The subject of this order is the design and construction of: expansion, reconstruction and renovation of existing facilities and the construction of new facilities, construction equipment, modernized wastewater treatment plant Kapuściska in Bydgoszcz at ul. Toruńska 324A

Prthe subject of this order is the design and construction of: expansion, reconstruction and renovation of existing facilities and the construction of new facilities, construction equipment, in the modernized sewage treatment plant KapuĹ "skiska in Bydgoszcz at ul. Toruńskiego 324A, including, among others:

1) Expansion of the mechanical part of the sewage treatment plant:

a) extension of the supply of raw sewage - object K-0;

b) reconstruction of the pumping station-PK-0 with equipment replacement;

c) reconstruction of drainage station object 28;

d) biofilter construction at PK-0,

e) renovation of building grates and mechanical sand drainage with sand expansion chamber, with replacement of equipment and installations - object 1;

f) reconstruction of the grit chamber with the replacement of equipment and installations, object 2;

g) construction of a biofilter for other objects of the mechanical part;

h) expansion of initial settling tanks -objects 3.1 and 3.2 with equipment replacement.

2) Expansion of the biological part of the sewage treatment plant:

a) replacement of equipment and installations of municipal sewage bioreactor - facilities 4.1 and 4.2;

b) renovation of secondary settling tanks - facilities 6 and 7;

c) reconstruction of the blowers station - object no. 19;

d) extension of the industrial sewage reactor for biological treatment of municipal sewage - Facility 5;

3) Expansion of the facilities of the wasp's economyand a gas sewage treatment plant:

a) construction of acid fermentation of primary sludge;

b) repair with replacement of sludge pumping station equipment Object 11;

c) construction of 2 compartments and renovation of existing closed fermentation chambers - object 12.1;

d) construction of a new and renovation with the replacement of equipment of the existing service building at ZKF-facilities 13 and 13A;

e) extension of the digestate sludge tankobject 14;

f) expansion of the boiler room with the replacement of equipment 29 and modernization of the cogeneration station object CHP;

g) extension and renovation with replacement of equipment for compaction and dewatering stations - object No. 17;

h) construction of a biogas tank with installations; ) replacement of biogas flare - object 23;

j) renovation with replacement of sewage pumping stations - facility 27;

k) elements of biogas - network expansionand biogas installations and expansion of heating networks,

l) disassembly of equipment and disassemblies of thickeners, objects 8.1 and 8.2;

4) Modernization of other facilities of the treatment plant with accompanying works:

a) renovation of administrative and technical building - object no. 25;

b) extension of interobjective wires and technological networks;

c) power and ACPiA works

d) auxiliary works: shapegrounding, greenery, traffic routes, sheds and rooms for switchgears and electric drives in KZ1-KZ4 chambers.

The detailed description of the subject of the order contains PARTS III of the SIWZ (Functional-Utility Program - "PFU") with attachments, subject to which The terms of order fulfillment and details of the Contractor's obligations are described in PART II of the ToR (ConditionsContract). Acting pursuant to art. 8 sec. 2a UPZP The Contracting Authority specified in the SIWZ requirements regarding the confidentiality of information contained in Annex No. 8 to PFU. As a result of the above Attachments will be made available in the manner indicated in the ToR. The remaining part of the SIWZ will be available to Contractors at http://www.bip.mwik.bydgoszcz.pl http://www.mwik.bydgoszcz.pl, in a way that unlimitedny, full and direct. In accordance with the provisions of art. 67 sec. 1 point 6 UPZP provides for the possibility of awarding orders consisting in the repeated reinstatement of similar services or construction works in accordance with the subject of the basic order, in the scope of designing and execution: chamber, tanks, networks and installations, renovation works, construction works in scope of extension, reconstruction and construction of facilitiesfrom electric power, automation and control, with a value not exceeding 20% of the basic order. The order will be awarded on the terms specified in the basic agreement constituting Part II of the ToR (Contract Conditions).

1. The contractors can apply for the awarding of the contract, who: - meet the conditions for participation in the proceedings specified by the Employer, regarding the economic situationfinancial and technical or professional capacity (the Employer does not specify a condition in terms of competences or entitlements to conduct a professional activity)

- They can not be excluded in the circumstances referred to in Article 24 (1) of the SPPs and Article 24 (5) points .1), 2), 3) and 8) UPZP.

For preliminary confirmation that the Contractor is not subject to exclusion and meets the conditions for participation in the proceedings, -The Contractor submits the current statement in the form of a single European order document (EAT) established by Reg. Kom (EU) 2016/7 of 5/01/2016, the Contractor shall send to the Ordering Party an E-mail encrypted and signed by a qualified electronic signature to the e-mail address: jedz@mwik.bydgoszcz.pl in such a way that it reaches the Ordering Party before the deadline for submission offers. In the content of the messagese-mail should indicate the name and the name of the proceedings which the EAT applies to and the name of the contractor. EAT each of the Contractors jointly applying for the order. The contractor, who refers to the resources of other entities along with the offer, also submits the statements of JEDZ regarding these entities

2. In order to confirm the absence of grounds for exclusion of the Contractor from participation in the Procurer proceedings-demands the following documents submitted to the ordering party's request in accordance with art.26 par. 1 UPZP by the Contractor whose tender was rated at the highest level:

a. information from the NQF in the scope specified in art. 24ust.1 pkt 13.14 and 21 UPZP, issued not earlier than 6 months before the deadline for submitting offers;

b. certificate of the competent US governor confirming that the Contractor is not in arrears with the optaxation, issued not earlier than 3 months before the deadline for submission of bids, or other document confirming that the Contractor has entered into an agreement with the competent tax authority regarding repayment of such receivables with possible interest or fines, in particular obtained the legally required exemption, postponement or distribution in installments of arrears or suspensionsto fully implement the decision of the competent authority;

c. a certificate of the relevant ZUS organizational unit or RUS Office or other document confirming that the Contractor is not in arrears with paying social security or health insurance contributions, issued not earlier than 3 months before the deadline for submission of bids, or other document confirming that the Contractor has concludedOration with the competent authority regarding the repayment of such receivables, together with any interest or fines, in particular obtaining the legally required exemption, deferral or payment in installments of overdue payments or suspension in full of the implementation of the decision of the competent authority;

d. excerpt from the relevant register or from central records and information on economic activity, if separate prwritings require entry in the register or records, in order to confirm the absence of grounds for exclusion under Article 24 (5) (1) of the Act;

e. the Contractor's statement that he has not been the subject of a final court judgment or final administrative decision on default of taxes, fees or social security or health insurance premiums, or - in the event of such a decision or decisionand - documents confirming the payment of these claims together with any interest or fines or the conclusion of a binding agreement regarding the repayment of such claims; the performance of the Contractor of the lack of a decision against him as a preventive measure for the prohibition of applying for public orders; Contractor's statement about not paying taxes and local fees, by whommentioned in the Act of November 12, 1993 on taxes and local fees.

3. If the Contractor relies on the resources of other entities, then he / she shall submit the above mentioned documents in point 2 to these entities. - This condition will be fulfilled if the Contractor shows that he has (in the case of two or more Contractors jointly applying for this order) theirtotal economic and financial situation):

a. liability insurance in the scope of conducted activities related to the subject of this order for a guarantee sum not less than PLN 10, 000, 000

b. financial means or creditworthiness of at least PLN 6, 000, 000

In order to confirm the fulfillment of the condition regarding the economic or financial situationrequesting from the Contractor, whose offer was assessed the highest:

- documents confirming that the Contractor is insured against civil liability in the scope of business related to the subject of the order for the guarantee sum required by the Employer,

- information bank or cooperative savings and credit account confirming the amount financial resources ownedor the creditworthiness of the Contractor, in a period not earlier than one month before the deadline for submission of tenders.

If for justified reasons, the Contractor can not submit documents regarding the financial or economic situation required by the Employer, may submit another document that sufficiently confirms compliance with the described by the ordering party to participate in posThe Contractor may, in order to confirm compliance with the abovementioned conditions for participation in the proceedings in relation to the order, or a part thereof, rely on the financial or economic situation of other entities, regardless of the legal nature of the legal relationship he has with it. In such a case, the Contractor must prove to the Ordering Party that he will have the necessary resources when performing the orderto these entities, in particular presenting with the offer the obligation of these entities to provide him with the necessary resources for the order.

The Contracting Authority assesses whether the resources made available to the Contractor by other entities allow the Contractor to demonstrate compliance with the above-mentioned conditions for participation in the procedure and examines whether there is any ground for exclusionreferred to in Article 24 paragraph 1 point 13-22 and 24 (5) (1), 2), 3) and 8) UPZP. - Contractor who refers to the resources of other entities, in order to demonstrate the absence of grounds for exclusion and compliance with them, in the scope of, in which he refers to their resources, the conditions for participation in the proceedings are also submitted together with the offer of the statement of JEDZ regarding these entities - Cd section III.1.3)the participant may, in order to confirm compliance with the above-mentioned conditions for participation in the proceedings in relation to the order, or parts of it, rely on the technical or professional abilities of other entities, regardless of the legal nature of the legal relationship he has with it. In such a case, the Contractor must prove to the Ordering Party that, in fulfilling the order, he will have the necessary resources for these ordersotow, in particular presenting with the offer an obligation of these entities to give him the necessary resources to fulfill the order.

- Requests and documents required, and the third party's obligation to putting the necessary resources at the disposal of the Contractor, they must meet the requirements specified in the UPZP and provisions of the Regulation of the Minister of Development of July 26, 2016on the types of documents that the contracting authority may request from the contractor in the contract award procedure (Journal of Laws of 2016 item 1126), in particular as to the form, - - Security deposit in cash and Security for due performance of the contract in money, it is paid by bank transfer to the account of the Employer No. 14 1240 3493 1111 0010 5925 8394,

- Documents must be enclosed with the offera valid authorization to sign an offer or other statements and documents submitted in the proceedings, including a relevant power of attorney (a) and proof of payment of a bid security (copy of the transfer order, if the bid bond is paid in cash, or original guarantee for other forms,

- The Contractor is not obliged to submit declarations or documents confirming fulfillment of the conditionso participate in the proceedings and no grounds for exclusion from the proceedings, if the Employer has statements or documents regarding this Contractor or can obtain them through free and publicly available databases, in particular public registers as defined in the Act of February 17, 2005 on computerization of entities' activities carrying out public tasks (Journal of Laws of 2017, item 570 t.j.). In the case referred to in - 10 para. 1 of the Ordinance of the Minister of Development of 26 July 2016 on the types of documents that the contracting authority may request from the Contractor in the procurement procedure (Journal of Laws of 2016, item 1126), the Employer requests the Contractor to provide a translation into Polish specified by the Contractor and documents collected by the Ordering Party.-If the Contractors in JEDZ refer to documents in the possession of the Ordering Party, the Ordering Party will take into account these documents, if they are up to date,

- The Contractor submits the required declarations and documents in accordance with the relevant models attached to Part I of the ToR (Instructions for Contractors) . Contractor, within 3 days of placing by the Proxy of the Ordering Party on the intinformation, referred to in art. 86 par. 5 UPZP submits to the Proxy of the Contracting Authority a declaration of belonging or non-affiliation to the same capital group as referred to in art. 24 sec. 1 point 23 UPZP. Along with the submission of a statement, the Contractor may provide evidence that links with another contractor do not lead to distortion of competition in the procurement procedure• The amount of the bid security required by the Ordering Party is PLN 1, 000, 000. The payment of a deposit in money by bank transfer to the bank account indicated by the Ordering Party will be effective upon crediting the bank account with the amount of the bid bond (if the effect of cash on the bank account indicated by the Ordering Party occurs before the deadline for submission of bids).enia) must be a unilaterally binding act. It must have the same liquidity as the cash deposit. The guarantee (surety) document should represent an unconditional guarantee, payable at the first request of the Ordering Party and, furthermore, the content of the guarantee should imply that the payment under the guarantee is not conditional upon acceptance of the claim of the Ordering Party. Original warranty (poręczenia) should be attached to the offer. Security for proper performance of the contract is set at 10% of the total (gross) price specified in the offer.

- The meeting of Contractors in order to get acquainted with the construction site (local vision) will take place at 10:00 on 26.10.2018. in Bydgoszcz at ul. Toruńska 324A. Participation in the meeting is not compulsory.
