When OMV Petrom initiates this procedure, it estimates that it will send an invitation to tender for the award of subsequent contracts within approximately 12 months during the implementation of the framework agreement.

Estimated value min./max. per frame agreement: VEmin = 48 297 714, 07 USD, VEmax = 124 035 802, 52 USD.

Estimated value min./max. per subsequent contract: VEmin = 6, 899, 673.44 USD, VEmax = 17, 719, 400.36 USD.

Request no. 1: Non-compliance with the situations stipulated in art. 177 of Law 99/2016; 2: Non-compliance with the situations stipulated in art. 178 and 180 of Law 99 / 2016.

Requirement no. 3: Non-compliance with the situations stipulated in art. 73 of Law 99/2016;

For the purposes of Article 76 (1) of Law 99/2016, EC prstipulates that the decision-makers within the contracting entity involved in the awarding procedure are: - - CRISTINA VERCHERE - Executive Director, Chairman of the Board, - - Stefan WALDNER - Financial Director and Member of the Executive Board, - - Radu Sorin CAPRAU - Member of the Directorate responsible for downstream oil activity,

- Ion ANGHEL - Director of the Upstream Services and Materials Management Department - Adriana VOICU - Purchasing Director and Petrom Governance.

Failure to comply with the-Requirements 1, 2 and 3 will be requested from both the Single Applicant and an association of each member of the association, the subcontractor and the supporting third party by completing Part III of the Part III: Exclusion Grounds, chap. A: Reasons for criminal convictions, chap. B: Reasons for paying taxes or social security contributions and head. C Reasons for insolvency, -conflict of interest or professional misconduct.

Mode of accomplishment:

The UAE will be presented by the economic operators participating in the award procedure, according to art. 202, par. (1) of Law 99/2016, completing the sections related to the above-mentioned requirements.

The supporting documents proving the fulfillment of the assumed by completing the DUAE, shall be submitted at the requestContracting entities only, by the candidates selected following the completion of the evaluation of the Application Forms.

The supporting documents may be:

1. certificates of absence of overdue debts regarding the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget, etc.) valid at the moment of their presentation; cazierul judiciary of the economic operator and of the members of the management, management or supervisory body of the respective economic operator, or of those who have the power of representation, decision or control within it, as it results from the certifying certificate issued by ONRC / the constitutive act, valid at the moment of their presentation; as the case may be, documents demonstrating itthat the economic operator may benefit from the derogations provided for in art. 179 par. (2), art. 180 par. (2), art. 184 of Law 99/2016 on sector acquisitions; other editing documents, as the case may be.

In order to demonstrate the capacity to practice the professional activity, the Contracting Entity requests the Applicant:

Oeconomic operators submitting a Request to Participate must prove a form of registration under the law of the country of residence, from which it appears that the economic operator is legally constituted, that he is not in any of the situations of cancellation of the constitution, as well as the fact that it has the professional capacity to perform the services covered by the largest Subsection Contractnt / Framework Agreement.

Way of accomplishment:

Requirement no. 1: The average annual turnover for the last 3 financial years (2015, 2016, 2017) should be at least $ 12, 000, 000. Adjustment formula:

Price / unit price adjustment of Products / Services will be negotiated based on the inflation rate published by the European Central Bank (www.ecb.europa.eu)-for the annual rate of consumer price inflation (percentage change in consumer prices from the same period of the previous year) as measured by the Harmonized Index of Consumer Prices (hereinafter "I (TO)" for the euro area and the countries of the region P (T1) = P (T0) x (1 C) where: P (T1) = Prices / Tariffs to be used in Subsequent Contracts to be signedafter adjustment

P (T0) = Prices / Rates used up to the adjustment time

C = Correction Factor (in percent), limited to the maximum ceiling of 5% and determined based on the following formula:

C = I 0.5, taking into account:

- the share of prices / tariffs not subject to adjustment (the fixed part): 50%

- the share of the prices / tariffs subject to the adjusted inflationher: 50%

I (T0) = the inflation index for the last 12 months

B. Adjustment procedure:

The party requesting the adjustment of the unit prices / tariffs of the products / services will submit to the other party a request to do so at least 15 (fifteen) business days before the adjustment date.

The request will contain: - - The official request for adjusting unit prices / tariffs-products / services,

- Extract containing relevant percentage changes reflecting applicable indices,

Pricing / unit adjusted product / service rates

The other party will approve the unit prices / unit prices of adjusted products / services if the adjustment Requested is justified.

The Contracting Entity communicates to all intin the submission of a request to participate in this procedure that they do not wish to apply a selection mechanism to Qualified Candidates.

Candidates will submit the requested documents in English or authorized translations from the English language language. In order to complete the DUAE, the following steps will be followed:

- after finalizing the DUAE will be exported both in xml format and in pdf format. They will be signed with the extended electronic signature,
