from the Employer.

11. The Ordering Party does not bear the costs related to access from the base to the area covered by winter maintenance.

12. As part of the contract price, the Contractor assures the loading of the equipment with a mixture.

13. The service includes all calendar days and all hours throughout the day. This work is not a permanent job, media and equipment are called to work depending on the needs.

14. Performerassumes full responsibility for the proper performance of services, provision of security conditions, maintenance in accordance with standards, quality of materials and appropriate organizational and technical methods. The contractor should provide competent management, personnel, materials, equipment and other equipment as well as all items to perform services to the extent that this circlewas ordered in the subject of the order.

16. The Contractor is obliged to direct for the service the equipment referred to in the relevant part of the order and at its cost to equip it with a yellow pulsating light, in accordance with the requirement specified in art. 54 of the Act of 20.6.1997 Traffic Law (2017, item 2160, as amended). Failure of the equipment will not release the Contractor from the obligation to performIn this situation, the Contractor will be obliged to substitute replacement equipment. 43 par. 2b points 2 of the Act on Public Procurement Law, the Awarding Entity has set the deadline for submitting tenders shorter than the date specified in para. 2 art. 43 of the Act on Public Procurement, as it considered that there is an urgent need to award the contract and shorten the deadline for submitting bids due tothat the previous proceedings covering the subject of the order in its scope as one of the tasks, ie. Winter maintenance of roads in poviat roads in the City and Commune of Aleksandr-w Łodzki, and Parzęczew commune - has been annulled, and the use of usual dates at least jeopardizes the execution of the order at the desired time it can cause negative economic or social effectsfailure to execute the order within this period.

The Ordering Party will exclude Contractors from the proceedings, for which the conditions specified in art. 24 sec. 1 item 12-23.

The Contractor shall attach the offer valid as at the day of submitting bids: In order to assess the fulfillment by the Contractor of the condition referred to in Section IV and whether the Contractor is not subject to exclusion from the proceedings regarding the grounds referred to inle V The Contractor submits a declaration valid as at the day of submitting offers in the form of a single European order document (EAT), referred to in art. 25a paragraph 2 of the Act, drawn up in accordance with the form provided in the Commission Implementing Regulation issued on the basis of art. 59 par. 2 of Directive 2014/24 / EU, the model of which is Annex 3 to the Terms of Reference of the ToR, the Contractor obligedit is sent to the Ordering Party of the E-mail in an electronic form with a qualified electronic signature, in accordance with the rules specified in Section VII of the ToR - in the case of joint application by the Contractors, referred to in art. 23 of the JITZ Act separately submits each of the Contractors jointly applying for the order. The content of the statement should confirm compliance with the conditionact in the proceeding, no grounds for exclusion to the extent that each Contractor demonstrates fulfillment of the conditions of participation in the proceeding and no grounds for exclusion; the Contractor who intends to entrust the execution of a part of the order to subcontractors,, Ada (EAT) subcontractors in the absence of grounds for exclusion, third party liability - if applicable, Contractor who relies on resources-other entities, submits (EAT) third parties together with a commitment, in the case of Contractors acting through a proxy power of attorney (presented in the form of an original or a copy authenticated by a notary public). Proceedings are conducted based on the provisions of art. 24aa paragraph Act. 2. Contractor whose offer will be evaluated as the most advantageous for the purpose of confirmationia meeting the conditions for participation in the proceedings and the grounds for exclusion, upon the request of the Employer, will be obliged to submit (within no more than 10 days of receiving the said call) declarations and documents. Within 3 days from the date of posting on the Ordering Party's website information referred to in art. 86 of the Act specifying the companies and addresses of Contractors whosubmitted offers within the deadline for submitting bids, the Contractor is obliged to provide the Employer with a declaration of affiliation or lack of belonging to the same capital group (in the form of the original). In the procedure for ordering communication between the Employer and Contractors is carried out via the postal operator, in person, via a messenger, fax or usingelectronic communication. In the absence of confirmation of receipt of correspondence, a confirmation of sending the message shall be accepted as confirmation of receipt. The declaration shall be submitted in writing or in electronic form, however, the EAT should be sent in an electronic form with a qualified electronic signature to the email address: eat @ County.zgierz.pl. The offer shall be made in writing in Polish, under pain of nullity
