Lot 1: School furniture type: school chair (340 pieces) chair (8 pieces), ergonomic chair (8 pieces), wardrobe 2 doors (16 pieces), hanger (16 pieces), table with 1 drawer (6 pieces), whiteboard (9 pieces)-the Timisoara Municipality shall exclude at any time the procedure for the award of supply contracts any economic operator who is in one of the situations stipulated in art. 60, 164, 165 and 167 of Public Procurement Law 98/2016.

Exclusion reasons will also be applied to Associates / subcontractors / third-party supporters after(the tenderer, the associated tenderer, the subcontractor, the third party, as the case may be), will present with the offer and the DUAE completed in accordance with the provisions art. 193 of Law 98/2016, with information related to their situation.

Will be presented:

(a) Stateon non-compliance in situations potentially generating conflict of interests, as defined in art. 60 of Law no. 98/2016 by all participants in the procedure, (b) and, if appropriate, the firm's firm commitment of the supporting party accompanied by documents showing the effective manner in which its support, subcontracting and / or association agreement will materialize.The supporting documents proving the fulfillment of the undertaken by completing the DUAE are to be submitted, only at the request of the contracting authority, to the first bidder after the application of the award criterion on the admissible tenders.

The supporting documents may be:

1) certificates regarding the lack of debts with regarding the payment of taxes, taxes or concessions(2) the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the economic operator or of those having the power to act in the general budget (local budget, state budget, etc.); representation, decision or control within it, as evidenced by the certifying certificate issued byONRC / constitutive act; 3) as the case may be, documents proving that the economic operator may benefit from the derogations provided in art. 166 par. 1) Within the documents attached to the SEAP published in the SEAP, DUAE is made available to economic operators interested in editable format in order to complete it by the bidders. Participating economic operators will fill in this document-the information / responses related to the inclusion / non-compliance in the grounds of exclusion, respectively the fulfillment of the qualification criteria requested by the contracting authority that have correspondent at the level of the participation announcement / data sheet instructions for tenderers (where they are clearly stated) and will not have the right to intervene on the DUAE format, respectively on im requirements(2) For viewing the attached documents, the economic operators must have a necessary program to view the electronically signed files;

3) Economic operators have the right to submit the tender for each batch submitted (DUAE completed, the declaration of non-compliance with the provisions Article 60 of Law No 98/2016, the technical proposal, the financial proposala) the supporting document on the establishment of the participation guarantee and, if applicable, the support of the third party, the association agreements and / or subcontracting agreements), only in electronic format signed with the extended electronic signature, 4) requests for clarification regarding this awarding documentation will be addressed exclusively in SEAP under the-awarding by electronic means, the contracting authority will not respond to requests addressed by means of communication other than the established one. Any interested economic operator has the right to request clarifications or additional information in relation to the awarding documentation, in compliance with the deadline specified by the contracting authority in Section II.1.4) of this document, not later than 15 days before the deadline set for the submission of tenders. Clarifications submitted after this deadline will no longer be taken into account. According to art. 160 161 of Law 98/2016, the contracting authority will respond clearly and completely to all clarification requests / additional information on the 11th day before the term limitate set for submitting bids, to the extent that they will be addressed within the deadline specified in the tender notice. The answers to the required clarifications will be published in the SEAP within the tender notice; 5) If the contracting authority requests the submission of certain clarifications / completions for the purpose of checking the conformity of the offer with the required requirements, atBoth the request and the bidder's response are transmitted in SEAP only in electronic format, signed with the extended electronic signature. If the bidder's response is posted in SEAP without the extended electronic signature, its offer will be assimilated to the provisions of Art. 137 par. (2) lit. j) of GD 395/2016, being rejected as unacceptable; 6) If, following application of the award criterion-"Lowest price" means that two or more first-ranked offers have equal prices, will be required to recharge through SEAP.
