1) The economic operator (leader, associate, third party supporter, subcontractor) must not be found in the situations provided in art. 164, 165 and 167 of Law no. 98 / 2016.

In order to fulfill the requirement, the DUAE will be completed by the economic operators with the information related to their situation.re will present them at the request of the contracting authority, in order to prove the non-inclusion in the exclusion situations provided in art. 164, 165 and 167 of Law 98/2016, will be the following:

- Certificates confirming the lack of outstanding debts regarding the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget, etc.) at the present timearias,

- the criminal record of the economic operator and of the members of the administration, management or supervision body of the respective economic operator or of those who have the power of representation, decision or control within it, as it results from the certifying certificate issued of ONRC / the constitutive act,

- as the case may be, documents proving that the eco operatornomic can benefit from the derogations provided in art. 166 para. (2), art. 167 para. (2), art. 171 of Law 98/2016,

- other edifying documents, as the case may be;

2) The economic operator (leader, associate, third party supporter, subcontractor) must comply with the rules for avoiding the conflict of interests provided for in art. 59-60 of Law no. 98/2016. A statement will be presented, together with the DUAEie liability for non-compliance with the provisions of art. 60 of Law no. 98/2016. The bidder must prove a form of registration under the law of the resident country, from which it can be seen that it is legally constituted, that it is not in any of the situations of cancellation of the constitution, and that it has the professional capacity to perform the activities that are the subject of the contract. In this sense, the bidder will complete DUAE with site related informationhis forgetfulness. The supporting documents proving the fulfillment of those assumed by completing the DUAE and mentioned below will be presented, at the request of the contracting authority, only by the bidder ranked on the first place in the intermediate ranking drawn up at the end of the evaluation of the offers: the certifying certificate issued by the Trade Register Office on near the Ministryl To the justice from which to identify identification information, the registered office, administrators, fields of activity, the duration of the company, associates, share capital, working points. The certifying certificate must contain actual / actual data at the date of presentation. Specify the average annual turnover. Its annual average turnover for the number of years required in the relevant announcement, in the procurement documents or in the DUAE, is as follows: the average of the overall turnover of the tenderer for the last 3 years (2016, 2017, 2018) shall be at least equal with the amount of: 2 500 000 RON. For the fulfillment of this requirement, tendererthe beneficiary can benefit from a firm commitment by another person according to art. 182 of Law no. 98/2016 and of art. 48 of the GD no. 395/2016. The reference rate that will be considered for calculating the equivalence for the contracts whose value is expressed in another currency than RON is the average annual rate RON / currency communicated by the NBR for each year separately. The operator savesc has the right to invoke the support of a third party in respect of the fulfillment of the turnover requirement. In this case, with the support commitment, the bidder / candidate has the obligation to submit documents transmitted to it by the third party (s), from which the effective way by which the third party (s) will support / will ensureinitiating its own commitment to support, documents that will be annexed to the respective commitment art. 182 of Law no. 98/2016 regarding public procurement.

Note: in case the tenderer was established or started its economic activity less than 3 years ago, it will be considered the presentation of the information corresponding to the effective period of activity. For calculationl for the price of the contract expressed in a currency other than RON, the average rate communicated by the National Bank of Romania for the last 3 years will be used. The RON rate / other currency to be taken into account for 2018 is the rate set by the NBR on the date of publication of the participation notice for the present procedure.

Designation of the winning bid: the final score of the offer will be established by calculating the sum of the scores related to each evaluation factor, calculated according to the calculation algorithm.previous state. The offer with the highest final score will be considered the winning bid.

Sorting of offers: if it is found that the eligible offers ranked first have equal prices, the authority will request clarifications through SEAP, in order to electronically upload to the economic operators of documents containing new prices. Econo operatorssmall are entitled to improve the previously offered price, following that the offer containing the new lowest price will be declared a winner.
