Cementing services for capital repairs to land and sea probes

At the start of this procedure, OMV Petrom estimates that, during a period of approximately 12 months during the implementation of the framework agreement, will issue a call for tenders for the award of Subsequent Contracts.

The estimated amounts of services under the Framework Agreement for Lot 5, namely the quantities of services that could is the subject of a single Subsequent Contract of those to be awarded, during the period of Aframe-frame, are:

Appraisal amounts of services related to the Framework Agreement: min. 205 / max. 450 probes

Estimated service quantities for a single Subsequent Contract: min. 41 / max. 69 wells

Estimated value min./max. per Frame Agreement: VEmin. = 965, 809.35 EUR, VEmax. = 2 120 069, 30 EUR.

Estimated value min./max. per Subsequent Contract: VEmin. = 193, 161.87 EUR, VEmax. = 325 077, 29 EURRequirement no. 1: Non-compliance with the situations stipulated in art. 177 of Law 99/2016; 2: Non-compliance with the situations stipulated in art. 178 and 180 of Law 99 / 2016.

Requirement no. 3: Non-compliance with the situations stipulated in art. 73 of Law 99/2016 • For the purposes of the provisions of Article 76 (1) of Law 99/2016, the EC states that the decision-makers of the contracting entity involvein the award procedure are:

- Stefan WALDNER - Financial Director and Member of the Board;

- Neil Anthony MORGAN - Member of the Board responsible for downstream oil business; Peter Rudolf ZEILINGER - Member of the Board responsible for Upstream activity; - - FRANCK ALBERT NEEL - MEmbassy of the Downstream Gas Directorate;

- Herbert HACKL - Financial Services Director;

- Ion ANGHEL - Director of the Upstream Services and Materials Demand Management Department - Adriana VOICU - Petrom's Acquisitions Manager and Governance.

Failure to comply with the foregoing Requirements 1, 2 and 3 will be applied to both the Single Offeror and an Aceto each member of the association, the subcontractor and the supporting third party by completing Part III of the DUAE: Exclusion Reasons, chap. A: Reasons for criminal convictions, chap. B: Reasons for paying taxes or social security contributions and head. C Reasons for insolvency, conflict of interest or professional misconduct.

Way of accomplishment: Pre-DUAE, on each lot, by the economic operators participating in the award procedure, according to art. 202, par. (1) of Law 99/2016, completing the sections related to the above-mentioned requirements.

The supporting documents, which prove the fulfillment of the assumed by completing the DUAE, shall be submitted at the request of the contracting entity, only by the tenderersthe first place after finalizing the bid evaluation.

The supporting documents can be:

1. certificates of absence of overdue debts regarding the payment of taxes, taxes or contributions to the consolidated general budget (local budget, state budget, etc.). They will only appear for social offices for which payment obligations exist. From these documents it must be clear that cthe bidder has no overdue debts at the moment of their presentation; the criminal record of the economic operator and the members of the management, management or supervisory body of that economic operator or of those having the power of representation, decision or control within that operator, as evidenced by the certifying certificate issued by ONRC / constitutive act, valaballs at the time of their presentation; as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided for in art. 179 par. (2), art. 180 par. (2), art. 184 of Law 99/2016 on sector acquisitions; other editing documents, as the case may be.

Economic operators submitting a tender must prove a form of registration under the law of the country of residence from which it appears that the economic operator is legally constituted, is not in any of the situations of cancellation of the establishment and the fact that it has the professional capacity to achievethe services subject to the largest Subsequent Contract / Framework Agreement.

Mode of performance: To be presented by the economic operators participating in the award procedure, according to art. 202, par. (1) of Law 99/2016, completing the sections related to the above requested requirements, namely the Part ... details on www.e-licitatie.ro

Requirement no. 1: Turnover average yearbut for the last three financial years (2015, 2016 and 2017) to be at least for each lot: Lot 1: minimum EUR 1, 300, 000 (VAT excluded) Lot 2: minimum EUR 3, 000, 000 (VAT excluded) Lot 3: minimum EUR 5, 000, 000 (VAT excluded) Lot 4: minimum EUR 1, 500, 000 (VAT excluded) Lot 5: minimum EUR 300, 000 (excluding VAT)

The entire doc. the award is available in SEAP. To view doc. attributable to the SEAP, op. ec. must have installed a program required to view the electronically signed files, this program being available on the websites of the electronic signature providers.

Economic operators who download this doc. directly attributable to the attachment to the SEAP published notice, have the obligation to follow in SEAP attachment of the various communications made by-EC following requests for clarification requested by some potential bidders.

To the extent that requests for clarification or info. Extras. were submitted within the deadline set out in the tender notice, respectively 19 days before the deadline for the submission of tenders, the EC will respond clearly and fully to all clarification requests or additional informationin the 25th and the 10th day before the deadline set in the tender announcement, according to the provisions of art. 172 of L99 / 2016. EC will only respond to requests for clarifications addressed by economic operators by the deadline, according to the provisions of art. 29, par. 3) of GD 394 / 2016.

Requests for clarification regarding the Awarding Documentation fromthe interested economic operators, and implicitly the corresponding responses from the Contracting Entity, will be transmitted exclusively through SEAP.

The DUAE will be presented in xml format. In order to complete the DUAE, the following steps will be followed:

- The document attached in the section "Documentation, clarifications and decisions" will be uploaded to the following link: https://ec.europa.eu/tools/espd and completedfor the sections requested above,

- after finalization the DUAE will be exported both in xml format and in pdf format. These will be signed with the extended electronic signature,

- DUAE in pdf format. will also be signed by a legal representative of the economic operator.

The unit prices mentioned in the Financial Proposal will be subject to adjustment / revision based on the following mechanism:

A. Adjustment formula:

Adjusting the unit prices of services, equipment, materials will be based on the consumer price inflation rate (changethe percentage of consumer prices since the same period last year) published by the ECB (www.ecb.europa.eu), as measured by the Harmonized Index of Consumer Prices (hereinafter I (T0)) for the Eurozone (T1) = P (T0) x (100% C)

Where:

P (T1) = The new unit prices in the Framework Agreement to be used as the basis for Subs contractsEquivalents to be signed after the adjustment

P (T0) = Unit prices of the Frame Agreement used up to the adjustment time

C = Correction Factor (in percent), limited to the maximum ceiling of 5% from the previous value and determined on the basis of the following formula:

C = I (T0) x 60%, taking into account:

- the share of unit prices not subject to adjustment (fixed part): 40%unit prices subject to inflation adjustment: 60%

I (T0) = Harmonized Index of Consumer Prices for the last 12 months

B. Adjustment procedure:

The party requesting the unit price adjustment from the CA will transmit to the other Party a request for this at least 30 working days before the adjustment date that will contain: • The official request for adjustment ofunitary prices in the Framework Agreement

• Extract containing relevant percentage changes reflecting the applicable indices

• Adjusted unit price proposal
