Servers for Territorial Statistics Departments and organizational structures of INS Central Office with the following components:

Specialists of the Department of Budget and Accounting of I.N.S. have substantiated the opportunity to purchase a Microsoft SQL Server 2016 Standard Edition database server, on the basis of the storage of financial information, staff data and information on the institution's budgets. placeexclusions provided for in Art. 59, 60, 164, 165 and 167 of Law no. 98/2016 on public procurement.

The contracting authority shall exclude from the procedure for the award of the public procurement contract any economic operator with regard to which it has determined, after analyzing the information and the documents it presents, one or another of the expprovided in the provisions of art. 59, 60 (conflict of interests), as in the provisions of art. 164, 165, 167 of Law no. 98/2016 on Public Procurement.

Note: It must not be found in the situations provided for in art. 59, 60 (conflict of interests), art. 164, 165 and 167 of Law no. 98/2016: the tenderer, the member / members of the association, the subcontractor / subcontractors, the third party / third party(i).

In accordance with the provisions of Art. 59, 60 of Law no. 98/2016 and on the basis of the provisions of art. 21 par. (5) of GD no. 395/2016 for the approval of the Methodological Norms for the application of the provisions regarding the award of the public procurement contract / the framework agreement of Law no. 98/2016 on public procurement, decision-makers from the National Institute of Statistica, respectively all persons who approve / sign documents issued in connection with or for organizing, running and finalizing the open online bidding process related to the acquisition of servers for the Territorial Statistical Divisions and organizational structures of the INS Central Office, having the following components: Lot 1 - Servers for Statist Territorial Directoratesica,

The way of demonstrating the fulfillment of the requirement: the economic operators participating in the awarding procedure will complete and provide, in electronic form and .pdf, the DUAE form Single European Procurement Document) with information related to their situation, accessible online at: https: //ec.europa.eu/growth/tools-databases/espd/filter/./ The DUAE Form will be separately filled out and provided by the bidder / associates / subcontractors / third party supporters.

The supporting document proving the fulfillment of the bidder's requirement by filling in the average of the global turnover for the last 3 years (2015, 2016, 2017). To dothe tenderer shall demonstrate the achievement of an average of the total turnover, on the lot 1 and / or on lot 2 and / or on lot 3 of the present public procurement procedure, on the the last three years (2015, 2016, 2017), by reference to the estimated value of each batch, according to art. 180 par. (1) of the Law no. 98/2016 on aat least equal to the following amount:

- lot 1 - RON 2, 992, 469.00 (150% of the estimated value of the contract, on lot 1,

- lot 2 - 157, 500.00 RON (150% of the estimated value of the contract, on lot 2, - lot 3 - RON 162, 000.00 (150% of the estimated value of the contract, on lot 3.

Note:

(a) Where an offer is submitted by economic operators participate incommon to the awarding procedure, each of them must demonstrate the fulfillment of a level of the average global turnover requirement for the last 3 years, proportional to the share of involvement in the execution of the future contract, according to art. 54 par. (3) of the Law no. 98/2016 on Public Procurement and Art. 31 par. (3) of GD no. 395/2016, (b) To the extent that the information is notnt available for the entire period, the date on which the economic operator was established or started its activity will be considered.

Commitment regarding the financial support of the tenderer / group of economic operators for the whole lot and / or Lot 2 / Lot 3, if applicable (Form No. 5). Meeting the requirement of the economic situation and beingnanciara can be proved by the economic operator / economic operators participating in the award procedure by invoking the support granted by a third party / third party, in accordance with the provisions of art. 182 par. (1) of the Law no. 98/2016. In this situation, the economic operator has the obligation to prove to the contracting authority that he has taken all the necessary measures to have access, into the necessary resources, presenting a firm support from the third party / third party, confirming that he or she will / will make available to the bidder the resources invoked for the performance of the contract. :

1) The engagement must be expressed in writing, explicitly and unconditionally, specifying, unequivocally, the requirement by which-the third party understands / the third party understand the support and the concrete way of granting the support, according to the law; 2) The firm commitment presented by the bidder must state the resources that are being sustained and show that their redundancy will be realize unconditionally, depending on the needs that arise during the fulfillment of the contract(3) If appropriate, the contracting authority shall, at any time during the assessment process, request the supporting third party (s), documents and additional information in relation to the engagement given or with the the documents submitted, if there are reservations about the correctness of the information or about the possibility(a) The third party / third party providing the economic and financial support must not be in any of the situations that lead to the exclusion from the award procedure,

(b) The contracting authority shall: verifies whether the third party / third party that assures support in meeting the criteria for locationeconomic and financial, fulfills / meets the criteria or does not fall within the grounds for exclusion provided in art. 164, 165 and 167 of Law no. 98/2016 on Public Procurement, (c) If the third party / third party does not meet / meet the relevant capacity criteria or falls within one of the grounds for exclusion provided in Art. 164, 165 and 167, the contracting authorityto require the economic operator to replace the supporting third party / supporter, once, without prejudice to the principle of equal treatment provided in art. 2 par. (2) lit. b) of Law no. 98/2016 on Public Procurement, (d) Where an economic operator demonstrates that the criteria relating to the economic and financial situation have been fulfilled by invoking(a) Information on the European Unique Acquisition Document (DUAE) and how to complete / complete the public procurement contract, submission by the tenderers for the initial demonstration of the fulfillment of the qualification requirements stipulated in:

1) Confrom the provisions of art. 193 of Law no. 98/2016 on public procurement, the contracting authority accepts, at the time of submitting the tender, the DUAE form, consisting of a statement on its own responsibility, as a preliminary proof regarding the fulfillment of the qualification requirements, Exercise; 2) The Contracting Authority Generates Electronic DUAE, complwith the information requested in relation to the qualification criteria established by the awarding documentation, marking the fields in the form for which the economic operators will submit the references and attach, in SEAP, the DUAE signed electronically, together with the other documents of the purchaser; and submission by economic operators, the DUAE can be downloaded from withinhttps://ec.europa.eu/growth/toolsdatabases/espd/filter/. Instructions on the completion of the DUAE are available at www.e-licitatie.ro; 4) When completing the DUAE, economic operators are not allowed to intervene on the format of the document in question on the requirements checked by the contracting authority, 5) DUAE will be submitted, by the economic operators and, as the case may be, by the assistantthird party supporters both in .xml format and in scanned PDF format, both electronically signed, for the security of a correct viewing and interpretation of the information; 6) According to art. 196 par. (1) of the Law no. 98/2016 on public procurement, the contracting authority may require tenderers to file all or part of the supporting documents as proof ofuprinse in the DUAE at any time during the course of an award procedure if necessary to ensure the proper conduct of the procedure; 7) Before awarding the contract, the contracting authority shall request the tenderer with the admissible tender ranked first, after application of the award criterion, present updated supporting documents, cis required to demonstrate the fulfillment of all the qualification criteria, according to the information contained in the DUAE (and in the tender documentation).

B) Regarding the awarding of public procurement contracts, the economic operators will be able to participate in the procedure by submitting offers for minimum 1 (one) lot and for maximum 3 (three) lots.

C) Information on the associationif applicable, lot 1 / lot 2 / lot 3: the tenderer, represented by a group of economic operators, will fill in and provide, exclusively in electronic format, the DUAE (Single European Procurement Document) form on the website : https://ec.europa.eu/growth/tools-databases/espd/filter. If the bid of the economic operators joint participants in the award procedure has been ranked-on the first place, in the interim ranking made at the completion of the evaluation of the tenders, at the request of the contracting authority, the tenderer represented by a group of economic operators will fill in and sign with the associate (or its associates) and sign an association agreement, in accordance with model no. 4 in the "Forms Patterns" section, possibly along with other eve(d) Legal form to be taken by the group of economic operators to whom the contract has been awarded: the contracting authority reserves the right to request the legalization of the joint venture if the joint tender is declared a winner.
