a) DUME: principle and concept

Pursuant to article 38 of the Royal Decree of 18.4.2017, in accordance with article 73of the law of 16.6.2017, at the time of submission of its bid, the tenderer must complete the Single European Market Document (hereinafter).

The DUME is a declaration on official honor, serving as a priori evidence in lieu of and place certificates issued by public authorities or third parties, whereby the economic operator asserts:

1) that he is not in one of the situations, vsections 67 to 69 of the Act, which must or may lead to the exclusion of bidders; (2) that it meets the applicable selection criteria established in accordance with Article 71; provide the relevant information required by the contracting authority.

The DUME is composed of 6 parts. In the context of this contract, the tenderer will have to complete the partsII (), III (), and IV (), and VI ().

Parts I and V should therefore not be completed by the tenderer:

- Part I deals with information relating to the procedure for awarding the contract and to the contracting authority, Part V deals with the possibility of reducing the number of selected candidates. However, the contracting authority does not make use of this possibility; b) delivery of the DUMEby electronic means (procedure to complete the DUME):

As for the signature of the DUME, we will note that, in accordance with article 42, -1of the Royal Decree of 18.4.2017, the DUME and the offer are signed (electronically) in a global manner by affixing a signature on the deposit report relating thereto. The tenderer must therefore not sign these documents individually (and therefore must not sign the DUME individually) when he uploads them on the e-Tendering platform;

c) Number of DUMEs to fill, as the case may be:

With regard to part IV of the DUME relatesive to the selection criteria, the contracting authority decides (Article 38 (2) AR) to request economic operators to fill in the details by completing sections A to D;

1) a copy of the financial statements (balance sheets and accounts). the last 3 financial years, showing the turnover and annual profit before taxes (article 67, -1, paragraph 2, 1 of the Royal Decree18.4.2017);

2) a bank certificate declaring the good health of the company and its good relations with its bank (article 67, -1, paragraphs 2, 3 of the Royal Decree of 18.4.2017).
