The subject of the order is the provision of a bus service including carriage of passengers, luggage and small animals on the route between the Modlin railway station and the Mazovia Airport Terminal (MPL). Warsaw Modlin, according to the bus timetable.

Main Site: The service will be carried out on the route betweenwith the Modlin railway station and the Mazovian Airport Terminal (MPL) Warsaw-Modlin.

1. The ordering party requires the provision of a service using:

1) at least three buses in very good condition, including two primary buses and one reserve bus, produced no earlier than in 2010,

2) at least one replacement bus, produced notearlier than in 2009,

Meet the technical conditions of buses indicated in the technical description of buses

2. The detailed description and manner of performing the subject matter of the orders are specified in the substantive provisions of the contract. Contractors who meet the conditions for participation in proceedings regarding competences or entitlements to conduct specific professional activities may apply for the award of the contract.If it results from separate regulations: The activity carried out for the needs of the order requires special entitlements, i.e. permission to perform the profession of road carrier, referred to in art. 5 of the Act of 6.9.2001 on road transport (Journal of Laws of 2017, item 2200), possibly a valid road transport license issued to persons based on a previous dateapplicable provisions.

2. At the request of the Awarding Entity, the Contractor is obliged to submit the following declarations and documents:

2.1) in order to confirm the Contractor's condition to participate in the proceedings referred to in point 1 of the permit to pursue the occupation of road carrier, referred to in Art. 5 of the Act of 6.9.2001 on road transport (Journal of Laws of 2017, item 2200), anvalidly licensed to carry out road transport on the basis of previously applicable provisions.

3. Contractors, who are not subject to exclusion, may apply for the award of a contract - Conditions of exclusion. 3.1) from the procedure for awarding a contract, the Contractor is excluded, in respect of which any of the circumstances referred to in art. 24 sec. 1 point 12-22 of the Public Procurement Law, with the exclusion of circumstances referred to in art. 24 sec. 1 point 13 letter d of the Public Procurement Law, and the circumstances referred to in art. 24 sec. 1 point 14 of the Public Procurement Law, if the person referred to in this provision has been convicted of an offense listed in art. 24 sec. 1 item 13 letter d of the Public Procurement Law,

3.2) from the procedure for awarding the contract, Contractors are excluded in relation to which thethe manifoldness referred to in art. 24 sec. 1 item 23 of Public Procurement Law,

3.3), the Contractor is excluded from the procurement procedure, in relation to which the circumstance referred to in art. 24 sec. 5 point 1 of the Public Procurement Law,

3.4), the Contractor is excluded in the cases provided for in the ToR with due regard to the relevant provisions of art. 24 sec. 7 Public Procurement Law,

3.5) The contractor who is to be excludedpursuant to art. 24 sec. 1 point 13 lit. a-c, item 14 (excluding the case of a final conviction for an offense referred to in point 13 (d), point 16 20 or Article 24 sec. 5 point 1 and the PPL, may provide evidence that the measures taken by him are sufficient to demonstrate its reliability, in particular to prove that the damage caused by the crime or crime has been repaired.notary, financial compensation for damage suffered or rectifying the damage, comprehensive explanation of the facts and cooperation with law enforcement agencies and taking specific technical, organizational and human resources measures that are appropriate to prevent further offenses or fiscal offenses or improper conduct of the Contractor. The provision of the first sentence is notis applied if the Contractor, being a collective entity, has been the subject of a final court ruling against applying for the order and the expiry of the prohibition specified in that judgment has not expired.

3.6) The Contractor is not subject to exclusion, if the Employer, taking into account the weight and special circumstances of the act The Contractor will consider as sufficient evidence presented on the basis of ppkt 3.5).

3.7) The Ordering Party may exclude the Contractor at any stage of the proceedings for the award of the order.

4. The Contractor may, in order to confirm the fulfillment of the conditions of participation in the proceedings, where appropriate, rely on the technical capabilities of other entities, regardless of the legal nature of the legal relationships that it has with him.

The Ordering Party did not specify this condition.

Cd. Section III. 1.1) -5. The Awarding Entity may, at any stage of the proceedings, consider that the Contractor does not have the required capacities if the Contractor's technical resources' involvement in other economic projects of the Contractor may have a negative impact on the implementation of the order. The Contractor shall attach to the offer a statement valid as of the day of submitting bids constituting a preliminary confirmation that:

6.1) is not subject to exclusioniu from the proceedings in the scope indicated in point 3,

6.2) meets the conditions for participation in the proceedings in the scope specified in Section III 1.1) point 1 and Section III.1.3) points 1

7. The declaration referred to in point 6, the Contractor is obliged to submit in the form of a single European order document, prepared in accordance with the standard form provided in the Commission Implementing Regulationopejska issued on the basis of art. 80 par. 3 of Directive 2014/25 / EU, hereinafter referred to as "single document." A single document completed by the Employer in the scope of Part I is Annex 2 to the Terms of Reference The Single Document The contractor is required to submit in accordance with the model constituting Annex 2 to the Terms of Reference. posted on the Purchase Platform along with the remaining documentation regarding the procedure for the award of the contract. Instructions for completing the EAT are available at www.uzp.gov.pl.

8. In the event of a joint application by the Contractors, a single document shall be submitted by each of the Contractors jointly applying for the order. These documents confirm the fulfillment of the conditions for participation in the proceedings and the lack of grounds for exclusion in the scope ofin which each of the Contractors demonstrates fulfillment of the conditions for participation in the proceedings and no grounds for exclusion.

9. If the Contractor refers to the resources of other entities, pursuant to the rules set out in art. 22a of the Public Procurement Law, in order to demonstrate the absence of grounds for exclusion and compliance with them, to the extent that they refer to their resources, the condition of participation in the proceedings alsodnolite documents regarding these entities

10. If the Contractor intends to entrust the execution of a part of the orders to subcontractors, in order to demonstrate the lack of existence of grounds for exclusion from participation in the procedure, submits uniform documents regarding subcontractors. If the Contractor demonstrating compliance with the conditions referred to in Section III.1.3) point 1, relies on the capacities of other entities, he must prove to the Employer that while performing the order, he will have the necessary resources of these entities, in particular by presenting the obligation of these entities to provide him with the necessary resources for the needs of the order, using the template of Annex 4 to the SETC. If the technical capacity of the entity referred to in Section III 1.1) point 4, do not confirmcompliance of the Contractor with the conditions of participation in the proceedings or the exclusion basis for these entities, the Employer requests that the Contractor, by the deadline specified by the Employer:

12.1) replaced this entity with another entity or entities, or

12.2) undertook to personally execute the relevant part of the order, if it demonstrates the technical capabilities referred to in the Section in the SectionIII.1.3), paragraphs 1
