1. The subject of the Order is the provision of public mass transport services (regular transport as part of local public transport, i.e. communicationcity) on lines 84 and 87 in Rumia and Reda, all days of the week, two low-floor city buses.

1. The subject of the Order is the provision of public mass transport services (regular transport within local public transport, i.e. public transport) on lines 84 and 87 in Rumia and Reda, all days of the week, two city buses, lowunder the driving schedules constituting Annexe No. 1a to the ToR.

2. Estimated number of vehicle-kilometers in the Order period: 330 998 (three hundred thirty thousand nine hundred and ninety eight).

3. The period of the implementation of the Order: 1.12.2018 31.12.2020, where: - - 1.12.2018 is the expected date of commencement of the service by the Contractor; this date may change in youof the Employer's actions related to the subject matter of the proceedings, - completion of the implementation of the Order for the service of line 87 may take place before December 31, 2020, but at the same time not earlier than on December 30, 2020, if in connection with the putting into service of the integration node "Rumia Janowo" The Municipality of Rumi will decide on the liquidation of line 87 and replace it with a trolleybus line.

4. The provision of services is to be two low-floor city buses, type: - MV, length from 11.50 m to 13.50 m. • Means (strictly required by ZKM): - conditions specified in the Ordinance of the Minister of Infrastructure of December 31, 2002 on the technical conditions of vehicles and the scope of their necessary equipment (consolidated text: Journal of Laws of 2015, item 305) andtechnical-utility arameters specified in Annex 1 to the ToR.

5. The Employer allows in so-called during the transitional period, i.e. - during the first 9 months from signing the contract if buses were offered for the production year 2019 or later,

- within the first 3 months from signing the contract if the buses were not offered for the production yearand 2019 or later. - Delivery of low-floor city bus services of the type: - MV from length 11.50 m to 13.50 m. • Means (absolutely required by ZKM): - conditions specified in the Ordinance of the Minister of Infrastructure of 31.12. 2002 on the technical conditions of vehicles and the scope of their necessary equipment (consolidated text, Journal of Laws of 2015, item 305) and

- parametertechnical and operational grounds specified in Annex 1 to the ToR.

1. Contractors who are not subject to exclusion from the Procedure for awarding a Contract pursuant to art. 24 sec. 1 point 13) point 23) of the Act

2. The Procurer will exclude the Contractor based on art. 24 sec. 5 point 1) point 8) of the Act - 3. The contractor is obliged to have a mealgive current permit to perform the occupation of road carrier, referred to in art. 5 section 1 of the Act of 6.9.2001 on road transport (unified text Journal of Laws of 2017, item 2200) or current license for the national road transport, issued on the basis of previously applicable provisions - Assessment of compliance with conditions required from the Contractors will be made according to the formula-"0 1", i.e. In the case of Contractors jointly applying for the award of the Contract, the condition described in item 3 above may be met jointly by the group of Contractors jointly applying for the award of the Order.

The offer must be valid as of the day of submitting initial offers a statement confirming that the Contractor is not subject to exclusion and meets the conditions for participation in the Proceedingse - the Contractor is obliged to submit in the form of a single document (Annex No. 2 to the Terms of Reference). a) In the case of an offer submitted by Contractors jointly applying for the award, the requirement to submit a single document applies to each of the Contractors jointly applying for - Granting the Order . These documents confirm fulfillment of the conditions for participation in the Proceedings and bk grounds of exclusion to the extent that each of the Contractors demonstrates compliance with the conditions of participation in the Procedure and no grounds for exclusion. b) If the Contractor relies on the resources of other entities under the terms specified in art. 22a of the Act, in order to demonstrate the absence of any grounds for exclusion from participation in the Procedure and compliance with them, to the extent that the Contractor relies on andresources, conditions of participation in the Procedure, submit uniform documents regarding these entities - "meets" "does not meet" on the basis of statements contained in the single European order document (Annex 2 to the Terms of Reference) attached to the offer submitted in the Proceedings. The Contracting Authority provides for the possibility of supplementary procurement based on Art. 67 sec. 1 point 6 of the Actin the single-source order mode, the value of which will not exceed 20% of the value of the basic order.

2. The supplementary orders will consist in the repeated delivery of the same type of procurement, i.e. the provision of public mass transport services (regular transport within local public transport, i.e. public transport), specified by the CPV code: 60100000-9 Services in the areaesie of road transport.

3. The Employer allows the possibility of changing the content of the contract concluded in the following cases:

3.1 change of the Contractor's bank account number,

3.2 change of contact details of the Contractor,

3.3 change of the line designation and / or brigade numbers,

3.4 change in the form of performance bond ;

3.5 changes of the entity indicatedin Annex 13 to the ToR, Annex No. 3 to the contract template, -7 points. 6.

All of the above changes must be made in writing under pain of nullity.

4. The Employer allows the possibility of changing the content of the contract (pursuant to Article 144 paragraph 1 of the Act) concluded as a result of this Procedure in the following cases:

4.1 changes in traffic conditions or in the case of changes in meshpassengers, the Ordering Party allows the possibility of changes to the provisions of the contract regarding the rules of organization of transport, 4.2 the necessity to introduce changes to bus equipment, necessary to implement the subject of the contract or changes in functionality of the required equipment of these buses The Contracting Authority allows the possibility of changing the provisions of the contract regarding bus equipment; Deploythe integrated charging system based on an electronic ticket in the LGU of the Pomeranian voivodship, forming the ZIT Union, the Contracting Authority allows for the amendment of the provisions of the concluded agreement with respect to the rules for the sale of tickets and the content of -5 of Annex No. 3 to the contract; impact on the content of the contract (from the date of entry into force of the regulations-specifying a change, e.g. a change in the VAT rate on the subject of this public order),

4.5 increase by the Contractor of the subject of the contract entrusted to the subcontractor / subcontractors in relation to the contents of the offer and entrusting - in the case where the Contractor, in the submitted offer, provided for the subcontracting / subcontracting of subcontractscom) performance of the contract subject subcontractors / subcontractors.

4.6 completion of implementation Contracts for the service of line 87 may take place before December 31, 2020, but at the same time no earlier than on December 30, 2020, if in connection with the commissioning of the node of the integrative "Rumia Janowo" The Municipality of Rumia will decide on the liquidation of line 87 and replace it with a trolleybus line.The changes referred to in 4.4 may only be introduced if both parties to the contract (the Employer and the Contractor) agree that the circumstances indicated and changes are necessary and necessary for the proper performance of the contract. Ww. changes must be made in writing under pain of nullity.

The change indicated in point 4.5 must be made in writing inngorem of invalidity and transfer to the Employer by the Contractor in writing under pain of nullity of data on the name (company) and registered office of subcontractors / subcontractors and the scope of the contract entrusted to subcontractors / subcontractors to implement within seven days before the date of commencement of services by subcontractor / subcontractors.
