1. LOT 1: 36, 541, 541, 09 RON excluding VAT

Requirement no. 1

The economic operators participating in the procedure must not comply with the situations provided in art. 164 of Law no. 98/2016 regarding public procurement.

Compliance with the requirement no. 1:

The economic operator (leader, associate, third sustinator, subcontractor) will complete the DUAE form from the award documentation, with the information related to his situation. The DUAE will be presented in xml format. The DUAE xml form is made available to the bidders in SEAP / SICAP. 2

The economic operators participating in the procedure must not comply with the situations provided in art. 165 of Law no. 98/2016 regarding public procuremente.

The mode of meeting the requirement no. 2:

The economic operator (leader, associate, third party supporter, subcontractor) will complete the DUAE form from the award documentation, with the information related to his situation. The DUAE will be presented in xml format. The DUAE xml form is made available to the bidders in SEAP / SICAP.

Requirement no. 3

The economic operators participating in the procedure must not enterin the situations provided in art. 167 para. 1 of Law no. 98 / 2016.

The method of fulfilling the requirement no. 3:

The economic operator (leader, associate, third party supporter, subcontractor) will complete the DUAE form from the DA with the information related to his situation. ofthe landowner ranked in the first place in the intermediate ranking, drawn up at the end of the evaluation.

In case of submitting an offer in the association, each associate has the obligation to demonstrate the fulfillment of the requirement. The economic operator (leader, associate, third party supporter, subcontractor) will complete the corresponding request, in the DUAE form from DA, with the information related to his situation.

Request no. 4-Statementon his own responsibility regarding the failure to comply with the provisions of art. 59 (avoiding conflict of interests) of Law no. 98/2016. The economic operators participating in the procedure must not comply with the situations provided in art. 60 paragraph 1 bed d and e of Law no. 98 / 2016.

The method of fulfilling the requirement no. 4:

Communication and data transmission rules: requests for clarifications regarding this award documentation will be addressed exclusively in SEAP (SICAP) to the section "Requests for clarification / Questions / Communications" within the award procedure carried out by electronic means, and the answers to these will be published in SEAP (SICAP) within the same Sectionions for the announcement of simplified participant

For the transmission of requests for clarifications regarding the award documentation, the economic operators will register in SEAP (www.e-licitatie.ro) as economic operator according to the provisions of art.5 paragraph (1) of H.G. no.395 / 2016 and will submit the requests taking into account the response time of the contracting authority provided in art.160-161 of Law no.98 / 2016.

Any communication, request, information, notificationRe and the like, are transmitted in writing, by electronic means of communication or, as an exception, by other means than electronic ones. following the evaluation of the offers, two or more offers are ranked 1st, having the same total score, the declared declared winner will be whataa of the tenderer who obtained the highest score related to the evaluation factor "the price of the offer".

If, following the evaluation of the offers, two or more offers are ranked on the first place, having the same total score, respectively the same score related to the factor of evaluation of the "offer price" and the same score related to the technical evaluation factors, then the contracting authority will askit is only for these bidders to recharge in SEAP a new price offer, until a single offer will be split.
