Dragomiresti-Vale Town Hall, as contracting authority intends to award the public procurement contract having as object Technical project elaboration, technical assistance from the designer during the execution period of works and execution of works for the investment object "Modernization of streets in the locality* The personal situation of the candidate or tenderer: - Information and formalities necessary for evaluating if requirements are met:

1) Tenderers, third parties and subcontractors shall not find themselves in the situations referred to in Articles 59, 60, 164, 165, 167 of the Law no. 98/2016. The manner by which the above mentioned requirements can be demonstrated: - - the DUAE will be filled by the economic operators participating in the award procedure (including any third parties and subcontractors) with the information related to their situation. The supporting documents proving the fulfillment of the assumed ones by completing the DUAE will be submitted, at the request of the contracting authority, only by the tenderer placed on the first place in the intermediate rankings drawn up at the completion of the evaluation of the bids.

These documents will be: - - certificates showing the lack of overdue debts regarding the payment of taxes or contributions to the consolidated general budget (local budget and state budget) at the moment- the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the economic operator or of the persons having the power to represent, decide or control it, as it results from the certifying certificate issued by the ONRC / constitutive act,

- as the case may be, documents demonstrating that opthe economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of the Public Procurement Law 98/2016; 2) The declaration of non-compliance with the provisions of art. 60 together with the DUAE by all participants in the award procedure (bidder, associate, subcontractor and third party). Capacity to exercise professional activity, including requirements for enrollment in professional or trade registers.

Economic operators submitting a bid must prove a form of registration under the law of the country of residence, the economic operator is legally constituted, is not in any of the situations the cancellation of the establishment and the fact that it has the professional capacity to carry out actsthe contracts covered by the contract. Modality by which the fulfillment of the requirement can be demonstrated: It will be completed by the economic operators participating in the award procedure with the information related to their situation. The interaction with the bidders, follow these rules: To view the assignment documentationuploaded to the SICAP, economic operators must have a program to view the electronically signed files (the websites of the electronic signature providers). Rules for communication and data transmission: Requests for clarification regarding this tender documentation will be addressed exclusively in the SICAP under the "Questions" section of the award procedure dand the responses to them will be published in the SICAP in the "Documentation, clarifications and decisions" section of the simplified participation notice. For subsequent posting submissions: the evaluation committee will forward the clarification requests regarding the bid by using technical facilities available in SICAP (section "Intrebari ") The way interested economic operators can access the DUAE for completion will be accessed through the following link: https://ec.europa.eu/growth/tools-databases/espd/filter or https: // ec. europa.eu/tools/espd The evaluation committee will analyze the DUAE in correlation with the requirements set out in the acquisition data sheet. The evaluation committee will review and check each offer inin view of the proposed technical elements, and subsequently in terms of the financial aspects involved. Upon completion of each of the verification phases set out above, the contracting authority will enter the accepted / rejected result in the SICAP and will open the SICAP submission session for the submission of supporting documents for the DUAE submitted by the bidder on the first place in thethe intermediary plan drawn up at the end of the evaluation of the tenders, granting a deadline. The economic operators will send the answers to the clarifications and any documents requested during the evaluation of the offers via the SICAP (section "Questions"), in electronic format, signed with the electronic signature, according to the Law 455/2001.of the contract for the works.

Note:

1) The way of awarding the bids ranked first after applying the award criteria: In the case of bids with the same rank placed in the first place for grading, the contracting authority (through SICAP in the " Questions ") will request re-submission by submitting a new financial proposal (equal or lower than the one depositedinitial). The new financial proposal will be submitted only and only following the request of the contracting entity
