Passenger air transport services, by purchasing air tickets required for passenger / props (luggage) transportation, of participants in international and national art festivals and tournaments. The framework agreement will be concluded with a maximum of 999 opeconomic errors, and subsequently subsequent contracts with the observance of the elements / conditions provided in the framework agreement, by resuming the competition between all the economic operators who have signed the framework agreement. Quantities that could be subject to a.c. min .: 600 tickets, max .: 2, 000 tickets, and of a single subsequent contract min: 1 ticket, max: 800 tickets, up to 600, 000 RON. They will endtakes subsequent contracts: minimum 5-maximum 100 contracts, with quarterly or monthly frequency, depending on the artistic groups participating in artistic shows.

A. The economic operators who submit the offer together with the third-party supporters, the subcontractors nominated by the tenderer must prove a form of registration according to the law in the country of residence to show that the economic operator is legally constituted, that it is not in any of the situations of cancellation of the constitution as and the fact that it has the capacityprofessional to carry out the activities that are the subject of the contract. The bidders, the third-party supporters and the subcontractors must not find themselves in the situations provided in art. 164, 165, 167 of Law no. 98 / 2016. The supporting documents proving the fulfillment of those assumed by completing the DUAE will be presented, at the request of the AC, only by the tenderer ranked on the first place in the claoath after applying the award criterion

These documents can be:

1) fiscal certificates regarding the lack of outstanding debts regarding the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget, etc.) at the time of presentation;

2) the criminal record of the economic operator and the criminal record of the members of the management, management bodyor supervision of the respective economic operator or of those with power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive document;

3) (if applicable) documents through which demonstrates that the economic operator can benefit from the derogations provided in art. 166 para. (2), art. 167 para. (2), art. 171 ofLaw 98/2016 on public procurement;

4) other edifying documents, as the case may be.

Respecting the rules for avoiding the conflict of interests, in accordance with the provisions of art. 59-62 of Law 98 / 2016.

The declaration regarding the avoidance of the conflict of interests will be presented by all participants, once the DUAE has been filed.

Foreign legal entities will submit with the document and translationis authorized notary in Romanian. The respective document must be presented both by the bidder / leader, as well as by associates, subcontractors and / or third parties, as the case may be;

B. The observance of the rules for avoiding the conflict of interests, in accordance with the provisions of art. 59-62 of Law 98/2016. The declaration regarding the avoidance of the conflict of interests will be presented by all participants, othe date of the DUAE filing. The persons holding decision-making functions within the authority regarding the conduct and completion of the award procedure within the meaning of the mentioned article are: Chiriac Constantin, legal representative; members: Albu M. Irina, Rahău Vicentiu, Muntiu I. Simona, Drăgan Adriana and involved in the Giurculete I. Sorin procedure.

The contracting entity has the obligation to respectLaw no. 184/2016 regarding the establishment of a mechanism for preventing the conflict of interest in the procedure for awarding public procurement contracts. the country of residence, it turns out that the economic operator is the linkconstituted, that it is not in any of the situations of cancellation of the constitution as well as the fact that it has the professional capacity to carry out the activities that are the subject of the contract.

1) The bidder has the obligation to complete the DUAE with the offer, under the sanction of rejecting the latter as unacceptable according to art. 137 para. (2) lit. b) from H.G. no. 395/2016. In turn, the third-party supporters and subcontractors known at the time of submission of the offer have the obligation to complete the DUAE separately according to the provisions of art. 193 of Law 98/2016;

2) The analysis of the documents presented by the bidders by the evaluation commission does not undertake any responsibility or obligation on their part to accept them as authentic or legal and does not remove the exclusive responsibility of the bidder in this respect. The contracting authority is subordinated to the Local Council of the City Hall of Sibiu [art. 7 paragraph (1) lit. c) of the Law98/2016, updated] and reserves the right to derogate from the contractual provisions until termination, reasonably, exceptionally and without other contractual stipulations, according to the transfers of the main authorizing officer of credits (as secondary credit authorizing officer, within the limit of liability conf. art. 22 of Law 500/2002);
