External review of Norwegian wages and working terms in Norwegian waters and on the Norwegian continental shelf

The Norwegian Parliament decided on a request resolution on the processing of the Revised National Budget 2017 after recommendations from the finance committee in the white paper 401 S - 2016-2017. In the request resolution n 1101 (2016-2017), the Norwegian Parliament has asked the government to review the option of setting requirements for Norwegian wages and working terms in Norwegian waters and on the Norwegian continental shelf. The review will, amongst other things, clarify the coastal state's leeway in Norwegian waters and on the Norwegian continental shelf without coming into conflict with the flag state principle.

The Ministry of Trade, Industry and Fisheries is responsible for the follow-up of the request resolution. A decision has been made to carry out an external review. The aim of the review is to highlight and discuss the options and challenges that come with setting requirements for Norwegian wages and working terms for mariners on foreign ships in Norwegian waters and on the Norwegian continental shelf.

Requirement: Paid taxes and duties.

Documentation Certificate, not older than 6 months, confirming that the tenderer has fulfilled his tax, social security and VAT obligations. The certificate can be ordered and obtained from Altinn from the separate link on skatteetaten.no. If this is not possible, it can be ordered from the tax collector or the Norwegian Tax Administration. The certificate is electronically certified and is therefore not signed. For further information, see skatteetaten.no. The certificate shall be enclosed with the tender in accordance with the outline given in the tender documents.

Foreign tenderers must provide certificates from equivalent authorities to the Norwegian authorities.

Requirements: The tenderer shall be a legally established company.

Foreign companies: Proof that the company is registered in a trade or business register as prescribed by the law of the country where the company is established.

Requirement: Tenderers must be able to refer to sufficient economic and financial capacity to carry out the delivery, in which, amongst other things, being creditworthy without any requirement for collateral will be adequate.

Documentation: A credit rating with key figures from a certified credit rating company or other documentation to demonstrate that the requirement has been met.
