Operation of sewage pumping stations in the catchment area of the City of Puszczykowo

The subject of the Order is a service consisting in the operation of a sewage pumping station in the catchment area of the City of Puszczykowo.

Main Site: City of Puszczykowo - Poznań District

Aquanet it commissions and the Contractor undertakes, throughout the term of this Agreement, do maintaining the Equipment in a condition ensuring their full efficiency and uninterrupted ability to perform the receipt and transmission of wastewater by Aquanet in a continuous and reliable manner and for the ongoing operation of the Equipment, and in particular to carry out the following activities:

1. supervising and direct service of the Devices;

2. performing cleaning and auxiliary works, the object of which will be the Officezenia and real estate on which the Equipment is located;

3. maintenance and performance of current repairs of the Equipment specified in SIWZ.

4. maintenance of an ambulance ensuring immediate action in the event of finding or reporting by a third party (including recipients of Aquanet services) any irregularities in the functioning of the Equipment; compliance with applicable, in the field of fuFunctioning of the Regulations of environmental protection law;

6. supervision over the Objects collateral according to the current security status of the Objects

1. Contractors may participate in the proceedings, who are not subject to exclusion from the procurement procedure in the circumstances referred to in art. 24 sec. 1 point 12-23 of the PPL (with the exclusion referred to in Article 133 paragraph 4 of the PPL), art. 24 sec. 1, 5, 6and 8 Pzp and who meet the conditions for participation in proceedings regarding: a) competences and entitlements to conduct a specific professional activity, if it results from separate regulations, b) economic and financial situation, c) technical and professional capacity

2. In order to confirm the lack of grounds for exclusion from the proceedings and to confirm compliance with the conditions for participation in the proceedingsthe contractor will be required to provide the orderer with the following declarations and documents, in terms specified in detail in the relevant terms of reference (hereinafter: SIWZ): a) Contractor's statement constituting preliminary confirmation of compliance with the conditions for participation in the procedure set out in this SIWZ and no grounds for exclusion, submitted on a uniform European form dof the Order's Order (hereinafter referred to as "EAT"), the model of which is specified in the Commission Implementing Regulation (EU) 2016/7 of 5.1.2016 establishing the standard Single European Order Document (EU L series 2016 Edition No. 3, pp. 16) The EAT declaration is submitted only in electronic form with a qualified electronic signature, EAT should be sent to the e-mail address: jedz @ aquanet.pl before the deadline for submitting offers. b) excerpt from the relevant register or from the Central Register and Information on Economic Activity, if separate regulations require an entry in the register or records, in order to confirm the absence of grounds for exclusion under Art. 24 sec. 5 point 1 Pzp;

c) certificate from the competent head of the tax office confirming that the contractor is not in arrearspayment of taxes, issued not earlier than 3 months before the deadline for submission of offers or other document confirming that the contractor has entered into an agreement with the competent tax authority regarding repayment of such receivables with possible interest or fines, in particular obtained the legally required exemption, postponement or distribution to installments of arrears or suspensionin full implementation of the decision of the competent authority; d) certificate of the relevant local organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the contractor is not in arrears with payment of social security or health insurance contributions issued not earlier than 3 months before the deadline submission of offers or other dockment confirming that the contractor has entered into an agreement with the competent authority regarding the repayment of such receivables, together with any interest or fines, in particular obtained legally permissible, postponement or payment in installments of overdue payments or suspension in full of the decision of the competent authority; The National Criminal Record in the scope specified in art. 24 ust. 1 points 13, 14 and 21 of the Act and, regarding conviction for offense to custody, to the extent specified by the awarding entity pursuant to art. 24 sec. 5 points 5 and 6 of the Act, issued not earlier than 6 months before the deadline for submitting bids;

f) statement of the Contractor regarding the lack of grounds for exclusion specified in art. 24 sec. 1 items 15 and 22 of the PPL and art. 24 sec. 5 points 5-6 Pzp and axisProviding the contractor not to pay taxes and local fees, referred to in the Act of 12.1.1991 on local taxes and charges (Journal of Laws of 2016, item 716) (Annex No. 5 to the ToR)

3 . Documents relating to foreign contractors are described in detail in clauses 7.4 - 7.6 of the SIWZ-IDW.

The Ordering Party does not set specific requirements for the description of compliance with the condition of participation inin respect of the condition regarding economic and financial capacity.

1. In order to confirm the lack of grounds for exclusion from the procedure for granting the order in the circumstances referred to in art. 24 sec. 1 item 23 of the PPL, the contractor will be required to submit a declaration on belonging to or not belonging to the same capital group. This contractor's statement should be fromto submit within 3 days from the date of placing by the Employer on the website, information referred to in Article 86 par. 5 Pzp. The pattern of the statement is contained in Annex 4 to the ToR.

2. In the procedure for ordering communication between the Employer and Contractors is carried out through the postal operator within the meaning of the Act of November 23, 2012. Postal Law, in person, -via a messenger, fax or using means of electronic communication within the meaning of the Act of 18.7.2002 on the provision of electronic services, including the requirements for form, set out below.

3. In the proceedings, the declaration shall be made in writing or in electronic form, however, that EAT should be sent in an electronic form bearing the qualificationswith an electronic signature. Declarations of entities submitting a joint bid (Article 25a (6) of the PPL) and entities making the potential available (Article 25a paragraph 3 point 1 of the PPL) submitted on the EAT form should be in the form of an electronic document signed with a qualified electronic signature by each of them in the scope of as confirmed by the circumstances referred to in Article 22 para. 1 Public Procurement Laws

4. The electronic communication means used for submitting EAT by the Contractor is e-mail. Attention. Placing an EAT along with an offer on a data carrier (eg CD, pendrive) or writing is inadmissible, because it does not constitute its submission using means of electronic communication within the meaning of the provisions of the Act of 18.7.2002 on the provision of electronic services.. EAT along with any attachments must be submitted in electronic form with a qualified electronic signature until the deadline for submitting offers to: jedz@aquanet.pl

6. The information to be provided in EED has been described in detail in point 7.1.a) of the ToR.

7. A detailed instruction regarding the submission of the EAT in electronic form can be found in item 8.8 of the Terms of Reference - 8. The complete offer must be in favorbelieve:

a) the offer form (Annex No. 1 to the ToR);

b) in case of signing the offer by proxy, and in the case of contractors jointly applying for granting the order, c) in the case of relying on the ability of another entity to oblige that entity to give the contractor the necessary resources to fulfill the order.4. SIWZ is available for freeon the Ordering Party's website (www.aquanet.pl) since the publication of this announcement on the order in the Official Journal of the European Union, in accordance with art. 42 par. 1 Pzp. At the same time, the contracting authority informs that it will not provide the contractors with SIWZ in paper form.

5. The offer validity period is 60 days.
