" Reconstruction of ecolThe tenderers, the supporting third parties and the subcontractors must not find themselves in the situations stipulated in Articles 164, 165, 167 of the Law No. 98 / 2016. The way in which the fulfillment of the requirement can be demonstrated: the DUAE will be filled by the economic operatorsto the award procedure, with information related to their situation. The supporting documents proving the fulfillment of the undertaken by completing the DUAE shall be submitted, at the request of the contracting authority, only by the bidder ranked first after applying the award criterion. These documents may be:

1) self-responsibility statements on non-compliance in sthe provisions of art. 164, 165 and 167 of Law no. (2) certified statements regarding the lack of debts, regarding the payment of taxes, duties or contributions to the consolidated general budget (local budget, state budget, etc.) at the moment of submission, 3) the criminal record of the economic operator and members of the management, management or supervisory body of the management bodythe economic operator or those who have the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act; 4) as the case may be, documents demonstrating that the economic operator can benefit from the derogations provided in art. 166 par. Documents shall be submitted in original or copy according to the original. For foreign tenderers, an equivalent document issued by the competent body of the country of origin shall be required, in original or a copy of the original, accompanied by the certified translation. The economic operators submitting the tender must prove a form of registration under the law of the country of residence, it should appear that the economic operator is legally constituted, that he is not in any of the situations of cancellation of the establishment, as well the fact that it has the professional capacity to perform the activities covered by the contract.
