The subject of the contract is to provide a replacement bus service in the area of trains running by Koleje Małopolskie Sp. z o.o.

The subject of the contract is a servicereplacement bus service in the area of trains running by Koleje Małopolskie sp.z o.o. in relations:

Krakow Głowny Wieliczka Rynek-Kopalnia,

Krakow Głowny Krakow Airport,

Krakow Głowny Podłęże / Kłaj Tarnow,

The Purchaser also informs that the service may also apply to smaller fragments of the indicated relations (e.g. Krakow Głowny Słomniki, Krakow Głowny Krakow Bieżanow). Examples of routes are included in Annex 1 to the Framework Agreement.

Contractors who meet the conditions for competence or entitlements to conduct specific professional activities may apply for the contract. The contracting authority will consider that the contractor meets the abovementioned condition if it is demonstrated by having a valid and valid permit to practice the profession of road transport operatorego or a valid and valid license to perform national road transport - issued on the basis of the Act of 6 September 2001 on road transport. In the case of foreign contractors, the Employer will consider that the contractor meets the abovementioned a condition if it is demonstrated by having appropriate documents issued in the country in which they have their registered office or place of residence and which entitle themthem to perform road transport on the territory of Poland, on the terms set out in the Act of 6 September 2001 on road transport.

Contractors may participate in the proceedings for which there are no grounds for exclusion from the procedure pursuant to art. 24 paragraph 1 points 12-23, art. 24 paragraph 5 item 1 of the Public Procurement Law Act,

Documents and statements required from the Contractor on the proofroots of no grounds for exclusion:

1) information from the National Criminal Record in the scope specified in art. 24 paragraph 1 point 13, 14, 21 of the Act, issued not earlier than 6 months before the deadline for submission of tenders,

2) the Contractor`s statement to the extent specified in art. 24 paragraph 1 point 15 of the Act on the lack of a final court judgment or final administrative decision on arrearswith the payment of taxes, fees or social security or health insurance premiums or in the event of the issuance of such a judgment or a decision of documents confirming the payment of these receivables together with any interest or fines or the conclusion of a binding agreement on the repayment of these receivables,

3) the Contractor`s statement regarding specified in art. 24 paragraph 1 point 22 of the Actabout the lack of a ruling against him as a preventive measure forbidding public procurement,

4) a certificate from the competent head of the tax office confirming that the Contractor is not in arrears with payment of taxes issued not earlier than 3 months before the deadline for submitting bids or another confirmation document, that the Contractor has entered into an agreement with the competent authoritytax on the repayment of these receivables together with any interest or fines, in particular, he obtained the exemption provided for by law, deferment or distribution in installments of overdue payments or withholding in full the execution of the decision of the competent authority (Article 24 (5) (8) of the Public Procurement Law),

5) certificate of the relevant organizational unit of the Social Insurance Institution or the Cash RegisterRolniczego Ubezpieczenia Społecznego (Agricultural Social Insurance) or other document confirming that the Contractor is not in arrears with payment of social security or health insurance contributions, issued not earlier than 3 months before the deadline for submission of tenders, or another document confirming that the Contractor has entered into an agreement with the competent authority on the repayment of these receivables together with any interest, lor by fines, in particular, obtained by law exemption, deferment or installment of overdue payments or suspension of the entire implementation of the decision of the competent authority,

6) excerpt from the relevant register or central register and information on economic activity, if separate provisions require an entry in the register or records to confirm that there are no grounds for exclusion onbased on art. 24 paragraph 5 point 1 of the Act,

7) a statement on belonging or not belonging to the same capital group; in the case of belonging to the same capital group, the Contractor may submit, together with a declaration, documents or information confirming that links with another Contractor do not lead to distortion of competition in the proceedings

The contract may be applied forContractors who meet the conditions relating to the economic or financial situation. The contracting authority will consider that the contractor meets the abovementioned a condition if it is demonstrated by possessing current civil liability insurance in the scope of conducted activity connected with the subject of the order for an insurance sum for task 1 in the amount of PLN 100, 000.00 (in words: one hundred thousand zlotys 00/100); for the job2 in the amount of PLN 1, 000, 000.00 (in words: one million zlotys 00/100); for task 3 in the amount of PLN 70, 000.00 (say: seventy thousand zlotys 00/100).

1 If the contractor has its registered office or place of residence outside the territory of the Republic of Poland, instead of the documents referred to:

1) in Chapter VIII para. 8 point 1 of the Terms of Reference submits information from the relevant register or, in the absence of such a regester, another equivalent document issued by the competent judicial or administrative authority of the country in which the contractor has its registered office or place of residence or place of residence, the person to whom the information or document relates, to the extent specified in art. 24 paragraph 1 point 13, 14 and 21;

2) in Chapter VIII, para. 8 points 4, 5 and 6 of the Terms of Reference submits a document or documents issued in the country in which the contractor has pResidence or place of residence, confirming accordingly that:

a) he is not in arrears with taxes, fees, social security or health insurance contributions, or that he has entered into an agreement with the competent authority regarding the repayment of these claims together with any interest or fines, in particular he has obtained exemption, deferral or installment of overdue payments provided for by law or inmaintaining in full the execution of the decision of the competent authority,

b) its liquidation has not been opened or bankruptcy has been announced.

2. The documents referred to in Chapter VIII para. 10 point 1, point 2 letter b of the ToR should be issued not earlier than 6 months before the submission deadline. The document referred to in Chapter VIII para. 10 point 2 lit. and the Terms of Reference should be issued not earlier than 3 mibefore the end of this period.

3. If in the country in which the contractor has its registered office or place of residence or place of residence there is a person to whom the document relates, the documents referred to in Chapter VIII, para. 10 of the Terms of Reference, they are replaced with a document containing the contractor`s statement, indicating the person or persons authorized to represent him or the statemente the person to whom the document was to relate, lodged before a notary public or before a judicial, administrative or professional or economic self-government body competent for the registered office or place of residence of the contractor or the place of residence of that person. The provision of para. 6 shall apply.

4. Contractor based in the territory of the Republic of Poland, in relation to a person having seatse to reside outside the territory of the Republic of Poland, to which the document referred to in Chapter VIII para. 8 point 1 of the Terms of Reference, submits the document referred to in chapter VIII para. 10 point 1 of the Terms of Reference, in the scope specified in art. 24 paragraph 1 points 14 and 21 of the Act. If in the country in which the person to whom the document was supposed to reside does not appear, such documents do not appear, it is replaced with the documentem containing the person`s declaration made before a notary public or before a judicial, administrative or professional or economic self-government body competent for the place of residence of that person.
