The subject of the orders covers the provision from 1 December 2018 (planned) to 30.11.2021on the bus lines operating within the public transport system connecting the area of Lesznowola commune with Warsaw, in the number of 2 076 000 (in words: two million seventy six thousand) 10% / - 10% (plus ten / minus ten percent) ) wozokilometrow.

1. Objects zamoThe contract includes the provision in the period: 1.12.2018 (planned) - 30.11.2021 regular transport services performed as part of local public transport on bus lines operating under the public transport system connecting the area of Lesznowola commune with Warsaw, in the number of 2 076 000 (in words: two millions seventy six thousand) 10% / - 10% (plus ten / minus ten percent)car-km 2. Services will be provided on routes:

L-1 PKP Piaseczno Dworcowa Orężna Łoziska Kuleszowka Łazy Magdalenka Lesznowola Janczewice Falenty CH Janki

L-3 PKP Piaseczno Polish Army Słoneczna Lesznowola Magdalenka Łazy Wola Mrokowska Jastrzębiec (selected courses implement drives to Os Walendia). 3. Establishment for timetables, mileage and list-stops are attachments to the contract (Annex No. 5 to the Terms of Reference - Model contract with attachments).

4. The ordering party provides for the possibility of ordering, referred to in art. 134 sec. 6 Public Procurement Law. The scope of these orders will not exceed 50% of the value of the basic order and may consist in extending the service deadline or increasing the basic number of transport vehicles during the periodand contracts. The Employer gave the orders referred to in art. 134 sec. 6 of the Public Procurement Law, on conditions not worse for the Employer than the basic order. The price of one vehicle-kilometer can not be higher than indicated in the contract concluded as a result of the resolution of this tender.

Subcontractors: Pursuant to art. 36a paragraph 2 point 1 of the Public Procurement Law, the Employer reserves the obligation to perform it personally by Wykthe vendor of the key parts of the order, i.e. the transport service. Other activities may be entrusted to subcontractors.

Chapter A: Conditions for participation in the proceedings

1.Ordering the contract may be applied to Contractors who:

1) are not subject to exclusion from the proceedings under Art. 24 sec. 1 of the Public Procurement Law, with the exclusion of the case specified in art. 24 sec. 1 point 13 lit. d of the Public Procurement Law and in the case ofreferred to in art. 24 sec. 1 point 14 of the Public Procurement Law, if the person referred to in this provision has been convicted of an offense listed in art. 24 sec. 1 point 13 lit. d of the Public Procurement Law and are not subject to exclusion from the proceedings pursuant to art. 24 sec. 5 points 1, 2, 4 and 8 of the Public Procurement Law,

2) meet the conditions for participation in proceedings in the scope of: a) competences or entitlements to conduct specific activitiesprofessional, if it results from separate regulations: - the Contractor meets this condition if he proves that he has a license referred to in art. 5b of the Act of 6.9.2001 on road transport (ie the Journal of Laws of 2017, item 2200, as amended) granted for the period covering the date of execution of the order;

Chapter B: Grounds for exclusion referred to in Article . 24 sec. 5 points 1, 2, 4 and 8 of the PPL Act (premiseand optional)

In addition, the Employer foresees the exclusion of the Contractor:

1. in relation to which the liquidation was opened, the court approved in the restructuring proceeding is expected to satisfy the creditors by liquidating its assets or the court ordered the liquidation of its property in accordance with art. 332 par. 1 of the Act of 15.5.2015. Restructuring Law (Journal of Laws of 2015, item. 978, 1259, 1513, 1830 and 1844) or whose bankruptcy was announced, with the exception of the Contractor who, after the bankruptcy, concluded a system approved by a legally valid court order, if the arrangement does not provide for the satisfaction of the creditors by liquidating the bankrupt's assets, unless the court ordered the liquidation of its assets in art. 366 para. 1 of the Act of 28 February 2003 on Bankruptcy Law (Journal of Laws of 2015-Pos. 233, 978, 1166, 1259 and 1844),

2.ktory in the manner of culpable seriously violated professional duties, which undermines his integrity, in particular when the Contractor as a result of intentional action or gross negligence did not perform or improperly performed the order, what the Employer is in able to show by means of appropriate evidence,

3.ktory, for reasons attributable to him, he did notor improperly performed, to a significant extent, an earlier public procurement contract or concession contract, concluded with the ordering party referred to in Art. 3 par. 1 point 1-4, which led to the termination of the contract or compensation,

4.ktorory violation of obligations relating to tax payments, fees or social security or health insurance, which the Purchaser is able to demonstrate-by means of appropriate evidence, except in the case referred to in paragraph 1 point 15 of the Public Procurement Law Act, unless the Contractor paid the due taxes, fees or social security or health insurance contributions with interest or fines or has entered into a binding agreement regarding the repayment of these debts.

Chapter C: Statements and documents confirming that the Contractor met inarunkow participation in the proceedings and no grounds for exclusion

1. To the offer, each Contractor shall attach, valid as of the day of submitting bids, a statement constituting preliminary confirmation that the Contractor is not subject to exclusion and meets the conditions for participation in the proceedings. The declaration must be submitted in the form of a single document (EED), drawn up in accordance with the specimen of the standard form specifiedo in an executive regulation of the European Commission issued on the basis of art. 59 par. 2 of Directive 2014/24 / EU and art. 80 ust. 3 of Directive 2014/25 / EU, in the scope indicated in Appendix No. 3 to the ToR.

2. The Contracting Party informs that the Contractor, when filling in the form EAT, may use the tool available at https://ec.europa.eu/growth/tools- databases / espd / filter lang = pl

This should be donetake the following steps:

a) from the Ordering Party's website, on which the document SIWZ has been made available, download the XML file named 'EAT'

b) go to https://ec.europa.eu/growth/tools-databases / espd /

c) choose the appropriate language version (in the case of submitting the EAT form in a language other than the Polish version, please enclose with the offer a translation signed by the person(d) choose the option "I am the contractor" (this option should also be selected if the form FADS is filled in by the entity for which the Contractor relies)

e) import the previously downloaded file

f) form (it is recommended to save the completed form)

g) print, sign and attach to the offer

h) sign the above-mentioned document with a qualified signature electroni(i) secure the above document with an access password or put it in an archive with an access password (eg 7zip). Note: The Contractor places the password to access the EJF file in the content of its offer submitted in writing.

1. The Contractor will be bound by the offer for a period of 60 days. The period of being bound by the offer starts as soon as the deadline for submission of tenders expires.

2procedure referred to in art. 24aa of the Public Procurement Law. The Awarding Entity will first evaluate the offer and then examine whether the Contractor whose tender has been rated as the most advantageous is not subject to exclusion and whether he meets the conditions for participation in the proceedings. If the Contractor, whose offer will be evaluated as the most advantageous, will avoid concluding the contract or will not bring the required securitydue to the proper performance of the contract, the Ordering Party will examine whether it is not subject to exclusion and whether it meets the conditions for participation in the proceedings. The Contractor who submitted the highest rated offer from the remaining offers.

3.Do offer (the offer form must be compatible with the enclosure 2 to the Terms of Reference) be attached:

a) statements and documents listed in chapter X of the ToR; Note: a statement in the form of EATbe drafted and transmitted in an electronic version on the terms specified in chapter XIII.2 of the SETC

b) power of attorney to submit an offer, in case when the power to represent the Contractor does not arise from the registration documents. The power of attorney should be submitted in the original or a copy certified for compliance with the original notary; c) in the case of Contractors jointly applying-for ordering: a power of attorney appointing a representative to represent them in the proceedings for the award or representation in the procedure and conclusion of the contract on the order; d) proof of payment of the bid security (in accordance with the requirements set out in chapter XI.5 of the ToR).
