Only bidders who are eligible for the contract are eligible for the fulfillment of the contractual obligations, the necessary aptitude (expertise and Leistungsfaeability) (-- 122 GWB, 44, 45, 46 VgV), and not acc. -- 123, 124 GWB are to be excluded (see also section III, no. 1.2). In deciding on the award, various criteria justified by the subject-matter of the contract will be taken into account (- 58 (2) VgV (see Section II No. 2.5). The surcharge is based on the most economical A taking into account all circumstancesngebot granted; the lowest bid price alone is not decisive (- 127 GWB).
