The subject of the contract is to perform an evaluation study: "Ex-ante evaluation of projects strategic and program documents of the Pomeranian Voivodship for the financial perspective 2021 ".

The subject of the contract is the performance of an evaluation study:" Ex-ante evaluation of draft strategic and program documents of the Pomeranian Voivodship for the financial perspective 2021 ".

Regulations regarding the subject of the contract are indicated in Annex 1 to the ToR, which is in the draft contract annexed No. 8 to the ToR.

The Employer does not reserve the obligation of personal performancekey parts of the contract by the Contractor. The Contractor may entrust the execution of part of the Subcontractor`s order. In such a situation, the Employer requests the Contractor to indicate the part of the contract which it intends to entrust to Subcontractors and to provide the Contractor with companies from Subcontractors (if known).

The Contractor will be obliged to complete the subject of the contract within: stage I exante of the draft Strategy for the Development of the Pomeranian Voivodship 2030

Up to 22 weeks from the date of the contract; stage II ex ante evaluation of the draft Pomeranian Voivodship Regional Operational Program for 2021-2027 up to 22 weeks

From the submission by the Employer of the draft Pomeranian Voivodship Regional Operational Program for 2021-2027

Additional information

1. The Contractor`s offer has beennot rejected pursuant to the principles specified in art. 89 of the Public Procurement Law

2. The Purchaser does not allow the submission of variants.

3. The Purchaser does not allow the submission of partial bids.

4. The awarding entity does not envisage the award of contracts referred to in art. 67 section 1 item 6 of the Public Procurement Law

5. Settlements between the Employer and the Contractor will be conducted in PLN.

6. The Employer does not provide for aelectronic section.

7. The Awarding Entity does not provide for reimbursement of the costs of participation in these proceedings.

8. The contracting authority does not envisage the conclusion of a framework agreement.

9. The Employer does not anticipate establishing a dynamic purchasing system.

10. The proceedings are conducted in Polish.

1. Contractors who can apply for the contract:

1.1. are not subject to exclusion:

1) from the proceeding regarding participationno contractor is excluded, in relation to which any of the circumstances referred to in art. 24 paragraph 1 point 12-23 of the Public Procurement Law;

2) the Contractor shall be excluded in accordance with art. 24 paragraph 7 of the Public Procurement Law;

3) Contractor who is subject to exclusion pursuant to art. 24 paragraph 1 point 13 and 14

And 16-20 of the Public Procurement Law, can provide evidence that the measures taken by him are sufficientto prove its reliability, in particular to prove compensation for damage caused by a crime or tax offense, monetary compensation for harm suffered or compensation, comprehensive explanation of the facts and cooperation with law enforcement authorities and taking specific technical, organizational and personnel measures that are appropriate for preventionfurther offenses or fiscal offenses or incorrect conduct of the Contractor. The regulation referred to in the first sentence shall not apply if the Contractor, being a collective entity, has been ordered by a final court judgment to apply for the contract and the period of validity of the prohibition specified in that judgment has not expired.

4) The Contractor shall not be excluded, if the Employer, taking into account the importance of

and the special circumstances of the Contractor`s act, deems sufficient evidence presented pursuant to item 3) above., i.e.:

a) The contracting authority will deem the condition fulfilled if the contractordemonstrates that he duly performed within the last 5 years before the deadline for submission of bids, and if the period of business activity is shorter, within this period, at least 3 services of research and / or analysis and / or evaluation of public intervention with a value of min. PLN 150, 000 gross each.

Note! The Employer requires that in the case of Contractors jointly applying for the award of the contractthe entire experience required by this point has been demonstrated by at least one of the Contractors jointly competing for the contract. ), consisting of a team coordinator and at bestfewer 7 people capable of performing the contract, meeting the following conditions:

Team coordinator a person who, within a period of 5 years before the deadline for submitting bids, was the team coordinator in at least 2 studies and / or analyzes and / or evaluations in the field of public intervention on minimum values PLN 150, 000 gross each;

1 person has experience within 5 years before the expirythe deadline for submitting bids for the implementation of at least 2 studies and / or analyzes and / or evaluations regarding entrepreneurship and / or innovation and / or research and development and / or industry 4.0;

1 person has experience within 5 years before the deadline for submitting bids in the implementation of at least 2 studies and / or analyzes and / or evaluations concerning social assistance and integration;

1 person has experiencecombining within 5 years before the deadline for submitting offers in the implementation of at least 2 studies and / or analyzes and / or evaluations regarding education and / or professional activation and / or culture and / or leisure services;

1 person has experience in the period of 5 years before the deadline for submitting bids for the implementation of at least 2 tests and / or analyzes and / or evaluations concerning health issues;

1 persona has experience in the period of 5 years before the deadline for submission of bids in the implementation of at least 2 tests and / or analyzes and / or evaluations regarding air quality and / or low-carbon economy (primarily refers to sectors:

ATTENTION!

For the purposes of assessing compliance with the conditions set out above, if the values are given in currencies other than the zloty, the Awarding Entity will adopt the average zloty exchange rate for that currency given by the National Bank of Poland on the day of publication of the announcement in the Official Journal The European Union. In the case of publication of the announcement on Saturday, the Purchaser will make the conversionof this currency into PLN at the average current exchange rate calculated and announced by the National Bank of Poland

2. The Employer may, at any stage of the procedure, recognize that the Contractor does not have the required capabilities, if the Contractor`s technical resources or professional involvement in otherEconomic activities of the Contractor may have a negative impact on the performance of the contract.

4. The Contractor may rely on the technical or professional ability or financial or economic standing of other entities to confirm compliance with the conditions for participation

In proceedings, where appropriate and in relation to a specific contract or part thereof, regardless of the legal natureits legal relations with him.

5. The Employer also informs that the "relevant situation" referred to in paragraph 4 above will occur only if:

1) The Contractor, which relies on the abilities or situation of other entities, will prove to the Employer that by carrying out the contract will have the necessary resources of these entities, in particular the commitment of thoseentities to put at the disposal of the necessary resources for the purposes of the contract;

2) The Employer assesses that the technical or professional capacity made available to the Contractor by other entities, or their financial or economic situation, allows the Contractor to demonstrate compliance with the conditions for participation in the procedure and will examine whether there are no grounds for exclusion for this entity,

3) with respect to the conditions related to education, professional qualifications or experience, Contractors rely on the abilities of other entities, if these entities provide services for which these abilities are required;

a) the scope of the contractor`s resources available to another entity;

b) the method of using the resources of another entity by the Contractor,

c) the scope and duration of the participation of another entity when performing the public contract;

d ) whether the entity on whose abilities the Contractor relies in relation to the conditions of participation in the proceedings regarding educationvaluation, professional qualifications or experience, will perform the services to which the abilities relate.

The offer must be secured with a deposit covering the period of the offer with a value of PLN 14, 000.00 (say: fourteen thousand zlotys) - detailed information in Chapter VIII of the ToR.

The contracting authority in the said procedure has set a deadline (see Chapter IV of the ToR) for completing the order in weeks (up to 22 weeks).

the deadline for completing the order in the Official Journal of the European Union is set in days. Thus, the Employer must convertweekly term for days. The civil code does not indicate the methodology for converting the weekly to daily period. Thus, the contracting authority has adopted a method of counting days based on the Civil Code regarding the calculation of the date specified in days (in the case when the beginning of the date marked in days is an event, when calculating the date the day on which the event is not taken into accountoccurred).

12. In the case of Contractors jointly applying for the contract

And in the case of other entities, on which the Contractor relies

On the principles set out in art. 22a of the Public Procurement Law, copies of documents regarding the Contractor or these entities, as appropriate, may be certified as true copies by the Contractor or by these entities or Contractorsfor applicants for a public contract, as appropriate, in respect of documents that affect each of them.

13. If the Contractor indicates the availability of declarations or documents referred to in this chapter in electronic form at specific internet addresses of publicly available and free databases, the Employer shall independently download the given data from these databases.ch statements or documents indicated by the Contractor. If the declarations and documents referred to in the first sentence are made in a foreign language, the contractor shall be obliged to present their translation into Polish.

14. Whenever in the ToR, as well as in the annexes to the ToR, there is a requirement to sign documents or statements or to confirm documents for compliance

With the original, it should be understood that these statements and documents should be accompanied by a qualified (qualified) electronic signature (signatures) of the person (s) authorized (authorized) to represent the Contractor / entity on the resources or situation which the Contractor relies in accordance with rules of representation indicated in the relevant register or authorized person (s)(s) to represent the Contractor / entity

15. If the contractor indicates statements or documents that are in the possession of the Employer, the contracting authority will use the statements or documents it has, as long as they are current, to confirm these circumstances.

16. Documents constituting attachmentsrequired by this specification should be completed by the Contractor in accordance with the conditions and provisions contained in the ToR. 17. Each time if this SIWZ refers to affixing / signing a document / statement with a qualified electronic signature, the Ordering Party requires that the qualified electronic signature be issued by the qualified trust service provider being the entityproviding certification services - an electronic signature that meets the security requirements set out in the Act of 5 September 2016 on trust and electronic identification services (Journal of Laws of 2019, item 162, as amended).
