The subject of the orders covers the service from 1.1.2019 to 30.11.2020, regular transport servicecarried out as part of the local public transport on the bus lines operating under the public transport system connecting the area of Gora Kalwaria with Warsaw, in the number of 374, 550 (in words: three hundred seventy four thousand seven hundred fifty) 10% / - 10% (plus ten / minus ten) wozokilometrow, also referred to as "wozokm." Contractor during the implementation of the subject of contractThe new one will have at least 4 (including 1 substitute) buses that meet the requirements described in Annex 1 to the ToR (Technical Guidelines for Buses) and requirements described in Chapter VI of the Terms of Reference.

1. Services will be provided on routes:

2. Assumptions for timetables, mileage and list of stops are attachments to the contract (Annex 4 to the Terms of Reference - Model contract with attachments).

3. The contracting authority provides for the possibility of ordering, referred to in Article 134 sec. 6 Public Procurement Law. The range of those fromamowień will not exceed 50% of the value of the basic order and may consist in extending the period of providing services or increasing the basic number of vehicle-kilometers within the duration of the contract. The Ordering Party shall provide supplementary orders on conditions not worse for the Employer than the basic order. The price of one vehicle-kilometer can not be higher than indicated in the contract concluded in the result of Chapter

Chapter A: Conditions for participation in the proceedings - 1.Our contractors may apply to Contractors who:

1) are not subject to exclusion on the basis of Article 24 paragraph 1 of the Public Procurement Law, with the exclusion of the case specified in art. 24 section 1 point 13 of the Public Procurement Law, and in Article 24 paragraph 1 point 14 of the Public Procurement Law, if a person who the speech in this provision was convicted of an offense. in-Art. 24 section 1 point 13 letter d of the Public Procurement Law, and are not subject to exclusion based on Art. 24 section 5 items 1, 2, 4 and 8 of the Public Procurement Law,

2) meet the conditions for participation in: a) competence or entitlements to perform a specific professional activity, if it results from separate regulations: - The Contractor meets this condition if he / she shows that he has a license referred to in art. 5 of the Road Transport Act (i.e. OJ from 2017 item 2200) granted for the period covering the date of execution of the order;

Chapter B: The grounds for exclusion of the contractor, referred to in art. 24 sec. 5 points 1, 2, 4 and 8 of the Public Procurement Law (optional premises)

Additionally, the Contracting Authority foresees that the Contractor will be excluded: - 1. in relation to which the liquidation has been opened, in the system approved by the court in the restructuring proceeding isthe satisfaction of the creditors by the liquidation of his property or the court ordered the liquidation of his property pursuant to art. 332 par. 1 of the Act of 15.5.2015. Restructuring law (Journal of Laws of 2015, item 978, 1259, 1513, 1830 and 1844) or whose bankruptcy was announced, with the exception of the Contractor who, after the bankruptcy, concluded an arrangement approved by a legally binding decision court, if the system does notsees the satisfaction of creditors by liquidating the assets of the bankrupt, unless the court ordered the liquidation of its assets in accordance with art. 366 para. 1 of the Act of 28.2.2003 Bankruptcy Law (Journal of Laws of 2015, item 2333, 978, 1166, 1259 and 1844), - 2. In the manner of a serious culpable violation of professional duties, which undermines its integrity, in particular when the Contractor as a result of the intended action or the offensenegligence did not perform or improperly performed the order, which the Purchaser is able to demonstrate by means of appropriate evidence, - 3.ktorory, for reasons attributable to him, did not perform or improperly performed significantly prior agreement on public procurement or concession contract, concluded with the ordering party referred to in art. 3 par. 1 points 1-4, which led to-termination of the contract or award damages,

4.ktorory violated obligations relating to payment of taxes, fees or social security or health insurance contributions, which the Employer is able to demonstrate by means of appropriate evidence, except in the case referred to in paragraph 1 point 15 of the Public Procurement Law, unless the Contractor has made payments of taxes, fees or insurance premiums due-social security or social security, including interest or fines or a binding agreement on the repayment of these claims.

Chapter C: Statements and documents confirming that the Contractor meets the conditions for participation in the proceedings and no grounds for exclusion

1. Each Contractor must enclose with the offer a statement as at the day of submitting bids in the scope indicated in Annex No. 3 to the SIW-Z CAKE. The information contained in the statement will constitute preliminary confirmation that the contractor is not subject to exclusion and meets the conditions for participation in the proceedings. According to art. 25a para. 2 Public Procurement Laws if the value of the order is equal to or exceeds the amounts specified in the regulations issued on the basis of art. 11 para. 8, the statement referred to in Chapter X.1 of these SIWZ, the contractor submits in the form ofa blank document drawn up in accordance with the standard form provided for in the European Commission Implementing Regulation issued on the basis of art. 59 par. 2 of Directive 2014/24 / EU. To this end, the following steps should be taken: - a) from the Employer's website where the document SIWZ has been made available, download the XML file named "JEDZ"

b) enter the website https: //ec.europa.eu/growth/tools-databases/espd/filterlang=us

c attached to its submission

d) choose the option "I am the contractor" (this option should also be ticked if the form EAT is filled in by the entity for which the resourcesinvokes the Contractor)

e) import the previously downloaded file

f) fill in the form EED

g) generate an electronic document EAT in the form .xml or .pdf and save it on the disk

h) sign the above document by qualified electronic signature

i) secure the above document with an access password or put it in an archive with an access password (eg 7zip). Warning!!! The contractor publishes the passwordto the file "EAT" in the content of its offer, submitted in writing.

1. The Contracting Authority provides for the application of the procedure referred to in art. 24aa of the Public Procurement Law. The Awarding Entity will first evaluate the offer and then examine whether the Contractor whose tender has been rated as the most advantageous is not subject to exclusion and whether he meets the conditions for participation in the proceedings. If the Contractor whose offer will be onvalued as the most advantageous, evades the conclusion of the contract or fails to provide the required security for due performance of the contract, the Ordering Party will examine whether it is not subject to exclusion and whether the conditions for participation in the procedure are met by the Contractor who submitted the highest rated offer from the remaining offers. According to art. 36a paragraph 2 point 1 of the Act on Public Procurement Law (Journal of Laws of 2017, item 1579)The applicant reserves the obligation of the Contractor to perform personally the key parts of the order, i.e. the transport service. Other activities may be entrusted to subcontractors.

3. The Contractor will be bound by the offer for a period of 60 days. The period of being bound by the offer starts as soon as the deadline for submission of tenders expires
