Subject of Orders covers physical protection of persons and property, as well as fire protection, implemented in form:

Subject of Orders includes physical protection of persons andproperty, as well as fire protection, implemented in the form of: a) direct physical protection (the sum of hours in which the service will be provided will be 85, 300 (/ - 2%)) in accordance with the Act on the Protection of Persons and Property and relevant executive acts to Act,

b) control of facilities by intervention patrols (the sum of driveways, implemented as part of the service, will amount to 21, 900 (/ - 5%)),

c) fire protection (the sum of hours in which the service will be carried out, will be 17, 550 (/ - 2%)) within the meaning of the Fire Protection Act and the Act amending laws regulating the conditions of access to certain occupations with physical protection and details.

Detailed information and requirements regarding the subject of the order are included in the Description of the Subject of the Order (OPZ) constituting Annex No. 1 to the ToR with attachments No. 1-6 to OPZ. - Ad documents and statements (4)

Parts of the order, to demonstrate the absence of grounds for exclusion from participation in the proceedings submitted subcontractor statements (consistent with the Annex No. 3 to the ToR)

In the note if it is authorized to place offers on behalf of the Contractor during the electronic auctionand a person other than the person signing the offer, the offer shall be accompanied by a power of attorney (original) for that person, which will result in the right to represent the Economic Operator in the electronic auction and submit bids in the course. The manner in which the offer is prepared is set out in Chapter XIII SIWZ. - Criteria for offer evaluation: The gross price of the offer is the sum-multiplying of the gross unit price per hour of the order by the fire protection employee together with the protection of persons and property and the number of hours in which the Subject of the Order will be carried out by the fire protection officerwith the protection of persons and property during the term of the Agreement, and the product of the unit gross price of the object of the order by the employee of physical protection of persons and property and the number of hours during which the Subject of the Order will be performed by the employee of physical protection of persons and property during the Agreement, and the product of the unit gross price of a one-off drivewayat the intervention patrol for the controlled area specified by the ordering party in the SIWZ and the number of ramps implemented under the Subject of the Order by the intervention patrol during the Contract weight of 90% - Number of personal services and property carried out 10% - detailed description of the scores in adopted the criteria are set out in SIWZ.

Time of binding the offer: Performthe offer will be bound by the offer for a period of 60 days. The bid validity period begins with the expiration of the deadline for submitting bids.

Information on the qualifications of contractors, evaluation and examination of offers is specified in ch. XVII SIWZ.

Contractor, kt. the offer will be selected, it will be obligatory to sign a contract for entrusting the processing of data to persons before the signing of the Contract for the award of a public contract.the model is attached to item 8 of the ToR.

The ordering party provides for the possibility of ordering, o. referred to in Article 134 of 6 point 3 of the Public Procurement Law. The scope of these orders will not exceed 50% of the value of the basic order. The information is described in chapter IV, paragraph 3 of the ToR.

The contractor may entrust the execution of a subcontractor's part of the order. In this case, they apply. regulations of art. 36b and art. 36ba of the Pzp. Act. Zamathe party reserves the obligation of the Contractor to perform the following work as part of the order:

a) direct physical protection, performed by one-man patrols in the premises administered by ZTM,

b) driveways of intervention patrols for facilities administered by ZTM,

c) fire protection carried out on the Młociny Communication Center (WKM)

Ad conditionsand (2):

2. The Contracting Authority may, at any stage of progress, consider that the Contractor does not have the required capacities if the involvement of technical resources or occupations. Contractors in other enterprises Contractor may have a negative impact on the implementation of the order.

3. The contractor may confirm the fulfillment of the conditions for participation in the progress, where appropriate and in relation to theorders, or parts thereof, rely on the ability of techn. or profession. financial situation or economics of other entities, regardless of the legal nature of its legal relations.

4. In the case of the Contractor, on the resources of another entity:

1) Contractor, kt. relies on the abilities or situation of other entities, he must prove to the Ordering Party that he will have dispositions when performing the orderthe necessary resources of these entities, in particular by presenting the obligation of these entities to give him the necessary resources for the needs of order fulfillment.

2) The Ordering Party will assess whether or not the technical ability or profession made available to the Contractor by other entities. they allow the Contractor to demonstrate compliance with the conditions of post participation and will investigate whether they are not subject to this entity afterexclusion clauses referred to in Article 24 (1) with exclusion in Article 24 paragraph 1 point 13 letter d of the Public Procurement Law, and in the footnote, o referred to in Article 24 (1) (14) of the Public Procurement Law, if a person for whom the speech in this provision was convicted of an offense. in Article 24 para. 1 point 13 of the Public Procurement Law and paragraph 5 point 18 of the Public Procurement Law - 3) In reference to the conditions regarding education, professional qualifications or experience, the Contractormay rely on the capabilities of other entities, if these entities provide services, to execute kt these abilities are required.

5. Submission by the contractors of the offer of documents and statements by in chapter X of the SIWZ will be the basis for the assessment of compliance with the conditions for participation in post. and no grounds for exclusion from post.

6. In the case of contractors jointly applying for the order, forthe provisions of art. 23, Art. 25a para. 6 and art. 141 of the Public Procurement Law

7. The contractor, kt. subject to exclusion based on Article 24, paragraph 16-20, or paragraph 5 of the PPL, may provide evidence that the measures taken by him are sufficient to demonstrate its reliability, in particular to prove the remedy for damage caused by an offense or fiscal offense, financial compensation forknown harm or repair of damage, comprehensive explanation of the facts and cooperation with law enforcement agencies and taking specific technical measures, organize. and personnel, kt they are suitable for the prevention of further offenses or fiscal offenses or incorrect progress. contractor. The provision of the first sentence shall not apply if the contractor is a collective entityhas been banned from applying for a contract and the period of validity of the ban has not expired.

8. The Contractor is not subject to exclusion, if the ordering party, considering the weight and special circumstances of the contractor's action, deems sufficient evidence presented above in point 7

9. The contract for the excluded contractor is considered rejected.

Appendix noThe Employer foresees the exclusion of the Contractor, if the premises specified in art. 24 sec. 5 points 1 and 8 of the Public Procurement Law. To demonstrate compliance by the contractor with the conditions of participation in post. the orderer demands the following declarations and documents:

1) statement on the fulfillment of the conditions for participation in post;

2) a concession issued by the ministry responsible for internal affairs, in scopee personal and property protection services carried out in the form of direct physical protection in accordance with the Act on the Protection of Person and Property, - 3) list of services performed, and periodic or continuous statements also performed, within the last 3 years before the deadline for submission of tenders, and if the period of conducting business is shorter in this period and evidence confirming due performanceusing these services
