Framework agreement for the provision of various security software packages

Concluding a supply framework agreement with a single economic operator, in order to purchase "Various security software packages" broken down into 2 lots., lot 1 "Email security gateway" and lot 2 "Software for the detection of network vulnerabilities".

Main Site: Str. Source no. 110, sector 5, Bucharest.

Lot no. 1. Email security gateway according to the specifications in the specification for the reference associated with this lot. 1 mandatory requirement for the presentation of the following documents: economic operators, subcontractors, associations and third-party supporters do notmust be found in the situations provided in art. 164, 165 and 167 of Law no. 98/2016, as subsequently amended and supplemented. The way in which the requirement can be demonstrated: the D.U.A.E. by the economic operators participating in the award procedure with the information related to their situation. The supporting documents proving the fulfillment of the oneshumble by completing the D.U.A.E. shall be presented, at the request of the contracting authority, only by the tenderer ranked first in the intermediate ranking drawn up at the end of the evaluation of the tenders. The documents will be translated into Romanian by a certified translator, according to the law in force. These documents can be:

1) the criminal record of the economic operator and the memberof the administrative, management or supervisory body of the respective economic operator or of those who have power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive document;

2) as the case may be, documents proving that the economic operator can benefit from the derogations provided in art. 166par. (2), art. 167 para. (2) and art. 171 of Law no. 98/2016 regarding the public procurement, with the subsequent modifications and completions;

3) other edifying documents, as the case may be.

Given that these documents will be requested from the bidder ranked first, they will be valid at the time of presentation. documents lead to the exclusion of the tenderer from the procedure.

Cerincase no. 2 mandatory requirement for the presentation of the following document: declaration regarding the non-classification in the situation provided in art. 59-63, respectively art. 167 para. (1) lit. e) of Law 98/2016 with subsequent amendments and completions, regarding the rules for avoiding the conflict of interests.
